77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to providing a cost-of-living adjustment applicable to
1010 certain benefits paid by the Employees Retirement System of Texas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter G, Chapter 814, Government Code, is
1313 amended by adding Section 814.605 to read as follows:
1414 Sec. 814.605. COST-OF-LIVING ADJUSTMENT FOR CERTAIN
1515 ANNUITANTS: JANUARY 2026. (a) The amount of a death benefit paid
1616 under this chapter to an annuitant based on service credited in the
1717 employee class is increased to include a cost-of-living adjustment
1818 in accordance with this section.
1919 (b) Subject to Subsections (c) and (d), to be eligible for
2020 the adjustment:
2121 (1) a person must be:
2222 (A) for the month of December 2025, an annuitant
2323 eligible to receive a death benefit annuity payment under Section
2424 814.301, 814.302, or 814.305; and
2525 (B) the surviving spouse or the guardian of the
2626 surviving minor children of the deceased member on whose service
2727 the annuity is based; and
2828 (2) the deceased member described by Subdivision
2929 (1)(B) must have been employed by the state as a law enforcement
3030 officer at the time of the member's death which must have been an
3131 occupational death, as determined by the executive director.
3232 (c) The adjustment does not apply to benefit payments based
3333 on service credited in the elected class.
3434 (d) To be eligible for the adjustment under this section:
3535 (1) the annuitant described by Subsection (b) must be
3636 living on the effective date of the adjustment; and
3737 (2) the date of death of the member of the retirement
3838 system on whose service the annuity is based must have been before
3939 September 1, 2025.
4040 (e) An adjustment under this section must be made beginning
4141 with an annuity payable for the month of January 2026.
4242 (f) The amount of the adjustment provided under this section
4343 is computed by multiplying the amount of the monthly benefit
4444 subject to the adjustment by the following percentage rate, as
4545 applicable:
4646 (1) if the date of the death of the member of the
4747 retirement system on whose service the annuity is based was on or
4848 before August 31, 2014, seven percent; and
4949 (2) if the date of the death of the member of the
5050 retirement system on whose service the annuity is based was after
5151 August 31, 2014, four percent.
5252 (g) The board of trustees shall recompute the amount of a
5353 death benefit annuity paid monthly under this chapter by applying
5454 the adjustment required under Subsection (f) to the monthly amount
5555 otherwise required to be paid. The adjustment under this section is
5656 in addition to the adjustment, if any, granted under Section
5757 814.604 or any other law.
5858 (h) The board of trustees shall determine the eligibility
5959 for and the amount of any adjustment in monthly annuities in
6060 accordance with this section.
6161 SECTION 2. Section 814.605, Government Code, as added by
6262 this Act, applies only to a monthly benefit payment made by the
6363 Employees Retirement System of Texas on or after January 1, 2026.
6464 SECTION 3. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2025.
