10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Article 42.15, Code of Criminal Procedure, is | |
12 | 12 | amended by adding Subsection (a-3) and amending Subsection (b) to | |
13 | 13 | read as follows: | |
14 | 14 | (a-3) When imposing fines and costs, a court may not require | |
15 | 15 | a defendant to pay more than five percent of the defendant's monthly | |
16 | 16 | income to satisfy the fines and costs, without the agreement of the | |
17 | 17 | defendant. | |
18 | 18 | (b) Subject to Subsections (a-3), (c), and (d) and Article | |
19 | 19 | 43.091, when imposing fines [a fine] and costs, a court may direct a | |
20 | 20 | defendant: | |
21 | 21 | (1) to pay the entire amount of fines [fine] and costs | |
22 | 22 | when sentence is pronounced; | |
23 | 23 | (2) to pay the entire amount of fines [fine] and costs | |
24 | 24 | at some later date; or | |
25 | 25 | (3) to pay a specified portion of the fines [fine] and | |
26 | 26 | costs at designated intervals. | |
27 | 27 | SECTION 2. The change in law made by this Act applies to a | |
28 | 28 | defendant who is sentenced for an offense on or after the effective | |
29 | 29 | date of this Act, regardless of whether the offense is committed | |
30 | 30 | before, on, or after that date. | |
31 | 31 | SECTION 3. This Act takes effect September 1, 2025. |
