613 A BILL TO BE ENTITLED
714 AN ACT
815 relating to municipal regulation of the removal of an Ashe juniper
916 tree.
1017 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1118 SECTION 1. Section 212.905, Local Government Code, is
1219 amended by amending Subsection (h) and adding Subsection (h-1) to
1320 read as follows:
1421 (h) A municipality may not prohibit the removal of or impose
1522 a tree mitigation fee for the removal of [a tree that]:
1623 (1) a tree that is diseased or dead; [or]
1724 (2) a tree that poses an imminent or immediate threat
1825 to persons or property; or
1926 (3) except as provided by Subsection (h-1), an Ashe
2027 juniper tree located on a residential property.
2128 (h-1) Subsection (h)(3) does not apply to an area located:
2229 (1) within 15 miles of the boundary of a military base,
2330 as defined by Section 43.0117, at which an active training program
2431 is conducted; and
2532 (2) in a county with a population of more than two
2633 million.
2734 SECTION 2. This Act takes effect September 1, 2025.
