| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 39A.111, Education Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING. |
|---|
| 15 | 15 | | If 10 percent of campuses in a school district are [a campus is] |
|---|
| 16 | 16 | | considered to have an unacceptable performance rating for five |
|---|
| 17 | 17 | | consecutive school years, the commissioner, subject to Section |
|---|
| 18 | 18 | | 39A.112, may [shall] order: |
|---|
| 19 | 19 | | (1) appointment of a board of managers to govern the |
|---|
| 20 | 20 | | school district as provided by Section 39A.202; or |
|---|
| 21 | 21 | | (2) any action authorized under Section 39A.002 |
|---|
| 22 | 22 | | [closure of the campus]. |
|---|
| 23 | 23 | | SECTION 2. Section 39A.209(a), Education Code, is amended |
|---|
| 24 | 24 | | to read as follows: |
|---|
| 25 | 25 | | (a) Notwithstanding Section 39A.208, the commissioner shall |
|---|
| 26 | 26 | | [may] remove a board of managers appointed to govern a school |
|---|
| 27 | 27 | | district under Subchapter C [only] if each [the] campus that was the |
|---|
| 28 | 28 | | basis for the appointment of the board of managers under Section |
|---|
| 29 | 29 | | 39A.111 receives an acceptable performance rating for two |
|---|
| 30 | 30 | | consecutive school years. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2025. |
