| 11 | 11 | SECTION 1. Section 46.04, Penal Code, is amended by adding | |
| 12 | 12 | Subsection (a-2) and amending Subsection (e) to read as follows: | |
| 13 | 13 | (a-2) A person commits an offense if the person is not | |
| 14 | 14 | lawfully present in the United States and possesses a firearm. | |
| 15 | 15 | (e) An offense under Subsection (a) or (a-2) is a felony of | |
| 16 | 16 | the third degree. An offense under Subsection (a-1), (b), or (c) is | |
| 17 | 17 | a Class A misdemeanor. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2025. |
