9 | 9 | | relating to the licensing of certain military veterans as health |
---|
10 | 10 | | care providers. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter C, Chapter 155, Occupations Code, is |
---|
13 | 13 | | amended by adding Section 155.108 to read as follows: |
---|
14 | 14 | | Sec. 155.108. LICENSE FOR MILITARY VETERAN TO PRACTICE |
---|
15 | 15 | | MEDICINE. (a) In this section, "active duty" and "armed forces of |
---|
16 | 16 | | the United States" have the meanings assigned by Section 55.001. |
---|
17 | 17 | | (b) The board shall issue a license to practice medicine to |
---|
18 | 18 | | an applicant who: |
---|
19 | 19 | | (1) is licensed in good standing as a physician in |
---|
20 | 20 | | another state; |
---|
21 | 21 | | (2) is a veteran of the armed forces of the United |
---|
22 | 22 | | States who retired from or otherwise left military service not more |
---|
23 | 23 | | than one year before the application date for a license under this |
---|
24 | 24 | | section; |
---|
25 | 25 | | (3) was, at the time of retiring from or leaving |
---|
26 | 26 | | military service: |
---|
27 | 27 | | (A) serving on active duty in this state; and |
---|
28 | 28 | | (B) authorized as a physician to treat persons |
---|
29 | 29 | | enlisted in the armed forces of the United States or veterans; and |
---|
30 | 30 | | (4) has passed the Texas medical jurisprudence |
---|
31 | 31 | | examination. |
---|
32 | 32 | | (c) The board may not issue a license under this section to |
---|
33 | 33 | | an applicant who: |
---|
34 | 34 | | (1) was discharged or separated from the armed forces |
---|
35 | 35 | | of the United States: |
---|
36 | 36 | | (A) on the basis of substandard conduct; or |
---|
37 | 37 | | (B) for any act of misconduct or moral or |
---|
38 | 38 | | professional dereliction; |
---|
39 | 39 | | (2) holds a medical license or a license to prescribe, |
---|
40 | 40 | | dispense, administer, supply, or sell a controlled substance that: |
---|
41 | 41 | | (A) is currently under active investigation; or |
---|
42 | 42 | | (B) is or was subject to a disciplinary order or |
---|
43 | 43 | | action or to denial by another jurisdiction; or |
---|
44 | 44 | | (3) has been convicted of, is on deferred adjudication |
---|
45 | 45 | | community supervision or deferred disposition for, or is under |
---|
46 | 46 | | active investigation for the commission of: |
---|
47 | 47 | | (A) a felony; or |
---|
48 | 48 | | (B) a misdemeanor involving moral turpitude. |
---|
49 | 49 | | SECTION 2. Subchapter F, Chapter 301, Occupations Code, is |
---|
50 | 50 | | amended by adding Section 301.262 to read as follows: |
---|
51 | 51 | | Sec. 301.262. LICENSE FOR MILITARY VETERAN TO PRACTICE |
---|
52 | 52 | | MEDICINE. (a) In this section, "active duty" and "armed forces of |
---|
53 | 53 | | the United States" have the meanings assigned by Section 55.001. |
---|
54 | 54 | | (b) The board shall issue a license to practice nursing to |
---|
55 | 55 | | an applicant who: |
---|
56 | 56 | | (1) is licensed in good standing as a nurse in another |
---|
57 | 57 | | state; |
---|
58 | 58 | | (2) is a veteran of the armed forces of the United |
---|
59 | 59 | | States who retired from or otherwise left military service not more |
---|
60 | 60 | | than one year before the application date for a license under this |
---|
61 | 61 | | section; |
---|
62 | 62 | | (3) was, at the time of retiring from or otherwise |
---|
63 | 63 | | leaving military service: |
---|
64 | 64 | | (A) serving on active duty in this state; and |
---|
65 | 65 | | (B) authorized as a nurse to treat persons |
---|
66 | 66 | | enlisted in the armed forces of the United States or veterans; and |

67 | 67 | | (4) has passed the jurisprudence examination. |
---|
68 | 68 | | (c) The board may not issue a license under this section to |
---|
69 | 69 | | an applicant who: |
---|

---|
