88 AN ACT
99 relating to prohibiting contracts or other agreements with certain
1010 foreign-owned companies in connection with critical infrastructure
1111 in this state and the use of certain technology purchased or leased
1212 from those companies.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Chapter 2275, Government Code, is
1515 amended to read as follows:
1616 CHAPTER 2275. PROHIBITION ON CONTRACTS WITH CERTAIN FOREIGN-OWNED
1717 COMPANIES IN CONNECTION WITH CRITICAL INFRASTRUCTURE AND THE USE OF
1818 CERTAIN TECHNOLOGIES PURCHASED OR LEASED FROM THOSE COMPANIES
1919 SECTION 2. Section 2275.0101, Government Code, is amended
2020 by amending Subdivisions (1) and (2) and adding Subdivisions (1-a),
2121 (7), and (8) to read as follows:
2222 (1) "Communication infrastructure system" includes:
2323 (A) a computer hardware device that converts data
2424 signals of one kind into another for the purpose of transmitting the
2525 data over telecommunications circuits, also known as a modem; and
2626 (B) a computer hardware device that mediates the
2727 transmission routes of data packets over an electronic
2828 communications network, also known as a router.
2929 (1-a) "Company" means a sole proprietorship,
3030 organization, association, corporation, partnership, joint
3131 venture, limited partnership, limited liability partnership, or
3232 limited liability company, including a wholly owned subsidiary,
3333 majority-owned subsidiary, parent company, or affiliate of those
3434 entities or business associations, that exists to make a profit.
3535 (2) "Critical infrastructure" means a communication
3636 infrastructure system, cybersecurity system, electric grid,
3737 hazardous waste treatment system, remote sensing technology,
3838 transportation infrastructure system, or water treatment facility.
3939 (7) "Remote sensing technology" means a remote sensing
4040 method that uses light in the form of a pulsed laser to measure
4141 variable distances for the purpose of developing a distance map of
4242 the objects from which the light is reflected. The term includes the
4343 technology known as LiDAR, or Light Detection and Ranging.
4444 (8) "Transportation infrastructure system" means a
4545 camera system used in enforcing the traffic laws of this state,
4646 including a school bus infraction detection system, speed detection
4747 system, or other traffic infraction detector.
4848 SECTION 3. Section 2275.0103, Government Code, is amended
4949 by adding Subsection (c) to read as follows:
5050 (c) The governor shall consider designating as a threat to
5151 critical infrastructure under Subsection (a) any country or person
5252 designated as a foreign adversary by the United States secretary of
5353 commerce, or the secretary's designee, under 15 C.F.R. Section
5454 791.4.
5555 SECTION 4. Effective July 1, 2026, Chapter 2275, Government
5656 Code, is amended by adding Section 2275.0104 to read as follows:
5757 Sec. 2275.0104. USE OF CERTAIN CRITICAL INFRASTRUCTURE
5858 PROHIBITED. A governmental entity may not use remote sensing
5959 technology or a transportation infrastructure system purchased or
6060 leased from a company described by Section 2275.0102(a)(2).
6161 SECTION 5. With respect to a contract or other agreement
6262 relating to critical infrastructure, the changes in law made by
6363 this Act to Section 2275.0101, Government Code, apply only to a
6464 contract or other agreement entered into on or after the effective
6565 date of this Act. A contract or agreement entered into before the
6666 effective date of this Act is governed by the law in effect on the
6767 date the contract or agreement was entered into, and that law is
6868 continued in effect for that purpose.
6969 SECTION 6. Except as otherwise provided by this Act, this
7070 Act takes effect September 1, 2025.
