7	7	AN ACT
8	8	relating to the transfer of certain state property from the Texas
9	9	Department of Criminal Justice to Walker County.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. (a) As soon as practicable, the Texas Department
12	12	of Criminal Justice shall transfer to Walker County the real
13	13	property interests of the State of Texas and the department in the
14	14	tract of land described by Subsection (f) of this section.
15	15	(b) Walker County may use the property transferred under
16	16	this Act only for a justice center. If Walker County uses the
17	17	property for any purpose other than the purpose described by this
18	18	subsection or if Walker County fails to use the property for the
19	19	purpose described by this subsection before the 10th anniversary of
20	20	the date of transfer, ownership of the property automatically
21	21	reverts to the Texas Department of Criminal Justice.
22	22	(c) The Texas Department of Criminal Justice shall transfer
23	23	the property by an appropriate instrument of transfer. The
24	24	instrument of transfer must:
25	25	(1) provide that:
26	26	(A) Walker County may use the property only for a
27	27	justice center; and
28	28	(B) ownership of the property will automatically
29	29	revert to the Texas Department of Criminal Justice if Walker
30	30	County:
31	31	(i) uses the property for any purpose other
32	32	than the purpose described by Paragraph (A) of this subdivision; or
33	33	(ii) fails to use the property for the
34	34	purpose described by Paragraph (A) of this subdivision before the
35	35	10th anniversary of the date of the transfer; and
36	36	(2) describe the property to be transferred by metes
37	37	and bounds.
38	38	(d) The Texas Department of Criminal Justice shall retain
39	39	custody of the instrument of transfer after the instrument of
40	40	transfer is filed in the real property records of Walker County.
41	41	(e) Sections 31.158 and 31.159, Natural Resources Code, do
42	42	not apply to the transfer of real property authorized by this Act.
43	43	(f) The tract of land referred to in this section is
44	44	described as follows:
45	45	State of Texas 14.999 Acres
46	46	County of WALKER
47	47	EXHIBIT "A"
48	48	Field notes of a 14.999 acres (653,371 sq. ft.)out of a called
49	49	279.39 acres, lying and being situated in the P. Gray League, A-24,
50	50	Walker County, being the same land described in Volume 112, Page 52
51	51	of the Official Records of Walker County, Texas and being more
52	52	particularly described herein;
53	53	Beginning at a concrete monument found in the south margin of a 100'
54	54	wide road (FM 2821), being the east margin of a variable width
55	55	county road (Smith Hill Road), marking the northwest corner and
56	56	point of beginning of the herein described 14.999 acres;
57	57	Thence N 60°21'13" E, along and with the south margin of FM 2821, a
58	58	distance of 159.94 feet to a concrete monument found, marking an
59	59	interior corner of the herein described 14.999 acres;
60	60	Thence continuing along and with the south margin of FM 2821 with a
61	61	curve to the right having a radius of 3780.30 feet, an arc length of
62	62	745.28, with a chord bearing of N 81°11'59" E, and a chord distance
63	63	of 744.07 feet to a concrete monument found for an interior corner
64	64	of the herein described 14.999 acres;
65	65	Thence N 86°58'17" E, continuing along and with the south margin of
66	66	FM 2821, a distance of 182.83 feet to a 1/2" iron rod set marked
67	67	"Campbell - Sandoval" from which a concrete monument found bears N
68	68	86°58'19" E, a distance of 557.10 feet marking the northeast corner
69	69	of the herein described 14.999 acres;
70	70	Thence S 03°53'37" E, departing the south margin of FM 2821, cutting
71	71	across and through the called 279.39 acre parent tract, a distance
72	72	of 634.00 feet to a 1/2" iron rod set marked "Campbell - Sandoval",
73	73	marking the southeast corner of the herein described 14.999 acres;
74	74	Thence S 85°53'14" W, cutting across and through the called 279.39
75	75	acre parent tract, a distance of 1067.85 feet to a 1/2" iron rod set
76	76	marked "Campbell - Sandoval" from which a 1/2" iron rod found bears
77	77	S 03°56'02" E, a distance of 121.33 feet, said point being in the
78	78	east margin of the aforementioned Smith Hill Road, marking the
79	79	southwest corner of the herein described 14.999 acres;
80	80	Thence N 03°56'02" W, along and with the east margin of Smith Hill
81	81	Road, a distance of 507.71 feet back to point of beginning and
82	82	containing 14.999 acres.
83	83	SECTION 2. This Act takes effect immediately if it receives
84	84	a vote of two-thirds of all the members elected to each house, as
85	85	provided by Section 39, Article III, Texas Constitution. If this
86	86	Act does not receive the vote necessary for immediate effect, this
87	87	Act takes effect September 1, 2025.
