77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the appointment of a special prosecutor by the court of
1010 criminal appeals for certain criminal cases.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 2A, Code of Criminal
1313 Procedure, is amended by adding Article 2A.112 to read as follows:
1414 Art. 2A.112. APPOINTMENT OF SPECIAL PROSECUTOR FOR CERTAIN
1515 CASES. (a) In this article, "prosecuting attorney" means a
1616 district attorney, criminal district attorney, or county attorney
1717 with criminal jurisdiction.
1818 (b) A law enforcement agency that investigates an offense
1919 prescribed by the election laws of this state may present to the
2020 court of criminal appeals a report that includes the
2121 investigation's findings and a description of any evidence obtained
2222 as a result of the investigation.
2323 (c) On receipt of a report under Subsection (b), the court
2424 of criminal appeals shall appoint a special prosecutor to:
2525 (1) review the report; and
2626 (2) make a determination to:
2727 (A) bring a criminal action based on the report;
2828 (B) decline to bring the action described by
2929 Paragraph (A); or
3030 (C) request that the law enforcement agency
3131 pursue further investigation.
3232 (d) To be eligible to be appointed as a special prosecutor
3333 under this article, a person must:
3434 (1) be a prosecuting attorney who serves an area that
3535 does not overlap with the area served by the law enforcement agency
3636 who presented the report, unless the law enforcement agency has
3737 statewide jurisdiction; and
3838 (2) have the appropriate experience to ensure
3939 competent representation of the state in any legal proceeding with
4040 respect to the offense that is the subject of the report.
4141 SECTION 2. This Act takes effect September 1, 2025.
