77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the enforcement of municipal rules, ordinances, or
1010 police regulations prohibiting illegal dumping; increasing a
1111 penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 54.001(b), Local Government Code, is
1414 amended to read as follows:
1515 (b) A fine or penalty for the violation of a rule,
1616 ordinance, or police regulation may not exceed $500 except that:
1717 (1) a fine or penalty for the violation of a rule,
1818 ordinance, or police regulation that governs fire safety, zoning,
1919 or public health and sanitation, other than the dumping of refuse,
2020 may not exceed $2,000; and
2121 (2) a fine or penalty for the violation of a rule,
2222 ordinance, or police regulation that governs the dumping of refuse
2323 may not exceed $10,000 [$4,000].
2424 SECTION 2. Section 29.003(a), Government Code, is amended
2525 to read as follows:
2626 (a) A municipal court, including a municipal court of
2727 record, shall have exclusive original jurisdiction within the
2828 municipality's territorial limits and property owned by the
2929 municipality located in the municipality's extraterritorial
3030 jurisdiction in all criminal cases that:
3131 (1) arise under:
3232 (A) the ordinances of the municipality; or
3333 (B) a resolution, rule, or order of a joint board
3434 operating an airport under Section 22.074, Transportation Code; and
3535 (2) are punishable by a fine not to exceed:
3636 (A) $2,000 in all cases arising under municipal
3737 ordinances or resolutions, rules, or orders of a joint board that
3838 govern fire safety, zoning, or public health and sanitation, other
3939 than the dumping of refuse;
4040 (B) $10,000 [$4,000] in cases arising under
4141 municipal ordinances that govern the dumping of refuse; or
4242 (C) $500 in all other cases arising under a
4343 municipal ordinance or a resolution, rule, or order of a joint
4444 board.
4545 SECTION 3. Article 4.14(a), Code of Criminal Procedure, is
4646 amended to read as follows:
4747 (a) A municipal court, including a municipal court of
4848 record, shall have exclusive original jurisdiction within the
4949 territorial limits of the municipality in all criminal cases that:
5050 (1) arise under the ordinances of the municipality;
5151 and
5252 (2) are punishable by a fine not to exceed:
5353 (A) $2,000 in all cases arising under municipal
5454 ordinances that govern fire safety, zoning, or public health and
5555 sanitation, other than the dumping of refuse;
5656 (B) $10,000 [$4,000] in cases arising under
5757 municipal ordinances that govern the dumping of refuse; or
5858 (C) $500 in all other cases arising under a
5959 municipal ordinance.
6060 SECTION 4. The changes in law made by this Act apply only to
6161 an offense committed on or after the effective date of this Act. An
6262 offense committed before the effective date of this Act is governed
6363 by the law in effect when the offense was committed, and the former
6464 law is continued in effect for that purpose. For purposes of this
6565 section, an offense was committed before the effective date of this
6666 Act if any element of the offense was committed before that date.
6767 SECTION 5. This Act takes effect September 1, 2025.
