88 AN ACT
99 relating to processes to ensure continuity of care and services for
1010 certain offenders.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 614, Health and Safety Code, is amended
1313 by adding Section 614.0175 to read as follows:
1414 Sec. 614.0175. CONTINUITY OF CARE AND SERVICES FOR CERTAIN
1515 OFFENDERS. (a) In this section:
1616 (1) "Local behavioral health authority" means an
1717 authority designated by the Health and Human Services Commission
1818 under Section 533.0356.
1919 (2) "Local mental health authority" has the meaning
2020 assigned by Section 531.002.
2121 (b) A local mental health authority or local behavioral
2222 health authority that receives notice that an individual to whom
2323 the authority provided services has been processed by a local jail
2424 may not refuse to provide services or discontinue services to the
2525 individual on that basis alone.
2626 (c) The Commission on Jail Standards shall require each
2727 local jail regulated by the commission to notify a local mental
2828 health authority or local behavioral health authority described by
2929 Subsection (b) before the jail releases an individual to whom the
3030 authority provided services to ensure the individual receives
3131 continuity of care and services.
3232 SECTION 2. This Act takes effect September 1, 2025.
