77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a criminal offense committed against a person because
1010 of bias or prejudice on the basis of sexual orientation or gender
1111 identity.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Article 42.014(a), Code of Criminal Procedure,
1414 is amended to read as follows:
1515 (a) In the trial of an offense under Title 5, Penal Code, or
1616 Section 28.02, 28.03, 28.08, or 42.0601, Penal Code, the judge
1717 shall make an affirmative finding of fact and enter the affirmative
1818 finding in the judgment of the case if at the guilt or innocence
1919 phase of the trial, the judge or the jury, whichever is the trier of
2020 fact, determines beyond a reasonable doubt that the defendant
2121 intentionally selected the person against whom the offense was
2222 committed, or intentionally selected the person's property that was
2323 damaged or affected as a result of the offense, because of the
2424 defendant's bias or prejudice against a group identified by race,
2525 color, disability, religion, national origin or ancestry, age,
2626 gender, [or] sexual orientation, or gender identity [preference] or
2727 by status as a peace officer or judge.
2828 SECTION 2. Article 42.014(c), Code of Criminal Procedure,
2929 is repealed.
3030 SECTION 3. The change in law made by this Act applies only
3131 to an offense committed on or after the effective date of this Act.
3232 An offense committed before the effective date of this Act is
3333 governed by the law in effect on the date the offense was committed,
3434 and the former law is continued in effect for that purpose. For
3535 purposes of this section, an offense was committed before the
3636 effective date of this Act if any element of the offense occurred
3737 before that date.
3838 SECTION 4. This Act takes effect September 1, 2025.
