66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to data collection of truancy case outcomes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 65, Family Code, is
1111 amended by adding Section 65.201 and renumbering subsequent
1212 sections as follows:
1313 Sec. 65.201. DATA COLLECTION ON CASE OUTCOMES. (a) The
1414 truancy court shall annually report to the Office of Court
1515 Administration regarding the following case outcomes, in total and
1616 disaggregated by school district, race, ethnicity, sex, age, grade
1717 level, eligibility for special education services, eligibility for
1818 Section 504 services, pregnant or parenting status, homelessness
1919 status, English learner status, and economically disadvantaged:
2020 1) The number of referrals received under Section
2121 25.0915, Education Code;
2222 2) The number of referrals dismissed under Section
2323 25.0915, Education Code;
2424 3) The number of referrals forwarded to a truant conduct
2525 prosecutor under Sec. 65.051;
2626 4) The number of petitions filed by the truant conduct
2727 prosecutor under Sec. 65.053;
2828 5) The number of petitions dismissed due to the child's
2929 mental illness under Sec. 65.065;
3030 6) The number of cases dismissed due to a finding that
3131 the child did not engage in truant conduct under Sec 65.101(g);
3232 7) The number of judgments issued finding that the child
3333 engaged in truant conduct under Sec. 65.101(h);
3434 8) The number of remedial orders entered and
3535 disaggregated under Sec. 65.103 requiring a child to:
3636 A) Attend school without unexcused absences;
3737 B) Attend a preparatory class for the high school
3838 equivalency examination;
3939 C) Take the high school equivalency examination;
4040 D) Attend a nonprofit, community-based special
4141 program;
4242 E) Complete community service; or
4343 F) Participate in a tutorial program;
4444 9) The number of orders entered to suspend or deny the
4545 issuance of a driver's license or permit to a child under Sec. 65.
4646 103 (c) ;
4747 10) The number of cases closed due to the child's
4848 compliance with a remedial order;
4949 11) The number of orders affecting parents and others
5050 entered under Sec. 65.105;
5151 12) The number of orders entered assessing court costs
5252 under Sec. 65.107;
5353 13) The number of orders entered holding a child in
5454 contempt of court and assessing a fine under Sec. 65.251(a)(1);
5555 14) The number of orders entered holding a child in
5656 contempt of court and suspending or denying the issuance of a
5757 driver's license or permit to a child under Sec. 65.251(a)(2);
5858 15) The number of orders entered referring a child to
5959 the juvenile probation department under Sec. 65.251(b);
6060 16) The number of orders entered finding a parent or
6161 person other than the child in contempt of court and:
6262 (A) assessing a fine under Sec. 65.253(c);
6363 (B) ordering confinement in jail under Sec.
6464 65.253(d); or
6565 (C) ordering community service under Sec.
6666 65.253(d);
6767 17) The number of writs of attachment issued under
6868 Sec. 65.254; and
6969 18) The number of warrants for arrest issued under
7070 Sec. 65.258(d).
7171 (b) The truancy court shall annually report to the Office of
7272 Court Administration regarding the following information:
7373 (1) the total amount of court costs collected under
7474 Sec. 65.107;
7575 (2) the total amount of fines assessed under Sec.
7676 65.251(a)(1);
7777 (3) the total amount of fines collected under Sec.
7878 65.251(a)(1);
7979 (4) the total amount of fines assessed under Sec.
8080 65.253(c); and
8181 (5) the total amount of fines collected under Sec.
8282 65.253(c).
8383 (c) The Office of Court Administration shall annually
8484 publish the case outcomes and information for each court on the
8585 office's public Internet website in a searchable format.
8686 SECTION 2. This Act takes effect September 1, 2025.
