8	8	AN ACT
9	9	relating to the confidentiality of certain personal information of
10	10	an applicant for or a person protected by a protective order.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 82.011, Family Code, is amended to read
13	13	as follows:
14	14	Sec. 82.011. CONFIDENTIALITY OF CERTAIN INFORMATION. On
15	15	request by an applicant, the court shall [may] protect the
16	16	applicant's mailing address and county of residence by rendering an
17	17	order:
18	18	(1) requiring the applicant to:
19	19	(A) disclose the applicant's mailing address and
20	20	county of residence to the court;
21	21	(B) designate a person to receive on behalf of
22	22	the applicant any notice or documents filed with the court related
23	23	to the application; and
24	24	(C) disclose the designated person's mailing
25	25	address to the court;
26	26	(2) requiring the court clerk to:
27	27	(A) strike the applicant's mailing address and
28	28	county of residence from the public records of the court, if
29	29	applicable; and
30	30	(B) maintain a confidential record of the
31	31	applicant's mailing address and county of residence for use only by
32	32	the court; and
33	33	(3) prohibiting the release of the information to the
34	34	respondent.
35	35	SECTION 2. Section 85.007, Family Code, is amended by
36	36	amending Subsection (a) and adding Subsection (a-1) to read as
37	37	follows:
38	38	(a) On request by a person protected by an order or an adult
39	39	member of the family or household of a person protected by an order,
40	40	the court shall [may] exclude from a protective order:
41	41	(1) the address, county of residence, and telephone
42	42	number of a person protected by the order; or
43	43	(2) the address and telephone number of:
44	44	(A) the place of employment or business of a
45	45	person protected by the order; or
46	46	(B) the child-care facility or school a child
47	47	protected by the order attends or in which the child resides.
48	48	(a-1) In a hearing on an application for a protective order,
49	49	the court shall inform each person described by Subsection (a) who
50	50	is present at the hearing of the person's right, on request, to have
51	51	information described by that subsection excluded from the
52	52	protective order and specifically ask the person if the person
53	53	wishes the court to exclude that information from the protective
54	54	order.
55	55	SECTION 3. Section 87.004, Family Code, is amended by
56	56	adding Subsection (a-1) to read as follows:
57	57	(a-1) On request by a person protected by an order, the
58	58	court shall keep confidential the changed address or telephone
59	59	number in the notification described by Subsection (a). On
60	60	granting a request for confidentiality under this subsection, the
61	61	court shall order the clerk to maintain a confidential record of the
62	62	information as described by Section 85.007(b)(2) and exclude that
63	63	information from the notification. If the applicant seeks to keep
64	64	confidential the applicant's mailing address, the applicant must:
65	65	(1) disclose the applicant's mailing address and
66	66	county of residence to the court;
67	67	(2) designate a person to receive on behalf of the
68	68	applicant any notice or documents filed with the court related to
69	69	the order; and
70	70	(3) disclose the designated person's mailing address
71	71	to the court.
72	72	SECTION 4. The change in law made by this Act applies to an
73	73	application for a protective order that is pending on or filed on or
74	74	after the effective date of this Act or a notification of change of
75	75	address or telephone number that is filed on or after the effective
76	76	date of this Act.
77	77	SECTION 5. This Act takes effect September 1, 2025.
