99 relating to electricity planning for large loads.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 39, Utilities Code, is
1212 amended by adding Section 39.169 to read as follows:
1313 Sec. 39.169. LARGE LOAD INTERCONNECTION; RELIABILITY
1414 PROGRAM. (a) In this section, "behind-the-meter generation" means
1515 a new generation facility on the retail customer's side of the
1616 meter.
1717 (b) The commission by rule shall require the independent
1818 organization certified under Section 39.151 for the ERCOT power
1919 region to develop and implement an interconnection program to
2020 provide an expedited interconnection process for operators of large
2121 loads who agree to cease consuming energy from the power grid
2222 through deployment of their behind-the-meter generation when
2323 directed to by the independent organization. The program must be
2424 available only to large loads that are a facility at a single site
2525 with an aggregate peak power demand that exceeds a demand threshold
2626 established by the independent organization. The threshold must be
2727 at least 75 megawatts unless the independent organization
2828 determines that a lower threshold will better ensure reliability in
2929 the ERCOT power region.
3030 (c) The program must require the independent organization
3131 certified under Section 39.151 for the ERCOT power region and the
3232 relevant electric cooperative, municipally owned utility, or
3333 transmission and distribution utility to give priority to a large
3434 load in the interconnection queue participating in the program.
3535 (d) The program must provide that:
3636 (1) an interconnection application for a
3737 participating large load with behind-the-meter generation that
3838 agrees to offer the energy generated by the behind-the-meter
3939 generation to the power grid at times directed by the independent
4040 organization or reduce its energy consumption from the power grid
4141 to a minimum level established by the independent organization will
4242 be given priority over other interconnection applications that are
4343 pending before the independent organization and the relevant
4444 electric cooperative, municipally owned utility, or transmission
4545 and distribution utility, including any applications from other
4646 participating large loads without behind-the-meter generation;
4747 (2) if applicable, the generator interconnection
4848 application for a participating large load's behind-the-meter
4949 generation will be processed in parallel with the load
5050 interconnection application; and
5151 (3) an applicant for participation in the program may
5252 choose:
5353 (A) if authorized by the independent
5454 organization and the relevant electric cooperative, municipally
5555 owned utility, or transmission and distribution utility, to
5656 contract with a vendor approved by the relevant electric
5757 cooperative, municipally owned utility, or transmission and
5858 distribution utility or by the independent organization to perform
5959 all studies required by the relevant electric cooperative,
6060 municipally owned utility, or transmission and distribution
6161 utility before the approval of the interconnection application;
6262 (B) to procure equipment required for the
6363 interconnection in accordance with technical specifications
6464 provided by the relevant electric cooperative, municipally owned
6565 utility, or transmission and distribution utility; and
6666 (C) to construct interconnection facilities in
6767 accordance with technical and other requirements of the relevant
6868 electric cooperative, municipally owned utility, or transmission
6969 and distribution utility.
7070 (e) The program shall provide that studies required by an
7171 electric cooperative, municipally owned utility, or transmission
7272 and distribution utility before the approval of an interconnection
7373 application for a participating large load may evaluate the load as
7474 non-firm.
7575 SECTION 2. This Act takes effect September 1, 2025.
