66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the transfer of certain state property from the Texas
99 Department of Criminal Justice to Walker County.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) As soon as practicable, the Texas Department
1212 of Criminal Justice shall transfer to Walker County the real
1313 property interests of the State of Texas and the department in the
1414 tract of land described by Subsection (f) of this section.
1515 (b) Walker County may use the property transferred under
1616 this Act only for a justice center. If Walker County uses the
1717 property for any purpose other than the purpose described by this
1818 subsection or if Walker County fails to use the property for the
1919 purpose described by this subsection before the 10th anniversary of
2020 the date of transfer, ownership of the property automatically
2121 reverts to the Texas Department of Criminal Justice.
2222 (c) The Texas Department of Criminal Justice shall transfer
2323 the property by an appropriate instrument of transfer. The
2424 instrument of transfer must:
2525 (1) provide that:
2626 (A) Walker County may use the property only for a
2727 justice center; and
2828 (B) ownership of the property will automatically
2929 revert to the Texas Department of Criminal Justice if Walker
3030 County:
3131 (i) uses the property for any purpose other
3232 than the purpose described by Paragraph (A) of this subdivision; or
3333 (ii) fails to use the property for the
3434 purpose described by Paragraph (A) of this subdivision before the
3535 10th anniversary of the date of the transfer; and
3636 (2) describe the property to be transferred by metes
3737 and bounds.
3838 (d) The Texas Department of Criminal Justice shall retain
3939 custody of the instrument of transfer after the instrument of
4040 transfer is filed in the real property records of Walker County.
4141 (e) Sections 31.158 and 31.159, Natural Resources Code, do
4242 not apply to the transfer of real property authorized by this Act.
4343 (f) The tract of land referred to in this section is
4444 described as follows:

4848 Field notes of a 14.999 acres (653,371 sq. ft.)out of a called
4949 279.39 acres, lying and being situated in the P. Gray League, A-24,
5050 Walker County, being the same land described in Volume 112, Page 52
5151 of the Official Records of Walker County, Texas and being more
5252 particularly described herein;
5353 Beginning at a concrete monument found in the south margin of a 100'
5454 wide road (FM 2821), being the east margin of a variable width
5555 county road (Smith Hill Road), marking the northwest corner and
5656 point of beginning of the herein described 14.999 acres;
5757 Thence N 60°21'13" E, along and with the south margin of FM 2821, a
5858 distance of 159.94 feet to a concrete monument found, marking an
5959 interior corner of the herein described 14.999 acres;
6060 Thence continuing along and with the south margin of FM 2821 with a
6161 curve to the right having a radius of 3780.30 feet, an arc length of
6262 745.28, with a chord bearing of N 81°11'59" E, and a chord distance
6363 of 744.07 feet to a concrete monument found for an interior corner
6464 of the herein described 14.999 acres;
6565 Thence N 86°58'17" E, continuing along and with the south margin of
6666 FM 2821, a distance of 182.83 feet to a 1/2" iron rod set marked
6767 "Campbell - Sandoval" from which a concrete monument found bears N
6868 86°58'19" E, a distance of 557.10 feet marking the northeast corner
6969 of the herein described 14.999 acres;
7070 Thence S 03°53'37" E, departing the south margin of FM 2821, cutting
7171 across and through the called 279.39 acre parent tract, a distance
7272 of 634.00 feet to a 1/2" iron rod set marked "Campbell - Sandoval",
7373 marking the southeast corner of the herein described 14.999 acres;
7474 Thence S 85°53'14" W, cutting across and through the called 279.39
7575 acre parent tract, a distance of 1067.85 feet to a 1/2" iron rod set
7676 marked "Campbell - Sandoval" from which a 1/2" iron rod found bears
7777 S 03°56'02" E, a distance of 121.33 feet, said point being in the
7878 east margin of the aforementioned Smith Hill Road, marking the
7979 southwest corner of the herein described 14.999 acres;
8080 Thence N 03°56'02" W, along and with the east margin of Smith Hill
8181 Road, a distance of 507.71 feet back to point of beginning and
8282 containing 14.999 acres.
8383 SECTION 2. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2025.
