8 | 8 | | relating to revision or elimination of the motor vehicle emissions |

9 | 9 | | inspection and maintenance program. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter G, Chapter 382, Health and Safety |
---|
12 | 12 | | Code, is amended by adding Section 382.2015 to read as follows: |
---|
13 | 13 | | Sec. 382.2015. REVIEW OF PROGRAM. (a) The commission |
---|
14 | 14 | | shall: |
---|
15 | 15 | | (1) identify the minimum program required by the |
---|
16 | 16 | | federal Clean Air Act (42 U.S.C. Section 7401 et seq.) for the motor |
---|
17 | 17 | | vehicle emissions inspection and maintenance program; and |
---|
18 | 18 | | (2) develop a state implementation plan revision and |
---|
19 | 19 | | necessary rules to revise the motor vehicle emissions inspection |
---|
20 | 20 | | and maintenance program to include only the minimum program. |
---|
21 | 21 | | (b) The commission shall submit the state implementation |
---|
22 | 22 | | plan revision and any rules to the United States Environmental |
---|
23 | 23 | | Protection Agency for approval. |
---|
24 | 24 | | (c) A state implementation plan submitted to the United |
---|
25 | 25 | | States Environmental Protection Agency under this Section shall |
---|
26 | 26 | | require a motor vehicle emissions inspection only at the transfer |
---|
27 | 27 | | of a vehicle title. |
---|
28 | 28 | | (d) If the United States Environmental Protection Agency |
---|
29 | 29 | | approves the plan, the commission shall: |
---|
30 | 30 | | (1) implement the revised program; and |
---|
31 | 31 | | (2) submit to the legislature a list of recommended |
---|
32 | 32 | | statutory changes to facilitate implementing the minimum program, |
---|
33 | 33 | | if any. |
---|
34 | 34 | | (e) Notwithstanding another provision of this chapter or |
---|
35 | 35 | | Chapter 548, Transportation Code, the commission and the Department |
---|
36 | 36 | | of Public Safety may implement a program developed and approved |
---|
37 | 37 | | under this section, and counties may participate in implementing |
---|
38 | 38 | | the program. |
---|
39 | 39 | | SECTION 2. Subchapter G, Chapter 382, Health and Safety |
---|
40 | 40 | | Code, is amended by adding Section 382.2025 to read as follows: |
---|
41 | 41 | | Sec. 382.2025. ELIMINATION OF PROGRAM. Notwithstanding any |
---|
42 | 42 | | other law, the commission and the Department of Public Safety may |
---|
43 | 43 | | not implement or enforce any other provision of this subchapter or a |
---|
44 | 44 | | requirement under Chapter 548, Transportation Code, related to |
---|
45 | 45 | | emissions inspections. |
---|
46 | 46 | | SECTION 3. (a) Except as otherwise provided by this |
---|
47 | 47 | | section, this Act takes effect September 1, 2025. |
---|
48 | 48 | | (b) Section 2 of this Act takes effect on the 30th day after |
---|
49 | 49 | | the date the United States Congress enacts legislation that becomes |
---|
50 | 50 | | law that repeals the federal Clean Air Act (42 U.S.C. Section 7401 |
---|
51 | 51 | | et seq.) or amends it in a way that the motor vehicle emissions |
---|
52 | 52 | | inspection and maintenance program established under Subchapter G, |
---|
53 | 53 | | Chapter 382, Health and Safety Code, is no longer required. If the |
---|
54 | 54 | | United States Congress does not enact legislation that becomes law |
---|
55 | 55 | | described by this subsection, Section 2 of this Act has no effect. |
