10 | 10 | | foreign-owned companies in connection with critical infrastructure |

11 | 11 | | in this state and the use of certain technology purchased or leased |
---|
12 | 12 | | from those companies. |

13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. The heading to Chapter 2275, Government Code, is |
---|
15 | 15 | | amended to read as follows: |
---|
16 | 16 | | CHAPTER 2275. PROHIBITION ON CONTRACTS WITH CERTAIN FOREIGN-OWNED |
---|
17 | 17 | | COMPANIES IN CONNECTION WITH CRITICAL INFRASTRUCTURE AND THE USE OF |
---|
18 | 18 | | CERTAIN TECHNOLOGIES PURCHASED OR LEASED FROM THOSE COMPANIES |
---|
19 | 19 | | SECTION 2. Section 2275.0101, Government Code, is amended |
---|
20 | 20 | | by amending Subdivisions (1) and (2) and adding Subdivisions (1-a), |
---|
21 | 21 | | (7), and (8) to read as follows: |
---|
22 | 22 | | (1) "Communication infrastructure system" includes: |
---|
23 | 23 | | (A) a computer hardware device that converts data |
---|
24 | 24 | | signals of one kind into another for the purpose of transmitting the |
---|
25 | 25 | | data over telecommunications circuits, also known as a modem; and |
---|
26 | 26 | | (B) a computer hardware device that mediates the |
---|
27 | 27 | | transmission routes of data packets over an electronic |
---|
28 | 28 | | communications network, also known as a router. |
---|
29 | 29 | | (1-a) "Company" means a sole proprietorship, |
---|
30 | 30 | | organization, association, corporation, partnership, joint |
---|
31 | 31 | | venture, limited partnership, limited liability partnership, or |
---|
32 | 32 | | limited liability company, including a wholly owned subsidiary, |
---|
33 | 33 | | majority-owned subsidiary, parent company, or affiliate of those |
---|
34 | 34 | | entities or business associations, that exists to make a profit. |
---|
35 | 35 | | (2) "Critical infrastructure" means a communication |
---|
36 | 36 | | infrastructure system, cybersecurity system, electric grid, |
---|
37 | 37 | | hazardous waste treatment system, remote sensing technology, |
---|
38 | 38 | | transportation infrastructure system, or water treatment facility. |
---|
39 | 39 | | (7) "Remote sensing technology" means a remote sensing |
---|
40 | 40 | | method that uses light in the form of a pulsed laser to measure |
---|
41 | 41 | | variable distances for the purpose of developing a distance map of |
---|
42 | 42 | | the objects from which the light is reflected. The term includes the |
---|
43 | 43 | | technology known as LiDAR, or Light Detection and Ranging. |
---|
44 | 44 | | (8) "Transportation infrastructure system" means a |
---|
45 | 45 | | camera system used in enforcing the traffic laws of this state, |
---|
46 | 46 | | including a school bus infraction detection system, speed detection |
---|
47 | 47 | | system, or other traffic infraction detector. |
---|
48 | 48 | | SECTION 3. Section 2275.0103, Government Code, is amended |
---|
49 | 49 | | by adding Subsection (c) to read as follows: |
---|
50 | 50 | | (c) The governor shall consider designating as a threat to |
---|
51 | 51 | | critical infrastructure under Subsection (a) any country or person |
---|
52 | 52 | | designated as a foreign adversary by the United States secretary of |
---|
53 | 53 | | commerce, or the secretary's designee, under 15 C.F.R. Section |
---|
54 | 54 | | 791.4. |
---|
55 | 55 | | SECTION 4. Effective July 1, 2026, Chapter 2275, Government |
---|
56 | 56 | | Code, is amended by adding Section 2275.0104 to read as follows: |
---|
57 | 57 | | Sec. 2275.0104. USE OF CERTAIN CRITICAL INFRASTRUCTURE |
---|
58 | 58 | | PROHIBITED. A governmental entity may not use remote sensing |
---|
59 | 59 | | technology or a transportation infrastructure system purchased or |
---|
60 | 60 | | leased from a company described by Section 2275.0102(a)(2). |
---|
61 | 61 | | SECTION 5. With respect to a contract or other agreement |
---|
62 | 62 | | relating to critical infrastructure, the changes in law made by |
---|
63 | 63 | | this Act to Section 2275.0101, Government Code, apply only to a |
---|
64 | 64 | | contract or other agreement entered into on or after the effective |
---|
65 | 65 | | date of this Act. A contract or agreement entered into before the |
---|
66 | 66 | | effective date of this Act is governed by the law in effect on the |
---|
67 | 67 | | date the contract or agreement was entered into, and that law is |
---|
68 | 68 | | continued in effect for that purpose. |
---|
69 | 69 | | SECTION 6. Except as otherwise provided by this Act, this |
---|
70 | 70 | | Act takes effect September 1, 2025. |
