77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of on-campus mental health services by a
1010 school district and reimbursement under Medicaid for certain
1111 services provided to eligible students.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1414 amended by adding Sections 38.042 and 38.043 to read as follows:
1515 Sec. 38.042. ON-CAMPUS MENTAL HEALTH SERVICES. (a) A
1616 school district may contract with a local mental health authority
1717 or a provider of community-based mental health services to provide
1818 mental health services on a campus of the district.
1919 (b) At the request of a student's parent or guardian, a
2020 local mental health authority or a provider described by Subsection
2121 (a) providing on-campus mental health services that conducts a
2222 mental health or behavioral health assessment of the student or
2323 provides mental health or behavioral health services to the student
2424 may provide to the student's primary care physician the results of
2525 any assessment conducted or services provided.
2626 Sec. 38.043. REIMBURSEMENT UNDER MEDICAID. The Health and
2727 Human Services Commission shall allow a school district to enroll
2828 as a provider under the medical assistance program under Chapter
2929 32, Human Resources Code, to provide and receive reimbursement for
3030 the provision of mental health services to district students who
3131 are medical assistance recipients.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2025.
