77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to human trafficking prevention, including training for
1010 medical assistants, disclosure of human trafficking information by
1111 certain health care facilities, and protection for facility
1212 employees who report human trafficking.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle G, Title 4, Health and Safety Code, is
1515 amended by adding Chapter 328 to read as follows:
1616 CHAPTER 328. HUMAN TRAFFICKING PREVENTION IN CERTAIN FACILITIES
1717 Sec. 328.001. DEFINITIONS. In this chapter:
1818 (1) "Facility" has the meaning assigned by Section
1919 31.002.
2020 (2) "Medical assistant" has the meaning assigned by
2121 Section 763.001.
2222 Sec. 328.002. HUMAN TRAFFICKING SIGNS REQUIRED. (a) A
2323 facility shall display a sign, at least 11 inches by 17 inches in
2424 size, written in at least a 16-point font and in the form prescribed
2525 by the attorney general, that includes:
2626 (1) the following statements:
2727 (A) "All health care practitioners and medical
2828 assistants are required to receive human trafficking prevention
2929 training."; and
3030 (B) "An employee may not be disciplined,
3131 retaliated against, or otherwise discriminated against for
3232 reporting in good faith a suspected act of human trafficking.";
3333 (2) information on recognizing and reporting human
3434 trafficking and a list of human trafficking indicators;
3535 (3) a phone number the attorney general designates for
3636 reporting a suspected act of human trafficking or a violation of
3737 this chapter; and
3838 (4) contact information for reporting suspicious
3939 activity to the Department of Public Safety.
4040 (b) The sign described by Subsection (a) must be posted:
4141 (1) in a location easily visible to all facility
4242 employees; and
4343 (2) separately in English, Spanish, and any other
4444 primary language spoken by 10 percent or more of the facility's
4545 employees.
4646 Sec. 328.003. DISCRIMINATION AND RETALIATION PROHIBITED. A
4747 facility may not discipline, retaliate against, or otherwise
4848 discriminate against a facility employee who in good faith reports
4949 a suspected act of human trafficking to the facility, a law
5050 enforcement agency, the National Human Trafficking Resource
5151 Center, the attorney general, or another appropriate authority.
5252 SECTION 2. Subtitle A, Title 9, Health and Safety Code, is
5353 amended by adding Chapter 763 to read as follows:
5454 CHAPTER 763. HUMAN TRAFFICKING PREVENTION TRAINING
5555 SUBCHAPTER A. TRAINING FOR MEDICAL ASSISTANTS
5656 Sec. 763.001. DEFINITIONS. In this subchapter:
5757 (1) "Commission" means the Health and Human Services
5858 Commission.
5959 (2) "Executive commissioner" means the executive
6060 commissioner of the Health and Human Services Commission.
6161 (3) "Human trafficking" means conduct that
6262 constitutes an offense under Section 20A.02, Penal Code.
6363 (4) "Medical assistant" means an individual who, under
6464 the supervision of a physician, assists with patient care
6565 management, executes administrative duties, and performs clinical
6666 procedures, including:
6767 (A) conducting aseptic procedures;
6868 (B) obtaining vital signs;
6969 (C) preparing patients for the physician's care;
7070 (D) performing venipunctures and non-intravenous
7171 injections;
7272 (E) observing and reporting patients' symptoms;
7373 (F) administering basic first aid;
7474 (G) assisting with patient examinations or
7575 treatments;
7676 (H) operating office medical equipment;
7777 (I) collecting routine laboratory specimens, as
7878 directed by the physician;
7979 (J) administering medication, as directed by the
8080 physician;
8181 (K) performing basic laboratory procedures; and
8282 (L) performing dialysis procedures, including
8383 home dialysis.
8484 Sec. 763.002. REQUIRED HUMAN TRAFFICKING TRAINING. A
8585 medical assistant, within the time prescribed by commission rule,
8686 shall successfully complete a training course approved by the
8787 executive commissioner on identifying, assisting, and reporting
8888 victims of human trafficking.
8989 Sec. 763.003. TRAINING COURSE APPROVAL. (a) The executive
9090 commissioner shall:
9191 (1) approve training courses on human trafficking
9292 prevention, including at least one course available without charge;
9393 and
9494 (2) post a list of the approved training courses on the
9595 commission's Internet website.
9696 (b) The executive commissioner shall update the list of
9797 approved training courses described by Subsection (a) as necessary
9898 and consider for approval training courses conducted by health care
9999 facilities.
100100 SECTION 3. As soon as practicable after the effective date
101101 of this Act, the attorney general shall design the sign required by
102102 Section 328.002, Health and Safety Code, as added by this Act.
103103 SECTION 4. As soon as practicable after the effective date
104104 of this Act, the executive commissioner of the Health and Human
105105 Services Commission shall approve and post on the commission's
106106 Internet website the list of approved human trafficking prevention
107107 training courses and adopt rules necessary to implement Subchapter
108108 A, Chapter 763, Health and Safety Code, as added by this Act.
109109 SECTION 5. This Act takes effect September 1, 2025.
