| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 201.106(b), Transportation Code, is | |
| 12 | 12 | amended to read as follows: | |
| 13 | 13 | (b) The department may settle a claim described by | |
| 14 | 14 | Subsection (a) if: | |
| 15 | 15 | (1) the department may be liable under Chapter 101, | |
| 16 | 16 | Civil Practice and Remedies Code; | |
| 17 | 17 | (2) the director determines that a settlement is in | |
| 18 | 18 | the best interest of the department; and | |
| 19 | 19 | (3) the department's liability under the terms of the | |
| 20 | 20 | settlement is less than $100,000 [$10,000]. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2025. |
