117 A BILL TO BE ENTITLED
128 AN ACT
139 relating to the administration and operation of the school health
1410 and related services program.
1511 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1612 SECTION 1. Subchapter B, Chapter 532, Government Code, as
1713 effective April 1, 2025, is amended by adding Section 532.00515 to
1814 read as follows:
1915 Sec. 532.00515. SCHOOL HEALTH AND RELATED SERVICES PROGRAM.
2016 (a) In this section:
2117 (1) "Local education agency" includes a school
2218 district or open-enrollment charter school.
2319 (2) "Regional education service center" means a
2420 regional education service center established under Chapter 8,
2521 Education Code.
2622 (b) In accordance with Section 532.0051(a), the commission
2723 is the sole state agency responsible for administering the school
2824 health and related services program.
2925 (c) The commission shall:
3026 (1) oversee the participation of local education
3127 agencies as providers in the school health and related services
3228 program, including:
3329 (A) the administration of provider training; and
3430 (B) the provision of information and guidance
3531 regarding the program to those providers, including guidance on
3632 applicable federal and state regulatory requirements; and
3733 (2) collaborate with regional education service
3834 centers to provide resources, information, and other appropriate
3935 assistance to local education agencies participating or seeking to
4036 participate as providers in the school health and related services
4137 program.
4238 (d) The commission and the Texas Education Agency shall
4339 enter into a memorandum of understanding that specifically
4440 identifies the responsibilities of each agency with respect to
4541 operating the school health and related services program.
4642 SECTION 2. If before implementing any provision of this Act
4743 a state agency determines that a waiver or authorization from a
4844 federal agency is necessary for implementation of that provision,
4945 the agency affected by the provision shall request the waiver or
5046 authorization and may delay implementing that provision until the
5147 waiver or authorization is granted.
5248 SECTION 3. This Act takes effect immediately if it receives
5349 a vote of two-thirds of all the members elected to each house, as
5450 provided by Section 39, Article III, Texas Constitution. If this
5551 Act does not receive the vote necessary for immediate effect, this
5652 Act takes effect September 1, 2025.
