712 AN ACT
813 relating to adding certain substances to the Texas Controlled
914 Substances Act and regulating kratom and kratom products;
1015 increasing civil penalties; creating criminal offenses; increasing
1116 a criminal penalty.
1217 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1318 SECTION 1. Chapter 444, Health and Safety Code, as added by
1419 Chapter 2 (S.B. 497), Acts of the 88th Legislature, Regular
1520 Session, 2023, is redesignated as Chapter 445, Health and Safety
1621 Code, and amended to read as follows:
1722 CHAPTER 445 [444]. MANUFACTURE, DISTRIBUTION, AND SALE OF KRATOM
1823 PRODUCTS
1924 Sec. 445.001 [444.001]. DEFINITIONS. In this chapter:
2025 (1) "Food" has the meaning assigned by Section
2126 431.002.
2227 (2) "Kratom" means any part of the leaf of the plant of
2328 the species Mitragyna speciosa.
2429 (3) "Kratom processor" means a person who:
2530 (A) processes kratom for a kratom product;
2631 (B) manufactures, prepares, or distributes[, or
2732 maintains] kratom products for sale;
2833 (C) [(B)] advertises, represents, or holds
2934 oneself out as a manufacturer or[,] preparer[, or seller] of kratom
3035 products;
3136 (D) [(C)] is responsible for ensuring the purity
3237 and proper labeling of kratom products; or
3338 (E) [(D)] packages or labels kratom products.
3439 (4) "Kratom product" means a food that contains[,
3540 including an extract, capsule, or pill, containing any form of]
3641 kratom.
3742 (5) "Kratom retailer" means a person [kratom
3843 processor] who sells or offers for sale kratom products to
3944 consumers or who advertises, represents, or holds oneself out as a
4045 person who sells kratom products to consumers.
4146 (6) "Manufacture" has the meaning assigned by Section
4247 431.002.
4348 Sec. 445.002 [444.002]. TESTING AND LABELING [LABEL]
4449 REQUIRED. (a) Before a kratom product is sold at retail or
4550 otherwise introduced into commerce in this state, a sample
4651 representing the kratom product must be tested:
4752 (1) by a laboratory that is:
4853 (A) located in this state; and
4954 (B) accredited by an accreditation body in
5055 accordance with International Organization for Standardization
5156 ISO/IEC 17025 or a comparable or successor standard; and
5257 (2) to determine:
5358 (A) the concentration and identity of the
5459 alkaloids in the product; and
5560 (B) the presence or quantity of heavy metals,
5661 pesticides, microbial contamination, and any other substances in
5762 the product as prescribed by the executive commissioner.
5863 (b) A kratom processor shall label each kratom product with
5964 the product use directions necessary to ensure safe use of the
6065 product by a consumer, including the recommended serving size for
6166 the product.
6267 (c) [(b)] A kratom retailer may only sell a kratom product
6368 that is properly tested and labeled in accordance with this
6469 section.
6570 (d) A person commits an offense if the person sells or
66- offers for sale a kratom product or a product marketed as containing
67- kratom that is not tested or labeled as required by this section.
71+ offers for sale a kratom product that is not tested or labeled as
72+ required by this section.
6873 (e) An offense under this section is a Class A misdemeanor.
6974 Sec. 445.003 [444.003]. ADULTERATED, CONTAMINATED, AND
70- PROHIBITED KRATOM PRODUCTS. (a) A person commits an offense if
71- the person manufactures, prepares, distributes, sells, or offers
72- for sale [A kratom processor or kratom retailer may not prepare,
73- distribute, sell, or offer to sell] a kratom product that:
75+ PROHIBITED KRATOM PRODUCTS. A person [kratom processor or kratom
76+ retailer] may not manufacture, prepare, distribute, sell, or offer
77+ for sale [to sell] a kratom product that:
7478 (1) is adulterated with a dangerous non-kratom
7579 substance affecting the quality or strength of the product to a
7680 degree that renders the product injurious to a consumer;
7781 (2) is contaminated with a poisonous or otherwise
7882 deleterious non-kratom substance, including any substance
7983 designated as a controlled substance by Chapter 481 (Texas
8084 Controlled Substances Act);
8185 (3) contains a level of 7-hydroxymitragynine in the
8286 alkaloid fraction that is greater than 0.1 [two] percent of the
8387 overall alkaloid composition of the product; [or]
8488 (4) contains any artificial or synthetic alkaloids,
8589 including artificial or synthetic 7-hydroxymitragynine and
8690 synthetically derived compounds from [a] kratom;
8791 (5) is a prepackaged beverage; or
8892 (6) is a prepackaged food other than:
8993 (A) raw or dried kratom leaves;
9094 (B) ground kratom leaves;
9195 (C) kratom leaf powder; or
9296 (D) clear capsules containing kratom leaf powder
9397 [plant].
94- (b) An offense under this section is a Class A misdemeanor.
95- (c) A kratom product described by Subsection (a) is
96- considered to be adulterated for purposes of Chapter 431.
9798 Sec. 445.004 [444.004]. OFFENSE: [FOR] DISTRIBUTION OR
9899 SALE OF KRATOM PRODUCT TO INDIVIDUAL YOUNGER THAN 21 YEARS OF AGE
99100 [MINOR]. (a) A person commits an offense if the person
100- distributes, sells, or exposes for sale a kratom product or a
101- product marketed as containing kratom to an individual younger than
102- 21 [18] years of age.
101+ distributes, sells, or exposes for sale a kratom product to an
102+ individual younger than 21 [18] years of age.
