88 AN ACT
99 relating to the licensing of certain military veterans as health
1010 care providers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 155, Occupations Code, is
1313 amended by adding Section 155.108 to read as follows:
1414 Sec. 155.108. LICENSE FOR MILITARY VETERAN TO PRACTICE
1515 MEDICINE. (a) In this section, "active duty" and "armed forces of
1616 the United States" have the meanings assigned by Section 55.001.
1717 (b) The board shall issue a license to practice medicine to
1818 an applicant who:
1919 (1) is licensed in good standing as a physician in
2020 another state;
2121 (2) is a veteran of the armed forces of the United
2222 States who retired from or otherwise left military service not more
2323 than one year before the application date for a license under this
2424 section;
2525 (3) was, at the time of retiring from or leaving
2626 military service:
2727 (A) serving on active duty in this state; and
2828 (B) authorized as a physician to treat persons
2929 enlisted in the armed forces of the United States or veterans; and
3030 (4) has passed the Texas medical jurisprudence
3131 examination.
3232 (c) The board may not issue a license under this section to
3333 an applicant who:
3434 (1) was discharged or separated from the armed forces
3535 of the United States:
3636 (A) on the basis of substandard conduct; or
3737 (B) for any act of misconduct or moral or
3838 professional dereliction;
3939 (2) holds a medical license or a license to prescribe,
4040 dispense, administer, supply, or sell a controlled substance that:
4141 (A) is currently under active investigation; or
4242 (B) is or was subject to a disciplinary order or
4343 action or to denial by another jurisdiction; or
4444 (3) has been convicted of, is on deferred adjudication
4545 community supervision or deferred disposition for, or is under
4646 active investigation for the commission of:
4747 (A) a felony; or
4848 (B) a misdemeanor involving moral turpitude.
4949 SECTION 2. Subchapter F, Chapter 301, Occupations Code, is
5050 amended by adding Section 301.262 to read as follows:
5151 Sec. 301.262. LICENSE FOR MILITARY VETERAN TO PRACTICE
5252 MEDICINE. (a) In this section, "active duty" and "armed forces of
5353 the United States" have the meanings assigned by Section 55.001.
5454 (b) The board shall issue a license to practice nursing to
5555 an applicant who:
5656 (1) is licensed in good standing as a nurse in another
5757 state;
5858 (2) is a veteran of the armed forces of the United
5959 States who retired from or otherwise left military service not more
6060 than one year before the application date for a license under this
6161 section;
6262 (3) was, at the time of retiring from or otherwise
6363 leaving military service:
6464 (A) serving on active duty in this state; and
6565 (B) authorized as a nurse to treat persons
6666 enlisted in the armed forces of the United States or veterans; and
6767 (4) has passed the jurisprudence examination.
6868 (c) The board may not issue a license under this section to
6969 an applicant who:
7070 (1) was discharged or separated from the armed forces
7171 of the United States:
7272 (A) on the basis of substandard conduct; or
7373 (B) for any act of misconduct or moral or
7474 professional dereliction;
7575 (2) holds a nursing license or a license to prescribe,
7676 dispense, administer, supply, or sell a controlled substance that:
7777 (A) is currently under active investigation; or
7878 (B) is or was subject to a disciplinary order or
7979 action or to denial by another jurisdiction; or
8080 (3) has been convicted of, is on deferred adjudication
8181 community supervision or deferred disposition for, or is under
8282 active investigation for the commission of:
8383 (A) a felony; or
8484 (B) a misdemeanor involving moral turpitude.
8585 SECTION 3. This Act takes effect September 1, 2025.
