9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter E, Chapter 65, Family Code, is |
---|
11 | 11 | | amended by adding Section 65.201 and renumbering subsequent |
---|
12 | 12 | | sections as follows: |
---|
13 | 13 | | Sec. 65.201. DATA COLLECTION ON CASE OUTCOMES. (a) The |
---|
14 | 14 | | truancy court shall annually report to the Office of Court |
---|
15 | 15 | | Administration regarding the following case outcomes, in total and |
---|
16 | 16 | | disaggregated by school district, race, ethnicity, sex, age, grade |
---|
17 | 17 | | level, eligibility for special education services, eligibility for |
---|
18 | 18 | | Section 504 services, pregnant or parenting status, homelessness |
---|
19 | 19 | | status, English learner status, and economically disadvantaged: |
---|
20 | 20 | | 1) The number of referrals received under Section |
---|
21 | 21 | | 25.0915, Education Code; |
---|
22 | 22 | | 2) The number of referrals dismissed under Section |
---|
23 | 23 | | 25.0915, Education Code; |
---|
24 | 24 | | 3) The number of referrals forwarded to a truant conduct |
---|
25 | 25 | | prosecutor under Sec. 65.051; |
---|
26 | 26 | | 4) The number of petitions filed by the truant conduct |
---|
27 | 27 | | prosecutor under Sec. 65.053; |
---|
28 | 28 | | 5) The number of petitions dismissed due to the child's |
---|
29 | 29 | | mental illness under Sec. 65.065; |
---|
30 | 30 | | 6) The number of cases dismissed due to a finding that |
---|
31 | 31 | | the child did not engage in truant conduct under Sec 65.101(g); |
---|
32 | 32 | | 7) The number of judgments issued finding that the child |
---|
33 | 33 | | engaged in truant conduct under Sec. 65.101(h); |
---|
34 | 34 | | 8) The number of remedial orders entered and |
---|
35 | 35 | | disaggregated under Sec. 65.103 requiring a child to: |
---|
36 | 36 | | A) Attend school without unexcused absences; |
---|
37 | 37 | | B) Attend a preparatory class for the high school |
---|
38 | 38 | | equivalency examination; |
---|
39 | 39 | | C) Take the high school equivalency examination; |
---|
40 | 40 | | D) Attend a nonprofit, community-based special |
---|
41 | 41 | | program; |
---|
42 | 42 | | E) Complete community service; or |
---|
43 | 43 | | F) Participate in a tutorial program; |
---|
44 | 44 | | 9) The number of orders entered to suspend or deny the |
---|
45 | 45 | | issuance of a driver's license or permit to a child under Sec. 65. |
---|

47 | 47 | | 10) The number of cases closed due to the child's |
---|
48 | 48 | | compliance with a remedial order; |
---|
49 | 49 | | 11) The number of orders affecting parents and others |

---|
65 | 65 | | (C) ordering community service under Sec. |
---|
66 | 66 | | 65.253(d); |
---|
67 | 67 | | 17) The number of writs of attachment issued under |
---|
68 | 68 | | Sec. 65.254; and |
---|
69 | 69 | | 18) The number of warrants for arrest issued under |
---|
70 | 70 | | Sec. 65.258(d). |
---|
71 | 71 | | (b) The truancy court shall annually report to the Office of |
---|
72 | 72 | | Court Administration regarding the following information: |
---|
73 | 73 | | (1) the total amount of court costs collected under |
---|
74 | 74 | | Sec. 65.107; |
---|
75 | 75 | | (2) the total amount of fines assessed under Sec. |
---|
76 | 76 | | 65.251(a)(1); |
---|
77 | 77 | | (3) the total amount of fines collected under Sec. |
---|
78 | 78 | | 65.251(a)(1); |
---|
79 | 79 | | (4) the total amount of fines assessed under Sec. |
---|
80 | 80 | | 65.253(c); and |
---|
81 | 81 | | (5) the total amount of fines collected under Sec. |
---|
82 | 82 | | 65.253(c). |
---|
83 | 83 | | (c) The Office of Court Administration shall annually |
---|
84 | 84 | | publish the case outcomes and information for each court on the |
---|
85 | 85 | | office's public Internet website in a searchable format. |
---|
86 | 86 | | SECTION 2. This Act takes effect September 1, 2025. |
