6	9		A BILL TO BE ENTITLED
7	10		AN ACT
8	11		relating to the confidentiality of certain information collected by
9	12		certain local governments and airport governing boards.
10	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	14		SECTION 1. Section 22.028, Transportation Code, is amended
12	15		to read as follows:
13	16		Sec. 22.028. CONFIDENTIALITY OF CERTAIN INFORMATION
14	17		COLLECTED BY LOCAL GOVERNMENT. Personal identifying information
15	18		collected by a local government is confidential and not subject to
16	19		disclosure under Chapter 552, Government Code, if the information
17	20		collected is in relation to a person's use of an airport [parking]
18	21		facility that includes:
19	22		(1) the person's name, address, e-mail address, phone
20	23		number, and zip code;
21	24		(2) the person's license plate number, toll tag
22	25		number, and credit, debit, or other payment card number; [or]
23	26		(3) the dates the person's vehicle was parked at a
24	27		parking [the] facility, the date the person's vehicle exited the
25	28		parking facility, and the amount the person paid to park in the
26	29		parking facility;
27	30		(4) the person's profile name associated with a
28	31		purchase or other online or in-person activity;
29	32		(5) the person's travel dates and flight information;
30	33		(6) the dates, times, and amounts of any purchase made
31	34		by the person; or
32	35		(7) the person's airport lounge memberships and
33	36		trusted traveler information.
34	37		SECTION 2. Section 22.091, Transportation Code, is amended
35	38		to read as follows:
36	39		Sec. 22.091. CONFIDENTIALITY OF CERTAIN INFORMATION
37	40		COLLECTED BY JOINT BOARD. Personal identifying information
38	41		collected by a joint board for which the constituent agencies are
39	42		populous home-rule municipalities is confidential and not subject
40	43		to disclosure under Chapter 552, Government Code, if the
41	44		information collected is in relation to:
42	45		(1) a commercial online payment system and includes a
43	46		person's:
44	47		(A) name, address, e-mail address, or phone
45	48		number;
46	49		(B) account number, password, payment
47	50		transaction activity, toll or charge record, or credit, debit, or
48	51		other payment card number; or
49	52		(C) other personal financial information; or
50	53		(2) a person's use of an airport [parking] facility
51	54		that includes:
52	55		(A) the person's name, address, e-mail address,
53	56		phone number, and zip code;
54	57		(B) the person's license plate number, toll tag
55	58		number, and credit, debit, or other payment card number; [or]
56	59		(C) the dates the person's vehicle was parked at
57	60		a parking [the] facility, the date the person's vehicle exited the
58	61		parking facility, and the amount the person paid to park in the
59	62		parking facility;
60	63		(D) the person's profile name associated with a
61	64		purchase or other online or in-person activity;
62	65		(E) the person's travel dates and flight
63	66		information;
64	67		(F) the dates, times, and amounts of any purchase
65	68		made by the person; or
66	69		(G) the person's airport lounge memberships and
67	70		trusted traveler information.
68	71		SECTION 3. The changes in law made by this Act apply only to
69	72		a request for public information received by a governmental body or
70	73		an officer for public information on or after the effective date of
71	74		this Act.
72	75		SECTION 4. This Act takes effect September 1, 2025.
