88 AN ACT
99 relating to a prohibition on the crushing of contaminated concrete
1010 by certain concrete crushing facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 382, Health and Safety
1313 Code, is amended by adding Section 382.0651 to read as follows:
1414 Sec. 382.0651. CONCRETE CRUSHING FACILITY; PROHIBITION ON
1515 CONTAMINATED CONCRETE. (a) The commission by rule shall, as a
1616 condition of issuing a permit or authorizing the use of a standard
1717 permit under this chapter for a concrete crushing facility,
1818 prohibit the facility from crushing concrete that has been exposed
1919 to a chemical contaminant listed under Subsection (b).
2020 (b) The commission by rule shall establish a list of
2121 chemicals that the commission finds may contaminate concrete in a
2222 manner likely to cause adverse human health effects when that
2323 concrete is crushed. Before adding a chemical to the list, the
2424 commission shall consider the degree of risk of the chemical
2525 causing contamination of concrete and of that contamination to
2626 cause adverse human health effects.
2727 SECTION 2. (a) Not later than March 1, 2026, the Texas
2828 Commission on Environmental Quality shall adopt rules necessary to
2929 implement the changes in law made by this Act, including by amending
3030 any applicable standard permit issued under Chapter 382, Health and
3131 Safety Code.
3232 (b) Notwithstanding any contrary provision of Chapter 382,
3333 Health and Safety Code, the Texas Commission on Environmental
3434 Quality shall require a concrete crushing facility operating under
3535 a permit or an authorization to use a standard permit issued before
3636 the effective date of the rules described by Subsection (a) of this
3737 section to comply with the rules as if the permit or authorization
3838 had been issued after the effective date of the rules.
3939 SECTION 3. This Act takes effect September 1, 2025.
