8 | 8 | | relating to the transfer of certain state property from the Texas |
---|
9 | 9 | | Department of Criminal Justice to Walker County. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. (a) As soon as practicable, the Texas Department |
---|
12 | 12 | | of Criminal Justice shall transfer to Walker County the real |
---|
13 | 13 | | property interests of the State of Texas and the department in the |
---|
14 | 14 | | tract of land described by Subsection (f) of this section. |
---|
15 | 15 | | (b) Walker County may use the property transferred under |
---|
16 | 16 | | this Act only for a justice center. If Walker County uses the |
---|
17 | 17 | | property for any purpose other than the purpose described by this |
---|
18 | 18 | | subsection or if Walker County fails to use the property for the |
---|
19 | 19 | | purpose described by this subsection before the 10th anniversary of |
---|
20 | 20 | | the date of transfer, ownership of the property automatically |
---|
21 | 21 | | reverts to the Texas Department of Criminal Justice. |
---|
22 | 22 | | (c) The Texas Department of Criminal Justice shall transfer |
---|
23 | 23 | | the property by an appropriate instrument of transfer. The |
---|
24 | 24 | | instrument of transfer must: |
---|
25 | 25 | | (1) provide that: |
---|
26 | 26 | | (A) Walker County may use the property only for a |
---|
27 | 27 | | justice center; and |
---|
28 | 28 | | (B) ownership of the property will automatically |
---|
29 | 29 | | revert to the Texas Department of Criminal Justice if Walker |
---|
30 | 30 | | County: |
---|
31 | 31 | | (i) uses the property for any purpose other |
---|
32 | 32 | | than the purpose described by Paragraph (A) of this subdivision; or |
---|
33 | 33 | | (ii) fails to use the property for the |
---|
34 | 34 | | purpose described by Paragraph (A) of this subdivision before the |
---|
35 | 35 | | 10th anniversary of the date of the transfer; and |
---|
36 | 36 | | (2) describe the property to be transferred by metes |
---|
37 | 37 | | and bounds. |
---|
38 | 38 | | (d) The Texas Department of Criminal Justice shall retain |
---|
39 | 39 | | custody of the instrument of transfer after the instrument of |
---|
40 | 40 | | transfer is filed in the real property records of Walker County. |
---|
41 | 41 | | (e) Sections 31.158 and 31.159, Natural Resources Code, do |
---|
42 | 42 | | not apply to the transfer of real property authorized by this Act. |
---|
43 | 43 | | (f) The tract of land referred to in this section is |
---|
44 | 44 | | described as follows: |

83 | 83 | | SECTION 2. This Act takes effect immediately if it receives |
---|
84 | 84 | | a vote of two-thirds of all the members elected to each house, as |
---|
85 | 85 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
86 | 86 | | Act does not receive the vote necessary for immediate effect, this |
---|
87 | 87 | | Act takes effect September 1, 2025. |
