77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the confidentiality of certain personal information of
1010 an applicant for or a person protected by a protective order.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 82.011, Family Code, is amended to read
1313 as follows:
1414 Sec. 82.011. CONFIDENTIALITY OF CERTAIN INFORMATION. On
1515 request by an applicant, the court shall [may] protect the
1616 applicant's mailing address and county of residence by rendering an
1717 order:
1818 (1) requiring the applicant to:
1919 (A) disclose the applicant's mailing address and
2020 county of residence to the court;
2121 (B) designate a person to receive on behalf of
2222 the applicant any notice or documents filed with the court related
2323 to the application; and
2424 (C) disclose the designated person's mailing
2525 address to the court;
2626 (2) requiring the court clerk to:
2727 (A) strike the applicant's mailing address and
2828 county of residence from the public records of the court, if
2929 applicable; and
3030 (B) maintain a confidential record of the
3131 applicant's mailing address and county of residence for use only by
3232 the court; and
3333 (3) prohibiting the release of the information to the
3434 respondent.
3535 SECTION 2. Section 85.007, Family Code, is amended by
3636 amending Subsection (a) and adding Subsection (a-1) to read as
3737 follows:
3838 (a) On request by a person protected by an order or an adult
3939 member of the family or household of a person protected by an order,
4040 the court shall [may] exclude from a protective order:
4141 (1) the address, county of residence, and telephone
4242 number of a person protected by the order; or
4343 (2) the address and telephone number of:
4444 (A) the place of employment or business of a
4545 person protected by the order; or
4646 (B) the child-care facility or school a child
4747 protected by the order attends or in which the child resides.
4848 (a-1) In a hearing on an application for a protective order,
4949 the court shall inform each person described by Subsection (a) who
5050 is present at the hearing of the person's right, on request, to have
5151 information described by that subsection excluded from the
5252 protective order and specifically ask the person if the person
5353 wishes the court to exclude that information from the protective
5454 order.
5555 SECTION 3. Section 87.004, Family Code, is amended by
5656 adding Subsection (a-1) to read as follows:
5757 (a-1) On request by a person protected by an order, the
5858 court shall keep confidential the changed address or telephone
5959 number in the notification described by Subsection (a). On
6060 granting a request for confidentiality under this subsection, the
6161 court shall order the clerk to maintain a confidential record of the
6262 information as described by Section 85.007(b)(2) and exclude that
6363 information from the notification. If the applicant seeks to keep
6464 confidential the applicant's mailing address, the applicant must:
6565 (1) disclose the applicant's mailing address and
6666 county of residence to the court;
6767 (2) designate a person to receive on behalf of the
6868 applicant any notice or documents filed with the court related to
6969 the order; and
7070 (3) disclose the designated person's mailing address
7171 to the court.
7272 SECTION 4. The change in law made by this Act applies to an
7373 application for a protective order that is pending on or filed on or
7474 after the effective date of this Act or a notification of change of
7575 address or telephone number that is filed on or after the effective
7676 date of this Act.
7777 SECTION 5. This Act takes effect September 1, 2025.
