88 AN ACT
99 relating to the transition of the nurse aide certification program
1010 from the Health and Human Services Commission to the Texas Board of
1111 Nursing and the creation of a workgroup on nursing career pathways.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. NURSE AIDE CERTIFICATION PROGRAM. (a) The Texas
1414 Board of Nursing and the Health and Human Services Commission shall
1515 jointly develop an operational plan for transitioning the nurse
1616 aide certification program from the Health and Human Services
1717 Commission to the Texas Board of Nursing. The study must include
1818 all financial, operational, and other relevant considerations
1919 necessary for the transition.
2020 (b) Not later than December 1, 2026, the Texas Board of
2121 Nursing and the Health and Human Services Commission shall submit
2222 the plan developed under this section to the governor, the
2323 lieutenant governor, the speaker of the house of representatives,
2424 and each standing committee of the legislature with primary
2525 jurisdiction over nursing.
2626 SECTION 2. NURSING CAREER PATHWAYS. (a) The Texas Center
2727 for Nursing Workforce Studies shall establish and oversee a
2828 workgroup to assess the feasibility of better aligning the
2929 certification and career pathways of nurse aides, medication aides,
3030 and personal care technicians into the nursing profession.
3131 (b) The workgroup must include:
3232 (1) the executive head of each of the following
3333 entities, or that person's designated representative:
3434 (A) the Texas Board of Nursing;
3535 (B) the Health and Human Services Commission;
3636 (C) the Texas Workforce Commission;
3737 (D) the Texas Education Agency; and
3838 (E) the Texas Higher Education Coordinating
3939 Board; and
4040 (2) relevant academic or health care professionals.
4141 (c) In conducting the assessment under this section, the
4242 workgroup shall consider and evaluate:
4343 (1) the standards, regulations, and laws currently
4444 impacting the nursing profession;
4545 (2) the feasibility of alignment in certification
4646 requirements for nurse aides, medication aides, and personal care
4747 technicians to minimize duplicative efforts in the educational
4848 pathways in nursing; and
4949 (3) the present and future impact of new business
5050 practices and advancing technologies in health care.
5151 (d) Not later than December 1, 2026, the workgroup
5252 established under this section shall submit a report summarizing
5353 the results of the assessment conducted under this section to the
5454 governor, the lieutenant governor, the speaker of the house of
5555 representatives, and each standing committee of the legislature
5656 with primary jurisdiction over nursing.
5757 SECTION 3. EXPIRATION. This Act expires January 1, 2027.
5858 SECTION 4. EFFECTIVE DATE. This Act takes effect September
5959 1, 2025.
