98 relating to the regulation of fire prevention standards for certain
109 agricultural facilities.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Subtitle Z, Title 10, Government Code, is
1312 amended by adding Chapter 3001 to read as follows:
1413 CHAPTER 3001. RESTRICTIONS ON CERTAIN FIRE REGULATIONS
1514 Sec. 3001.001. DEFINITIONS. In this chapter:
1615 (1) "Agricultural pole barn" means a nonresidential
1716 farm building in which 70 percent or more of the perimeter walls are
1817 permanently open and allow free ingress and egress.
1918 (2) "Governmental entity" has the meaning assigned by
2019 Section 2007.002.
2120 (3) "Livestock market" has the meaning assigned by
2221 Section 161.111, Agriculture Code.
2322 (4) "Nonresidential farm building" means any
2423 temporary or permanent building on a farm, ranch, or other
2524 agricultural facility that is used primarily for agricultural
2625 purposes and not intended to be used as a residential dwelling. The
2726 term includes a barn, greenhouse, shade house, farm office, storage
2827 building, workshop, poultry house, animal handling facility, or
2928 commodity storage and feed processing facility.
3029 Sec. 3001.002. RESTRICTION ON REGULATION OF CERTAIN
3130 AGRICULTURAL FACILITIES. Notwithstanding any other law, a
3231 governmental entity may not adopt or enforce an ordinance, order,
3332 rule, or other measure that requires the installation of a fire
3433 protection sprinkler system in:
3534 (1) an agricultural pole barn;
3635 (2) a nonresidential farm building;
3736 (3) a cotton gin;
3837 (4) a cottonseed storage building;
3938 (5) a grain storage facility;
4039 (6) a livestock market; or
4140 (7) a commercial feed mill.
4241 SECTION 2. This Act takes effect September 1, 2025.