103103 (b) An offense under this section is a Class A [C]
104104 misdemeanor.
105105 Sec. 445.005. OFFENSE: SALE OR DELIVERY OF CERTAIN KRATOM
106106 PRODUCTS NEAR SCHOOL. (a) In this section, "school" and
107107 "premises" have the meanings assigned by Section 481.134.
108108 (b) A person commits an offense if the person sells, offers
109- for sale, or delivers a kratom product or a product marketed as
110- containing kratom in, on, or within 1,000 feet of the premises of a
111- school.
109+ for sale, or delivers a kratom product in, on, or within 1,000 feet
110+ of the premises of a school.
112111 (c) An offense under this section is a Class A misdemeanor.
113112 Sec. 445.006. OFFENSE: FALSE LABORATORY REPORT. (a) A
114113 person commits an offense if the person, with the intent to deceive,
115114 forges, falsifies, or alters the results of a laboratory test
116115 authorized or required by this chapter.
117116 (b) An offense under this section is a felony of the third
118117 degree.
119118 Sec. 445.007. OFFENSE: SALE OF OTHER PRODUCTS PROHIBITED.
120119 (a) A person commits an offense if the person sells or offers for
121- sale a kratom product or a product marketed as containing kratom at
122- a location that also sells or offers for sale the following products
123- or products marketed as the following products:
120+ sale a kratom product at a location that also sells or offers for
121+ sale:
124122 (1) a consumable hemp product as defined by Section
125123 443.001;
126124 (2) a cigarette, e-cigarette, or tobacco product as
127125 defined by Section 161.081; or
128126 (3) an alcoholic beverage as defined by Section 1.04,
129127 Alcoholic Beverage Code.
130- (b) An offense under this section is a Class A misdemeanor.
131- Sec. 445.0071. OFFENSE: MANUFACTURE, DISTRIBUTION, OR SALE
132- OF KRATOM PRODUCT FOR SMOKING. (a) In this section, "smoking"
133- means burning or igniting a substance and inhaling the smoke or
134- heating a substance and inhaling the resulting vapor or aerosol.
135- (b) A person commits an offense if the person manufactures,
136- distributes, sells, or offers for sale a kratom product or a product
137- marketed as containing kratom for smoking.
138- (c) An offense under this section is a Class A misdemeanor.
139- Sec. 445.0072. OFFENSE: MANUFACTURE, DISTRIBUTION, OR SALE
140- OF PILL OR TABLET CONTAINING KRATOM. (a) A person commits an
141- offense if the person manufactures, distributes, sells, or offers
142- for sale a pill or tablet that contains kratom or that is marketed
143- as containing kratom. For purposes of this subsection, a capsule is
144- not considered to be a pill or tablet.
145128 (b) An offense under this section is a Class A misdemeanor.
146129 Sec. 445.008 [444.005]. CIVIL PENALTY. (a) A person who
147130 violates this chapter is subject to a civil penalty in the amount
148131 of:
149132 (1) $2,500 [$250] for the first violation;
150133 (2) $5,000 [$500] for the second violation; and
151134 (3) $10,000 [$1,000] for each subsequent violation.
152135 (b) Each day a violation continues or occurs is a separate
153136 violation for purposes of imposing a penalty under this section.
154137 (c) [A kratom retailer is not liable for a civil penalty
155138 under this section for a violation of Section 444.002 or 444.003 if
156139 the kratom retailer proves by a preponderance of the evidence that
157140 the violation was unintentional and due to the kratom retailer's
158141 good faith reliance on the representation of another kratom
159142 processor.
160143 [(d)] The attorney general or the district or county
161144 attorney for the county or municipal attorney for the municipality
162145 in which the violation is alleged to have occurred may bring an
163146 action to recover a civil penalty under this section.
164147 Sec. 445.009 [444.006]. PENALTIES UNDER OTHER LAW. The
165148 penalties prescribed by this chapter are in addition to any other
166149 penalties prescribed by law, including penalties prescribed by
167150 Chapters 431 and 481.
168151 Sec. 445.010 [444.007]. RULES. The executive commissioner
169152 may adopt rules consistent with this chapter as necessary to ensure
170153 the safe consumption and distribution of kratom and kratom
171154 products.
172155 SECTION 2. Section 481.002, Health and Safety Code, is
173156 amended by adding Subdivision (56) to read as follows:
174157 (56) "Kratom" means any part of the leaf of the plant
175158 of the species Mitragyna speciosa.
176159 SECTION 3. Section 481.102, Health and Safety Code, is
177160 amended to read as follows:
178161 Sec. 481.102. PENALTY GROUP 1. Penalty Group 1 consists of:
179162 (1) the following opiates, including their isomers,
180163 esters, ethers, salts, and salts of isomers, esters, and ethers,
181164 unless specifically excepted, if the existence of these isomers,
182165 esters, ethers, and salts is possible within the specific chemical

670613 SECTION 5. The changes in law made by this Act apply only to
671614 an offense committed on or after the effective date of this Act. An
672615 offense committed before the effective date of this Act is governed
673616 by the law in effect on the date the offense was committed, and the
674617 former law is continued in effect for that purpose. For purposes of
675618 this section, an offense was committed before the effective date of
676619 this Act if any element of the offense occurred before that date.
677620 SECTION 6. To the extent of any conflict, this Act prevails
678621 over another Act of the 89th Legislature, Regular Session, 2025,
679622 relating to nonsubstantive additions to and corrections in enacted
680623 codes.
681624 SECTION 7. This Act takes effect September 1, 2025.
