69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the confidentiality of certain information collected by
912 certain local governments and airport governing boards.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 22.028, Transportation Code, is amended
1215 to read as follows:
1316 Sec. 22.028. CONFIDENTIALITY OF CERTAIN INFORMATION
1417 COLLECTED BY LOCAL GOVERNMENT. Personal identifying information
1518 collected by a local government is confidential and not subject to
1619 disclosure under Chapter 552, Government Code, if the information
1720 collected is in relation to a person's use of an airport [parking]
1821 facility that includes:
1922 (1) the person's name, address, e-mail address, phone
2023 number, and zip code;
2124 (2) the person's license plate number, toll tag
2225 number, and credit, debit, or other payment card number; [or]
2326 (3) the dates the person's vehicle was parked at a
2427 parking [the] facility, the date the person's vehicle exited the
2528 parking facility, and the amount the person paid to park in the
2629 parking facility;
2730 (4) the person's profile name associated with a
2831 purchase or other online or in-person activity;
2932 (5) the person's travel dates and flight information;
3033 (6) the dates, times, and amounts of any purchase made
3134 by the person; or
3235 (7) the person's airport lounge memberships and
3336 trusted traveler information.
3437 SECTION 2. Section 22.091, Transportation Code, is amended
3538 to read as follows:
3639 Sec. 22.091. CONFIDENTIALITY OF CERTAIN INFORMATION
3740 COLLECTED BY JOINT BOARD. Personal identifying information
3841 collected by a joint board for which the constituent agencies are
3942 populous home-rule municipalities is confidential and not subject
4043 to disclosure under Chapter 552, Government Code, if the
4144 information collected is in relation to:
4245 (1) a commercial online payment system and includes a
4346 person's:
4447 (A) name, address, e-mail address, or phone
4548 number;
4649 (B) account number, password, payment
4750 transaction activity, toll or charge record, or credit, debit, or
4851 other payment card number; or
4952 (C) other personal financial information; or
5053 (2) a person's use of an airport [parking] facility
5154 that includes:
5255 (A) the person's name, address, e-mail address,
5356 phone number, and zip code;
5457 (B) the person's license plate number, toll tag
5558 number, and credit, debit, or other payment card number; [or]
5659 (C) the dates the person's vehicle was parked at
5760 a parking [the] facility, the date the person's vehicle exited the
5861 parking facility, and the amount the person paid to park in the
5962 parking facility;
6063 (D) the person's profile name associated with a
6164 purchase or other online or in-person activity;
6265 (E) the person's travel dates and flight
6366 information;
6467 (F) the dates, times, and amounts of any purchase
6568 made by the person; or
6669 (G) the person's airport lounge memberships and
6770 trusted traveler information.
6871 SECTION 3. The changes in law made by this Act apply only to
6972 a request for public information received by a governmental body or
7073 an officer for public information on or after the effective date of
7174 this Act.
7275 SECTION 4. This Act takes effect September 1, 2025.
