| 10 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 18 | | SECTION 1. Section 212.905, Local Government Code, is |
|---|
| 12 | 19 | | amended by amending Subsection (h) and adding Subsection (h-1) to |
|---|
| 13 | 20 | | read as follows: |
|---|
| 14 | 21 | | (h) A municipality may not prohibit the removal of or impose |
|---|
| 15 | 22 | | a tree mitigation fee for the removal of [a tree that]: |
|---|
| 16 | 23 | | (1) a tree that is diseased or dead; [or] |
|---|
| 17 | 24 | | (2) a tree that poses an imminent or immediate threat |
|---|
| 18 | 25 | | to persons or property; or |
|---|
| 19 | 26 | | (3) except as provided by Subsection (h-1), an Ashe |
|---|
| 20 | 27 | | juniper tree located on a residential property. |
|---|
| 21 | 28 | | (h-1) Subsection (h)(3) does not apply to an area located: |
|---|
| 22 | 29 | | (1) within 15 miles of the boundary of a military base, |
|---|
| 23 | 30 | | as defined by Section 43.0117, at which an active training program |
|---|
| 24 | 31 | | is conducted; and |
|---|
| 25 | 32 | | (2) in a county with a population of more than two |
|---|
| 26 | 33 | | million. |
|---|
| 27 | 34 | | SECTION 2. This Act takes effect September 1, 2025. |
