9 | 9 | | relating to the appointment of an interpreter for a court |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Sections 57.002(a) and (b), Government Code, are |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (a) A court, including a municipal or justice court, shall |
---|
15 | 15 | | appoint a certified court interpreter or a certified CART provider |
---|
16 | 16 | | for an individual who has a hearing impairment or a licensed court |
---|
17 | 17 | | interpreter for an individual who can hear but does not comprehend |
---|
18 | 18 | | or communicate in English if a motion for the appointment of an |
---|
19 | 19 | | interpreter or provider is filed by a party or requested by a |
---|
20 | 20 | | witness in a civil or criminal proceeding in the court. |
---|
21 | 21 | | (b) A court, including a municipal or justice court, may, on |
---|
22 | 22 | | its own motion, appoint a certified court interpreter or a |
---|
23 | 23 | | certified CART provider for an individual who has a hearing |
---|
24 | 24 | | impairment or a licensed court interpreter for an individual who |
---|
25 | 25 | | can hear but does not comprehend or communicate in English. |
---|
26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2025. |
