7	12		AN ACT
8	13		relating to adding certain substances to the Texas Controlled
9	14		Substances Act and regulating kratom and kratom products;
10	15		increasing civil penalties; creating criminal offenses; increasing
11	16		a criminal penalty.
12	17		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	18		SECTION 1. Chapter 444, Health and Safety Code, as added by
14	19		Chapter 2 (S.B. 497), Acts of the 88th Legislature, Regular
15	20		Session, 2023, is redesignated as Chapter 445, Health and Safety
16	21		Code, and amended to read as follows:
17	22		CHAPTER 445 [444]. MANUFACTURE, DISTRIBUTION, AND SALE OF KRATOM
18	23		PRODUCTS
19	24		Sec. 445.001 [444.001]. DEFINITIONS. In this chapter:
20	25		(1) "Food" has the meaning assigned by Section
21	26		431.002.
22	27		(2) "Kratom" means any part of the leaf of the plant of
23	28		the species Mitragyna speciosa.
24	29		(3) "Kratom processor" means a person who:
25	30		(A) processes kratom for a kratom product;
26	31		(B) manufactures, prepares, or distributes[, or
27	32		maintains] kratom products for sale;
28	33		(C) [(B)] advertises, represents, or holds
29	34		oneself out as a manufacturer or[,] preparer[, or seller] of kratom
30	35		products;
31	36		(D) [(C)] is responsible for ensuring the purity
32	37		and proper labeling of kratom products; or
33	38		(E) [(D)] packages or labels kratom products.
34	39		(4) "Kratom product" means a food that contains[,
35	40		including an extract, capsule, or pill, containing any form of]
36	41		kratom.
37	42		(5) "Kratom retailer" means a person [kratom
38	43		processor] who sells or offers for sale kratom products to
39	44		consumers or who advertises, represents, or holds oneself out as a
40	45		person who sells kratom products to consumers.
41	46		(6) "Manufacture" has the meaning assigned by Section
42	47		431.002.
43	48		Sec. 445.002 [444.002]. TESTING AND LABELING [LABEL]
44	49		REQUIRED. (a) Before a kratom product is sold at retail or
45	50		otherwise introduced into commerce in this state, a sample
46	51		representing the kratom product must be tested:
47	52		(1) by a laboratory that is:
48	53		(A) located in this state; and
49	54		(B) accredited by an accreditation body in
50	55		accordance with International Organization for Standardization
51	56		ISO/IEC 17025 or a comparable or successor standard; and
52	57		(2) to determine:
53	58		(A) the concentration and identity of the
54	59		alkaloids in the product; and
55	60		(B) the presence or quantity of heavy metals,
56	61		pesticides, microbial contamination, and any other substances in
57	62		the product as prescribed by the executive commissioner.
58	63		(b) A kratom processor shall label each kratom product with
59	64		the product use directions necessary to ensure safe use of the
60	65		product by a consumer, including the recommended serving size for
61	66		the product.
62	67		(c) [(b)] A kratom retailer may only sell a kratom product
63	68		that is properly tested and labeled in accordance with this
64	69		section.
65	70		(d) A person commits an offense if the person sells or
66		-	offers for sale a kratom product or ~~a product marketed~~ as ~~containing~~
67		-	~~kratom that is not tested or labeled as~~ required by this section.

68	73		(e) An offense under this section is a Class A misdemeanor.
