10 | 10 | by designated emergency infant care providers and the termination | |

12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 262.302, Family Code, is amended by | |
14 | 14 | amending Subsection (a) and adding Subsection (a-1) to read as | |
15 | 15 | follows: | |
16 | 16 | (a) A designated emergency infant care provider shall, | |
17 | 17 | without a court order, take possession of a child who appears to be | |
18 | 18 | younger than one year [60 days] old [or younger] if: | |
19 | 19 | (1) the child is voluntarily delivered to the provider | |
20 | 20 | by the child's parent by: | |
21 | 21 | (A) leaving the child with an employee of the | |
22 | 22 | provider; or | |
23 | 23 | (B) placing the child in a newborn safety device | |
24 | 24 | located inside the provider's facilities; and | |
25 | 25 | (2) the parent did not express an intent to return for | |
26 | 26 | the child. | |
27 | 27 | (a-1) A parent who voluntarily delivers the parent's child | |
28 | 28 | to a designated emergency infant care provider under Subsection (a) | |
29 | 29 | is considered to have voluntarily relinquished the parent's | |
30 | 30 | parental rights to the child. | |
31 | 31 | SECTION 2. This Act takes effect September 1, 2025. |
