77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a grant program to reimburse public schools for certain
1010 costs associated with hiring retired teachers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter I, Chapter 21, Education Code, is
1313 amended by adding Section 21.416 to read as follows:
1414 Sec. 21.416. EMPLOYED RETIREE TEACHER REIMBURSEMENT GRANT
1515 PROGRAM. (a) From money appropriated or otherwise available, the
1616 commissioner shall establish and administer a grant program to
1717 reimburse a school district, an open-enrollment charter school, the
1818 Windham School District, the Texas School for the Deaf, or the Texas
1919 School for the Blind and Visually Impaired for the increased
2020 contributions to the Teacher Retirement System associated with
2121 hiring a teacher who retired before September 1, 2024.
2222 (b) In appropriating money for grants awarded under this
2323 section, the legislature may provide for, modify, or limit amounts
2424 appropriated for that purpose in the General Appropriations Act,
2525 including by:
2626 (1) providing, notwithstanding Subsection (a), a date
2727 or date range other than September 1, 2024, before which a teacher
2828 must have retired for a school district, an open-enrollment charter
2929 school, the Windham School District, the Texas School for the Deaf,
3030 or the Texas School for the Blind and Visually Impaired to be
3131 eligible; or
3232 (2) limiting eligibility to a district or school
3333 described by Subdivision (1) that hires a retired teacher:
3434 (A) who holds a certain certification;
3535 (B) to teach a certain subject or grade;
3636 (C) in a certain geographical area; or
3737 (D) to provide instruction to certain students,
3838 including to students with disabilities.
3939 (c) If the total amount of money sought by eligible
4040 districts or schools exceeds the amount of money appropriated or
4141 otherwise available for the purpose, the commissioner shall
4242 prioritize awarding grants to eligible districts or schools with
4343 the most need, beginning with districts or schools that hire a
4444 retired teacher to teach special education or bilingual education.
4545 (d) A school district, an open-enrollment charter school,
4646 the Windham School District, the Texas School for the Deaf, or the
4747 Texas School for the Blind and Visually Impaired may use money
4848 received under this section to make required payments under Section
4949 825.4092, Government Code.
5050 SECTION 2. This Act applies beginning with the 2025-2026
5151 school year.
5252 SECTION 3. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2025.
