| 8 | 8 | | relating to the issuance of a license or provisional license to |
|---|
| 9 | 9 | | certain military service members, military veterans, and military |
|---|
| 10 | 10 | | spouses to engage in a business or occupation in this state. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 55.004, Occupations Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (b-1) to read as follows: |
|---|
| 14 | 14 | | (b-1) On receipt by a state agency of an application for a |
|---|
| 15 | 15 | | license in accordance with this section, the agency shall promptly |
|---|
| 16 | 16 | | issue a provisional license to the applicant while the agency |
|---|
| 17 | 17 | | processes the application or issue the license for which the |
|---|
| 18 | 18 | | applicant applied. A provisional license issued under this |
|---|
| 19 | 19 | | subsection expires on the earlier of: |
|---|
| 20 | 20 | | (1) the date the agency approves or denies the |
|---|
| 21 | 21 | | provisional license holder's application for the license; or |
|---|
| 22 | 22 | | (2) the 180th day after the date the provisional |
|---|
| 23 | 23 | | license is issued. |

| 24 | 24 | | SECTION 2. Section 55.0041, Occupations Code, is amended by |
|---|
| 25 | 25 | | adding Subsection (b-1) to read as follows: |
|---|
| 26 | 26 | | (b-1) On receipt by a state agency of the notice and |
|---|
| 27 | 27 | | information required by Subsections (b)(1) and (2), the agency |
|---|
| 28 | 28 | | shall promptly issue the confirmation under Subsection (b)(3) or |
|---|
| 29 | 29 | | issue a provisional license to the military service member or |
|---|
| 30 | 30 | | military spouse pending the issuance of a confirmation under |
|---|
| 31 | 31 | | Subsection (b)(3). A provisional license issued under this |
|---|
| 32 | 32 | | subsection expires on the earlier of: |
|---|
| 33 | 33 | | (1) the date the agency issues or denies confirmation |
|---|
| 34 | 34 | | under Subsection (b)(3); or |
|---|
| 35 | 35 | | (2) the 180th day after the date the provisional |
|---|
| 36 | 36 | | license is issued. |
|---|
| 37 | 37 | | SECTION 3. Not later than December 1, 2025, a state agency, |
|---|
| 38 | 38 | | as defined by Section 55.001, Occupations Code, shall adopt rules |
|---|
| 39 | 39 | | to implement Sections 55.004(b-1) and 55.0041(b-1), Occupations |
|---|
| 40 | 40 | | Code, as added by this Act. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect September 1, 2025. |
