77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the registration and inspection of vehicles.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 382.0622(a), Health and Safety Code, as
1212 amended by Chapters 362 (S.B. 2102) and 851 (H.B. 3297), Acts of the
1313 88th Legislature, Regular Session, 2023, is reenacted and amended
1414 to read as follows:
1515 (a) Clean Air Act fees consist of:
1616 (1) fees collected by the commission under Sections
1717 382.062, 382.0621, 382.202, and 382.302 and as otherwise provided
1818 by law;
1919 (2) each amount designated [described] by Section
2020 548.510 [Sections 548.510(d)(3) and (e)(3)], Transportation Code,
2121 for deposit to the credit of the clean air account; and
2222 [(3) $6 from the portion of each fee collected for an
2323 inspection of a vehicle and remitted to the state under Section
2424 548.5035, Transportation Code; and]
2525 (3) fees collected that are required under Section 185
2626 of the federal Clean Air Act (42 U.S.C. Section 7511d).
2727 SECTION 2. Section 382.202(d-2), Health and Safety Code, is
2828 amended to read as follows:
2929 (d-2) If approved by the United States Environmental
3030 Protection Agency as part of the state's air quality state
3131 implementation plan, [provides for a three-year emissions
3232 inspection period for a vehicle described by Section 548.1025(a),
3333 Transportation Code:
3434 [(1) the system implemented by] the Department of
3535 Public Safety of the State of Texas shall provide under Subsection
3636 (d) [shall provide] for a three-year emissions inspection period
3737 for a vehicle registered under [described by] Section 502.0026
3838 [548.1025(a)], Transportation Code. The [; and
3939 [(2) the] commission shall establish and assess fees
4040 for an [the] emissions inspection conducted under this section [of
4141 a vehicle described by Section 548.1025(a), Transportation Code,]
4242 in amounts calculated to provide the same revenue that would be
4343 provided if the vehicle was inspected annually or biennially.
4444 SECTION 3. Section 502.0026(b), Transportation Code, is
4545 amended to read as follows:
4646 (b) Payment for all applicable fees, including any optional
4747 fee imposed under Subchapter H and other registration fees and the
4848 fee required by Section 548.510 [548.5035], for the entire
4949 registration period is due at the time of registration.
5050 SECTION 4. Section 502.044, Transportation Code, is amended
5151 by adding Subsection (a-1) and amending Subsection (e) to read as
5252 follows:
5353 (a-1) Notwithstanding Subsection (a), the department shall
5454 designate a vehicle registration period of 24 consecutive months to
5555 begin on the first day of a calendar month and end on the last day of
5656 the 24th calendar month for a passenger car or light truck that:
5757 (1) is sold in this state or purchased by a commercial
5858 fleet buyer described by Section 501.0234(b)(4) for use in this
5959 state;
6060 (2) has not been previously registered in this or
6161 another state; and
6262 (3) on the date of sale is of the current or preceding
6363 model year.
6464 (e) The department shall use the date of sale of the vehicle
6565 in designating the registration period [year] for a vehicle for
6666 which registration is applied [for] under Section 501.0234.
6767 SECTION 5. The heading to Section 548.510, Transportation
6868 Code, as amended by Chapters 851 (H.B. 3297) and 999 (H.B. 198),
6969 Acts of the 88th Legislature, Regular Session, 2023, is reenacted
7070 to read as follows:
7171 Sec. 548.510. INSPECTION PROGRAM REPLACEMENT FEE.
7272 SECTION 6. Section 548.510(a), Transportation Code, as
7373 amended by Chapters 851 (H.B. 3297) and 999 (H.B. 198), Acts of the
7474 88th Legislature, Regular Session, 2023, is reenacted and amended
7575 to read as follows:
7676 (a) In [Except as provided by Subsections (b) and (c), in]
7777 addition to other fees imposed at the time of registration, at the
7878 time of application for initial registration or renewal of
7979 registration of a motor vehicle, trailer, semitrailer, pole
8080 trailer, or mobile home, the applicant shall pay an annual fee of
8181 $7.50.
8282 SECTION 7. Section 548.510, Transportation Code, is amended
8383 by amending Subsections (b) and (c) and adding Subsection (e-1) to
8484 read as follows:
8585 (b) Instead of the fee provided by Subsection (a), an
8686 applicant shall pay a one-time fee of $16.75 if the application is
8787 for the initial registration of a passenger car or light truck under
8888 Section 502.044(a-1) [that:
8989 [(1) is sold in this state or purchased by a commercial
9090 fleet buyer described by Section 501.0234(b)(4) for use in this
9191 state;
9292 [(2) has not been previously registered in this or
9393 another state; and
9494 [(3) on the date of sale is of the current model year
9595 or preceding model year].
9696 [(c)] An applicant who pays a fee under this subsection
9797 [Subsection (b)] for a registration year is not required to pay a
9898 fee under Subsection (a) for the next registration year for the same
9999 vehicle.
100100 (c) Instead of the fee provided by Subsection (a) or (b), an
101101 applicant shall pay a one-time fee of $22.25 if the application is
102102 for the initial registration of a passenger car or light truck under
103103 Section 502.0026. An applicant who pays a fee under this subsection
104104 for a registration year is not required to pay a fee under
105105 Subsection (a) for the next two registration years for the same
106106 vehicle.
107107 (e-1) Each fee paid under Subsection (c) shall be deposited
108108 by the comptroller after receipt under Section 548.509 as follows:
109109 (1) $16.25 to the credit of the Texas mobility fund;
110110 and
111111 (2) $6 to the credit of the clean air account.
112112 SECTION 8. The following sections of the Transportation
113113 Code are repealed:
114114 (1) 548.051(a) and (c);
115115 (2) 548.052;
116116 (3) 548.054;
117117 (4) 548.1025;
118118 (5) 548.104(d);
119119 (6) 548.501(a); and
120120 (7) 548.5035.
121121 SECTION 9. This Act takes effect September 1, 2025.