69	74		Sec. 445.003 [444.003]. ADULTERATED, CONTAMINATED, AND
70		-	PROHIBITED KRATOM PRODUCTS. (a) A person commits an offense if
71		-	the person manufactures, prepares, distributes, sells, or offers
72		-	for sale [A kratom processor or kratom retailer may not prepare,
73		-	distribute, sell, or offer to sell] a kratom product that:
	75	+	PROHIBITED KRATOM PRODUCTS. A person [kratom processor or kratom
	76	+	retailer] may not manufacture, prepare, distribute, sell, or offer
	77	+	for sale [to sell] a kratom product that:
74	78		(1) is adulterated with a dangerous non-kratom
75	79		substance affecting the quality or strength of the product to a
76	80		degree that renders the product injurious to a consumer;
77	81		(2) is contaminated with a poisonous or otherwise
78	82		deleterious non-kratom substance, including any substance
79	83		designated as a controlled substance by Chapter 481 (Texas
80	84		Controlled Substances Act);
81	85		(3) contains a level of 7-hydroxymitragynine in the
82	86		alkaloid fraction that is greater than 0.1 [two] percent of the
83	87		overall alkaloid composition of the product; [or]
84	88		(4) contains any artificial or synthetic alkaloids,
85	89		including artificial or synthetic 7-hydroxymitragynine and
86	90		synthetically derived compounds from [a] kratom;
87	91		(5) is a prepackaged beverage; or
88	92		(6) is a prepackaged food other than:
89	93		(A) raw or dried kratom leaves;
90	94		(B) ground kratom leaves;
91	95		(C) kratom leaf powder; or
92	96		(D) clear capsules containing kratom leaf powder
93	97		[plant].
94		-	(b) An offense under this section is a Class A misdemeanor.
95		-	(c) A kratom product described by Subsection (a) is
96		-	considered to be adulterated for purposes of Chapter 431.
97	98		Sec. 445.004 [444.004]. OFFENSE: [FOR] DISTRIBUTION OR
98	99		SALE OF KRATOM PRODUCT TO INDIVIDUAL YOUNGER THAN 21 YEARS OF AGE
99	100		[MINOR]. (a) A person commits an offense if the person
100		-	distributes, sells, or exposes for sale a kratom product or a
101		-	product marketed as containing kratom to an individual younger than
102		-	21 [18] years of age.
	101	+	distributes, sells, or exposes for sale a kratom product to an
	102	+	individual younger than 21 [18] years of age.
103	103		(b) An offense under this section is a Class A [C]
104	104		misdemeanor.
105	105		Sec. 445.005. OFFENSE: SALE OR DELIVERY OF CERTAIN KRATOM
106	106		PRODUCTS NEAR SCHOOL. (a) In this section, "school" and
107	107		"premises" have the meanings assigned by Section 481.134.
108	108		(b) A person commits an offense if the person sells, offers
109		-	for sale, or delivers a kratom product or a product marketed as
110		-	containing kratom in, on, or within 1,000 feet of the premises of a
111		-	school.
	109	+	for sale, or delivers a kratom product in, on, or within 1,000 feet
	110	+	of the premises of a school.
112	111		(c) An offense under this section is a Class A misdemeanor.
113	112		Sec. 445.006. OFFENSE: FALSE LABORATORY REPORT. (a) A
114	113		person commits an offense if the person, with the intent to deceive,
115	114		forges, falsifies, or alters the results of a laboratory test
116	115		authorized or required by this chapter.
117	116		(b) An offense under this section is a felony of the third
118	117		degree.
119	118		Sec. 445.007. OFFENSE: SALE OF OTHER PRODUCTS PROHIBITED.
120	119		(a) A person commits an offense if the person sells or offers for
121		-	sale a kratom product or a product marketed as containing kratom at
122		-	a location that also sells or offers for sale the following products
123		-	or products marketed as the following products:
	120	+	sale a kratom product at a location that also sells or offers for
	121	+	sale:
124	122		(1) a consumable hemp product as defined by Section
125	123		443.001;
126	124		(2) a cigarette, e-cigarette, or tobacco product as
127	125		defined by Section 161.081; or
128	126		(3) an alcoholic beverage as defined by Section 1.04,
129	127		Alcoholic Beverage Code.
130		-	(b) An offense under this section is a Class A misdemeanor.
