10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 39.905, Utilities Code, is amended by | |
12 | 12 | adding Subsection (a-1) to read as follows: | |
13 | 13 | (a-1) In addition to meeting the demand goals provided by | |
14 | 14 | Subsection (a), the commission by rule shall provide a method to | |
15 | 15 | establish an annual energy savings goal of one percent not later | |
16 | 16 | than the 2032 calendar year for each electric utility. The method | |
17 | 17 | must be based on the existing and expected usage of electricity | |
18 | 18 | delivered in a utility's service area that is required to pay the | |
19 | 19 | annual energy efficiency cost recovery fee. In adopting rules, the | |
20 | 20 | commission may provide for cost caps for the implementation of this | |
21 | 21 | subsection and provide good cause exceptions for a utility that is | |
22 | 22 | unable to meet the goal in a cost-effective manner. | |
23 | 23 | SECTION 2. The Public Utility Commission of Texas shall | |
24 | 24 | adopt rules to implement the changes made by this Act to Section | |
25 | 25 | 39.905, Utilities Code, not later than December 31, 2025. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2025. |
