77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an exemption from certain requirements regarding
1010 diversity, equity, or inclusion initiatives for certain activities
1111 not funded by state money provided by public institutions of higher
1212 education.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 51.3525(d), Education Code, is amended
1515 to read as follows:
1616 (d) Subsection (b)(1) may not be construed to apply to:
1717 (1) academic course instruction;
1818 (2) scholarly research or a creative work by an
1919 institution of higher education's students, faculty, or other
2020 research personnel or the dissemination of that research or work;
2121 (3) an activity of a student organization registered
2222 with or recognized by an institution of higher education;
2323 (4) guest speakers or performers on short-term
2424 engagements;
2525 (5) a policy, practice, procedure, program, or
2626 activity to enhance student academic achievement or postgraduate
2727 outcomes that is designed and implemented without regard to race,
2828 sex, color, or ethnicity;
2929 (6) data collection; [or]
3030 (7) student recruitment or admissions; or
3131 (8) a program, activity, or scholarship funded by a
3232 private donation, federal money, or money not appropriated by the
3333 legislature.
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