131		-	Sec. 445.0071. OFFENSE: MANUFACTURE, DISTRIBUTION, OR SALE
132		-	OF KRATOM PRODUCT FOR SMOKING. (a) In this section, "smoking"
133		-	means burning or igniting a substance and inhaling the smoke or
134		-	heating a substance and inhaling the resulting vapor or aerosol.
135		-	(b) A person commits an offense if the person manufactures,
136		-	distributes, sells, or offers for sale a kratom product or a product
137		-	marketed as containing kratom for smoking.
138		-	(c) An offense under this section is a Class A misdemeanor.
139		-	Sec. 445.0072. OFFENSE: MANUFACTURE, DISTRIBUTION, OR SALE
140		-	OF PILL OR TABLET CONTAINING KRATOM. (a) A person commits an
141		-	offense if the person manufactures, distributes, sells, or offers
142		-	for sale a pill or tablet that contains kratom or that is marketed
143		-	as containing kratom. For purposes of this subsection, a capsule is
144		-	not considered to be a pill or tablet.
145	128		(b) An offense under this section is a Class A misdemeanor.
146	129		Sec. 445.008 [444.005]. CIVIL PENALTY. (a) A person who
147	130		violates this chapter is subject to a civil penalty in the amount
148	131		of:
149	132		(1) $2,500 [$250] for the first violation;
150	133		(2) $5,000 [$500] for the second violation; and
151	134		(3) $10,000 [$1,000] for each subsequent violation.
152	135		(b) Each day a violation continues or occurs is a separate
153	136		violation for purposes of imposing a penalty under this section.
154	137		(c) [A kratom retailer is not liable for a civil penalty
155	138		under this section for a violation of Section 444.002 or 444.003 if
156	139		the kratom retailer proves by a preponderance of the evidence that
157	140		the violation was unintentional and due to the kratom retailer's
158	141		good faith reliance on the representation of another kratom
159	142		processor.
160	143		[(d)] The attorney general or the district or county
161	144		attorney for the county or municipal attorney for the municipality
162	145		in which the violation is alleged to have occurred may bring an
163	146		action to recover a civil penalty under this section.
164	147		Sec. 445.009 [444.006]. PENALTIES UNDER OTHER LAW. The
165	148		penalties prescribed by this chapter are in addition to any other
166	149		penalties prescribed by law, including penalties prescribed by
167	150		Chapters 431 and 481.
168	151		Sec. 445.010 [444.007]. RULES. The executive commissioner
169	152		may adopt rules consistent with this chapter as necessary to ensure
170	153		the safe consumption and distribution of kratom and kratom
171	154		products.
172	155		SECTION 2. Section 481.002, Health and Safety Code, is
173	156		amended by adding Subdivision (56) to read as follows:
174	157		(56) "Kratom" means any part of the leaf of the plant
175	158		of the species Mitragyna speciosa.
176	159		SECTION 3. Section 481.102, Health and Safety Code, is
177	160		amended to read as follows:
178	161		Sec. 481.102. PENALTY GROUP 1. Penalty Group 1 consists of:
179	162		(1) the following opiates, including their isomers,
180	163		esters, ethers, salts, and salts of isomers, esters, and ethers,
181	164		unless specifically excepted, if the existence of these isomers,
182	165		esters, ethers, and salts is possible within the specific chemical
183	166		designation:

670	613		SECTION 5. The changes in law made by this Act apply only to
671	614		an offense committed on or after the effective date of this Act. An
672	615		offense committed before the effective date of this Act is governed
673	616		by the law in effect on the date the offense was committed, and the
674	617		former law is continued in effect for that purpose. For purposes of
675	618		this section, an offense was committed before the effective date of
676	619		this Act if any element of the offense occurred before that date.
677	620		SECTION 6. To the extent of any conflict, this Act prevails
678	621		over another Act of the 89th Legislature, Regular Session, 2025,
679	622		relating to nonsubstantive additions to and corrections in enacted
680	623		codes.
681	624		SECTION 7. This Act takes effect September 1, 2025.
