66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to revision or elimination of the motor vehicle emissions
99 inspection and maintenance program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter G, Chapter 382, Health and Safety
1212 Code, is amended by adding Section 382.2015 to read as follows:
1313 Sec. 382.2015. REVIEW OF PROGRAM. (a) The commission
1414 shall:
1515 (1) identify the minimum program required by the
1616 federal Clean Air Act (42 U.S.C. Section 7401 et seq.) for the motor
1717 vehicle emissions inspection and maintenance program; and
1818 (2) develop a state implementation plan revision and
1919 necessary rules to revise the motor vehicle emissions inspection
2020 and maintenance program to include only the minimum program.
2121 (b) The commission shall submit the state implementation
2222 plan revision and any rules to the United States Environmental
2323 Protection Agency for approval.
2424 (c) A state implementation plan submitted to the United
2525 States Environmental Protection Agency under this Section shall
2626 require a motor vehicle emissions inspection only at the transfer
2727 of a vehicle title.
2828 (d) If the United States Environmental Protection Agency
2929 approves the plan, the commission shall:
3030 (1) implement the revised program; and
3131 (2) submit to the legislature a list of recommended
3232 statutory changes to facilitate implementing the minimum program,
3333 if any.
3434 (e) Notwithstanding another provision of this chapter or
3535 Chapter 548, Transportation Code, the commission and the Department
3636 of Public Safety may implement a program developed and approved
3737 under this section, and counties may participate in implementing
3838 the program.
3939 SECTION 2. Subchapter G, Chapter 382, Health and Safety
4040 Code, is amended by adding Section 382.2025 to read as follows:
4141 Sec. 382.2025. ELIMINATION OF PROGRAM. Notwithstanding any
4242 other law, the commission and the Department of Public Safety may
4343 not implement or enforce any other provision of this subchapter or a
4444 requirement under Chapter 548, Transportation Code, related to
4545 emissions inspections.
4646 SECTION 3. (a) Except as otherwise provided by this
4747 section, this Act takes effect September 1, 2025.
4848 (b) Section 2 of this Act takes effect on the 30th day after
4949 the date the United States Congress enacts legislation that becomes
5050 law that repeals the federal Clean Air Act (42 U.S.C. Section 7401
5151 et seq.) or amends it in a way that the motor vehicle emissions
5252 inspection and maintenance program established under Subchapter G,
5353 Chapter 382, Health and Safety Code, is no longer required. If the
5454 United States Congress does not enact legislation that becomes law
5555 described by this subsection, Section 2 of this Act has no effect.
