611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the execution of a search warrant for taking a blood
914 specimen from certain persons in certain intoxication offenses.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Article 18.067, Code of Criminal Procedure, is
1217 amended to read as follows:
1318 Art. 18.067. EXECUTION OF WARRANT FOR BLOOD SPECIMEN IN
1419 INTOXICATION OFFENSE. Notwithstanding any other law, a warrant
1520 issued under Article 18.02(a)(10) to collect a blood specimen from
1621 a person suspected of committing an intoxication offense under
1722 Section 49.04, 49.045, 49.05, 49.06, 49.061, 49.065, 49.07, or
1823 49.08, Penal Code, may be executed by any peace officer[:
1924 [(1)] in any county adjacent to the county in which the
2025 warrant was issued[; and
2126 [(2) by any law enforcement officer authorized to make
2227 an arrest in the county of execution].
2328 SECTION 2. The change in law made by this Act applies only
2429 to a search warrant issued on or after the effective date of this
2530 Act. A search warrant issued before the effective date of this Act
2631 is governed by the law in effect on the date the warrant was issued,
2732 and the former law is continued in effect for that purpose.
2833 SECTION 3. This Act takes effect September 1, 2025.
