66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the definition of an abuse unit for certain controlled
99 substances under the Texas Controlled Substances Act.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 481.002(50), Health and Safety Code, is
1212 amended to read as follows:
1313 (50) "Abuse unit" means:
1414 (A) except as provided by Paragraph (B):
1515 (i) a single unit on or in any adulterant,
1616 dilutant, or similar carrier medium, including marked or perforated
1717 blotter paper, a tablet, gelatin wafer, sugar cube, or stamp, or
1818 other medium that contains any amount of a controlled substance
1919 listed in Penalty Group 1-A, if the unit is commonly used in abuse
2020 of that substance; or
2121 (ii) each 10 milligrams [quarter-inch
2222 square section] of paper, calculated by rounding the weight down to
2323 the nearest whole number, if the adulterant, dilutant, or carrier
2424 medium is paper not marked or perforated into individual abuse
2525 units; or
2626 (B) if the controlled substance is in liquid or
2727 solid form, 40 micrograms of the controlled substance including any
2828 adulterant or dilutant.
2929 SECTION 2. The change in law made by this Act applies only
3030 to an offense committed on or after the effective date of this Act.
3131 An offense committed before the effective date of this Act is
3232 governed by the law in effect on the date the offense was committed,
3333 and the former law is continued in effect for that purpose. For
3434 purposes of this section, an offense was committed before the
3535 effective date of this Act if any element of the offense occurred
3636 before that date.
3737 SECTION 3. This Act takes effect September 1, 2025.
