77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the minimum standards of care provided to sexual
1010 assault survivors by health care facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 323.004(b), Health and Safety Code, is
1313 amended to read as follows:
1414 (b) A health care facility providing care to a sexual
1515 assault survivor shall provide the survivor with:
1616 (1) subject to Subsection (b-1), a forensic medical
1717 examination in accordance with Subchapter B, Chapter 420,
1818 Government Code, and Subchapter G, Chapter 56A, Code of Criminal
1919 Procedure;
2020 (2) a private area, if available, to wait or speak with
2121 the appropriate medical, legal, or sexual assault crisis center
2222 staff or volunteer until a physician, nurse, or physician assistant
2323 is able to treat the survivor;
2424 (3) access to a sexual assault program advocate, if
2525 available, as provided by Subchapter H, Chapter 56A, Code of
2626 Criminal Procedure;
2727 (4) the information form required by Section 323.005;
2828 (5) a private treatment room, if available;
2929 (6) if indicated by the history of contact, access to
3030 appropriate prophylaxis for exposure to sexually transmitted
3131 infections;
3232 (7) the name and telephone number of the nearest
3333 sexual assault crisis center; [and]
3434 (8) if the health care facility has shower facilities,
3535 access to a shower at no cost to the survivor after the examination
3636 described by Subdivision (1); and
3737 (9) if the survivor consents and the treatment is
3838 clinically indicated, an emergency contraceptive approved by the
3939 United States Food and Drug Administration to prevent pregnancy.
4040 SECTION 2. This Act takes effect September 1, 2025.
