11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Chapter 614, Health and Safety Code, is amended | |
13 | 13 | by adding Section 614.0175 to read as follows: | |
14 | 14 | Sec. 614.0175. CONTINUITY OF CARE AND SERVICES FOR CERTAIN | |
15 | 15 | OFFENDERS. (a) In this section: | |
16 | 16 | (1) "Local behavioral health authority" means an | |
17 | 17 | authority designated by the Health and Human Services Commission | |
18 | 18 | under Section 533.0356. | |
19 | 19 | (2) "Local mental health authority" has the meaning | |
20 | 20 | assigned by Section 531.002. | |
21 | 21 | (b) A local mental health authority or local behavioral | |
22 | 22 | health authority that receives notice that an individual to whom | |
23 | 23 | the authority provided services has been processed by a local jail | |
24 | 24 | may not refuse to provide services or discontinue services to the | |
25 | 25 | individual on that basis alone. | |
26 | 26 | (c) The Commission on Jail Standards shall require each | |
27 | 27 | local jail regulated by the commission to notify a local mental | |
28 | 28 | health authority or local behavioral health authority described by | |
29 | 29 | Subsection (b) before the jail releases an individual to whom the | |
30 | 30 | authority provided services to ensure the individual receives | |
31 | 31 | continuity of care and services. | |
32 | 32 | SECTION 2. This Act takes effect September 1, 2025. |
