66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the issuance of a license or provisional license to
99 certain military service members, military veterans, and military
1010 spouses to engage in a business or occupation in this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 55.004, Occupations Code, is amended by
1313 adding Subsection (b-1) to read as follows:
1414 (b-1) On receipt by a state agency of an application for a
1515 license in accordance with this section, the agency shall promptly
1616 issue a provisional license to the applicant while the agency
1717 processes the application or issue the license for which the
1818 applicant applied. A provisional license issued under this
1919 subsection expires on the earlier of:
2020 (1) the date the agency approves or denies the
2121 provisional license holder's application for the license; or
2222 (2) the 180th day after the date the provisional
2323 license is issued.
2424 SECTION 2. Section 55.0041, Occupations Code, is amended by
2525 adding Subsection (b-1) to read as follows:
2626 (b-1) On receipt by a state agency of the notice and
2727 information required by Subsections (b)(1) and (2), the agency
2828 shall promptly issue the confirmation under Subsection (b)(3) or
2929 issue a provisional license to the military service member or
3030 military spouse pending the issuance of a confirmation under
3131 Subsection (b)(3). A provisional license issued under this
3232 subsection expires on the earlier of:
3333 (1) the date the agency issues or denies confirmation
3434 under Subsection (b)(3); or
3535 (2) the 180th day after the date the provisional
3636 license is issued.
3737 SECTION 3. Not later than December 1, 2025, a state agency,
3838 as defined by Section 55.001, Occupations Code, shall adopt rules
3939 to implement Sections 55.004(b-1) and 55.0041(b-1), Occupations
4040 Code, as added by this Act.
4141 SECTION 4. This Act takes effect September 1, 2025.
