77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to accountability interventions for certain school
1010 districts with low-performing campuses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39A.111, Education Code, is amended to
1313 read as follows:
1414 Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING.
1515 If 10 percent of campuses in a school district are [a campus is]
1616 considered to have an unacceptable performance rating for five
1717 consecutive school years, the commissioner, subject to Section
1818 39A.112, may [shall] order:
1919 (1) appointment of a board of managers to govern the
2020 school district as provided by Section 39A.202; or
2121 (2) any action authorized under Section 39A.002
2222 [closure of the campus].
2323 SECTION 2. Section 39A.209(a), Education Code, is amended
2424 to read as follows:
2525 (a) Notwithstanding Section 39A.208, the commissioner shall
2626 [may] remove a board of managers appointed to govern a school
2727 district under Subchapter C [only] if each [the] campus that was the
2828 basis for the appointment of the board of managers under Section
2929 39A.111 receives an acceptable performance rating for two
3030 consecutive school years.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2025.
