77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the payment of certain fines and costs by a defendant.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 42.15, Code of Criminal Procedure, is
1212 amended by adding Subsection (a-3) and amending Subsection (b) to
1313 read as follows:
1414 (a-3) When imposing fines and costs, a court may not require
1515 a defendant to pay more than five percent of the defendant's monthly
1616 income to satisfy the fines and costs, without the agreement of the
1717 defendant.
1818 (b) Subject to Subsections (a-3), (c), and (d) and Article
1919 43.091, when imposing fines [a fine] and costs, a court may direct a
2020 defendant:
2121 (1) to pay the entire amount of fines [fine] and costs
2222 when sentence is pronounced;
2323 (2) to pay the entire amount of fines [fine] and costs
2424 at some later date; or
2525 (3) to pay a specified portion of the fines [fine] and
2626 costs at designated intervals.
2727 SECTION 2. The change in law made by this Act applies to a
2828 defendant who is sentenced for an offense on or after the effective
2929 date of this Act, regardless of whether the offense is committed
3030 before, on, or after that date.
3131 SECTION 3. This Act takes effect September 1, 2025.
