88 AN ACT
99 relating to prior authorization for prescription drug benefits
1010 related to the treatment of neurodegenerative diseases.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Subchapter N, Chapter 1369,
1313 Insurance Code, is amended to read as follows:
1414 SUBCHAPTER N. COVERAGE OF PRESCRIPTION DRUGS FOR CERTAIN
1515 [AUTOIMMUNE] DISEASES AND [CERTAIN BLOOD] DISORDERS
1616 SECTION 2. Section 1369.654(a), Insurance Code, is amended
1717 to read as follows:
1818 (a) A health benefit plan issuer that provides prescription
1919 drug benefits may not require an enrollee to receive more than one
2020 prior authorization annually of the prescription drug benefit for a
2121 prescription drug prescribed to treat an autoimmune disease,
2222 hemophilia, a neurodegenerative disease, or Von Willebrand
2323 disease.
2424 SECTION 3. The change in law made by this Act applies only
2525 to a health benefit plan that is delivered, issued for delivery, or
2626 renewed on or after January 1, 2026. A health benefit plan
2727 delivered, issued for delivery, or renewed before January 1, 2026,
2828 is governed by the law as it existed immediately before the
2929 effective date of this Act, and that law is continued in effect for
3030 that purpose.
3131 SECTION 4. This Act takes effect September 1, 2025.
