66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the unlawful possession of a firearm by a person not
99 lawfully present in the United States; creating a criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 46.04, Penal Code, is amended by adding
1212 Subsection (a-2) and amending Subsection (e) to read as follows:
1313 (a-2) A person commits an offense if the person is not
1414 lawfully present in the United States and possesses a firearm.
1515 (e) An offense under Subsection (a) or (a-2) is a felony of
1616 the third degree. An offense under Subsection (a-1), (b), or (c) is
1717 a Class A misdemeanor.
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2025.
