77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to increasing the criminal penalty for certain acts of
1010 official oppression.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39.03, Penal Code, is amended by
1313 amending Subsection (d) and adding Subsections (e), (f), and (g) to
1414 read as follows:
1515 (d) Except as otherwise provided by this section, an [An]
1616 offense under this section is a Class A misdemeanor.
1717 (e) An[, except that an] offense under this section is a
1818 felony of the third degree if the public servant acted with the
1919 intent to impair the accuracy of data reported to the Texas
2020 Education Agency through the Public Education Information
2121 Management System (PEIMS) described by Sections 48.008 and 48.009,
2222 Education Code, under a law requiring that reporting.
2323 (f) An offense under this section is a felony of the second
2424 degree if the public servant, at the time of the commission of the
2525 offense, was a peace officer and:
2626 (1) caused bodily injury to another or threatened
2727 another with imminent bodily injury; and
2828 (2) while engaging in the conduct described by
2929 Subdivision (1):
3030 (A) caused serious bodily injury to another; or
3131 (B) used or exhibited a deadly weapon.
3232 (g) If conduct constituting an offense under this section
3333 also constitutes an offense under another section of this code, the
3434 actor may be prosecuted under either section or both sections.
3535 SECTION 2. The change in law made by this Act applies only
3636 to an offense committed on or after the effective date of this Act.
3737 An offense committed before the effective date of this Act is
3838 governed by the law in effect on the date the offense was committed,
3939 and the former law is continued in effect for that purpose. For
4040 purposes of this section, an offense was committed before the
4141 effective date of this Act if any element of the offense occurred
4242 before that date.
4343 SECTION 3. This Act takes effect September 1, 2025.
