13 | 18 | | SECTION 1. Chapter 444, Health and Safety Code, as added by |
---|
14 | 19 | | Chapter 2 (S.B. 497), Acts of the 88th Legislature, Regular |
---|
15 | 20 | | Session, 2023, is redesignated as Chapter 445, Health and Safety |
---|
16 | 21 | | Code, and amended to read as follows: |
---|
17 | 22 | | CHAPTER 445 [444]. MANUFACTURE, DISTRIBUTION, AND SALE OF KRATOM |
---|

---|
19 | 24 | | Sec. 445.001 [444.001]. DEFINITIONS. In this chapter: |
---|
20 | 25 | | (1) "Food" has the meaning assigned by Section |
---|
21 | 26 | | 431.002. |
---|
22 | 27 | | (2) "Kratom" means any part of the leaf of the plant of |
---|
23 | 28 | | the species Mitragyna speciosa. |
---|
24 | 29 | | (3) "Kratom processor" means a person who: |
---|
25 | 30 | | (A) processes kratom for a kratom product; |
---|
26 | 31 | | (B) manufactures, prepares, or distributes[, or |
---|
27 | 32 | | maintains] kratom products for sale; |
---|
28 | 33 | | (C) [(B)] advertises, represents, or holds |
---|
29 | 34 | | oneself out as a manufacturer or[,] preparer[, or seller] of kratom |
---|
30 | 35 | | products; |
---|
31 | 36 | | (D) [(C)] is responsible for ensuring the purity |
---|
32 | 37 | | and proper labeling of kratom products; or |
---|
33 | 38 | | (E) [(D)] packages or labels kratom products. |
---|
34 | 39 | | (4) "Kratom product" means a food that contains[, |
---|
35 | 40 | | including an extract, capsule, or pill, containing any form of] |
---|
36 | 41 | | kratom. |
---|
37 | 42 | | (5) "Kratom retailer" means a person [kratom |
---|
38 | 43 | | processor] who sells or offers for sale kratom products to |
---|
39 | 44 | | consumers or who advertises, represents, or holds oneself out as a |
---|
40 | 45 | | person who sells kratom products to consumers. |
---|
41 | 46 | | (6) "Manufacture" has the meaning assigned by Section |
---|
42 | 47 | | 431.002. |
---|
43 | 48 | | Sec. 445.002 [444.002]. TESTING AND LABELING [LABEL] |
---|
44 | 49 | | REQUIRED. (a) Before a kratom product is sold at retail or |
---|
45 | 50 | | otherwise introduced into commerce in this state, a sample |
---|
46 | 51 | | representing the kratom product must be tested: |
---|
47 | 52 | | (1) by a laboratory that is: |
---|
48 | 53 | | (A) located in this state; and |
---|
49 | 54 | | (B) accredited by an accreditation body in |
---|
50 | 55 | | accordance with International Organization for Standardization |
---|
51 | 56 | | ISO/IEC 17025 or a comparable or successor standard; and |
---|
52 | 57 | | (2) to determine: |
---|
53 | 58 | | (A) the concentration and identity of the |
---|
54 | 59 | | alkaloids in the product; and |
---|
55 | 60 | | (B) the presence or quantity of heavy metals, |
---|
56 | 61 | | pesticides, microbial contamination, and any other substances in |
---|
57 | 62 | | the product as prescribed by the executive commissioner. |
---|
58 | 63 | | (b) A kratom processor shall label each kratom product with |
---|
59 | 64 | | the product use directions necessary to ensure safe use of the |
---|
60 | 65 | | product by a consumer, including the recommended serving size for |
---|
61 | 66 | | the product. |
---|
62 | 67 | | (c) [(b)] A kratom retailer may only sell a kratom product |
---|
63 | 68 | | that is properly tested and labeled in accordance with this |
---|
64 | 69 | | section. |
---|
65 | 70 | | (d) A person commits an offense if the person sells or |
---|
145 | 128 | | (b) An offense under this section is a Class A misdemeanor. |
---|
146 | 129 | | Sec. 445.008 [444.005]. CIVIL PENALTY. (a) A person who |
---|
147 | 130 | | violates this chapter is subject to a civil penalty in the amount |
---|
148 | 131 | | of: |
---|
149 | 132 | | (1) $2,500 [$250] for the first violation; |
---|
150 | 133 | | (2) $5,000 [$500] for the second violation; and |
---|
151 | 134 | | (3) $10,000 [$1,000] for each subsequent violation. |
---|
152 | 135 | | (b) Each day a violation continues or occurs is a separate |
---|
153 | 136 | | violation for purposes of imposing a penalty under this section. |
---|
154 | 137 | | (c) [A kratom retailer is not liable for a civil penalty |
---|
155 | 138 | | under this section for a violation of Section 444.002 or 444.003 if |
---|
156 | 139 | | the kratom retailer proves by a preponderance of the evidence that |
---|
157 | 140 | | the violation was unintentional and due to the kratom retailer's |
---|
158 | 141 | | good faith reliance on the representation of another kratom |
---|
159 | 142 | | processor. |
---|
160 | 143 | | [(d)] The attorney general or the district or county |
---|
161 | 144 | | attorney for the county or municipal attorney for the municipality |
---|
162 | 145 | | in which the violation is alleged to have occurred may bring an |
---|
163 | 146 | | action to recover a civil penalty under this section. |
---|
164 | 147 | | Sec. 445.009 [444.006]. PENALTIES UNDER OTHER LAW. The |
---|
165 | 148 | | penalties prescribed by this chapter are in addition to any other |
---|
166 | 149 | | penalties prescribed by law, including penalties prescribed by |
---|
167 | 150 | | Chapters 431 and 481. |
---|
168 | 151 | | Sec. 445.010 [444.007]. RULES. The executive commissioner |
---|
169 | 152 | | may adopt rules consistent with this chapter as necessary to ensure |
---|
170 | 153 | | the safe consumption and distribution of kratom and kratom |
---|
171 | 154 | | products. |

172 | 155 | | SECTION 2. Section 481.002, Health and Safety Code, is |
