77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the Texas Food, Drug, and Cosmetic Act.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 431.002, Health and Safety Code, is
1212 amended by adding Subdivision (7) to read as follows:
1313 (7) "Commerce" means intrastate commerce and
1414 interstate commerce.
1515 SECTION 2. Section 431.011(a), Health and Safety Code, is
1616 amended to read as follows:
1717 (a) This chapter applies to a consumable hemp product
1818 subject to Chapter 443. [An article regulated under this chapter
1919 may not be deemed to be adulterated solely on the basis that the
2020 article is a consumable hemp product.]
2121 SECTION 3. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2025.
