| 15 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 12 | | SECTION 1. Subchapter B, Chapter 532, Government Code, as |
|---|
| 17 | 13 | | effective April 1, 2025, is amended by adding Section 532.00515 to |
|---|
| 18 | 14 | | read as follows: |
|---|
| 19 | 15 | | Sec. 532.00515. SCHOOL HEALTH AND RELATED SERVICES PROGRAM. |
|---|
| 20 | 16 | | (a) In this section: |
|---|
| 21 | 17 | | (1) "Local education agency" includes a school |
|---|
| 22 | 18 | | district or open-enrollment charter school. |
|---|
| 23 | 19 | | (2) "Regional education service center" means a |
|---|
| 24 | 20 | | regional education service center established under Chapter 8, |
|---|
| 25 | 21 | | Education Code. |
|---|
| 26 | 22 | | (b) In accordance with Section 532.0051(a), the commission |
|---|
| 27 | 23 | | is the sole state agency responsible for administering the school |
|---|
| 28 | 24 | | health and related services program. |
|---|
| 29 | 25 | | (c) The commission shall: |
|---|
| 30 | 26 | | (1) oversee the participation of local education |
|---|
| 31 | 27 | | agencies as providers in the school health and related services |
|---|
| 32 | 28 | | program, including: |
|---|
| 33 | 29 | | (A) the administration of provider training; and |
|---|
| 34 | 30 | | (B) the provision of information and guidance |
|---|
| 35 | 31 | | regarding the program to those providers, including guidance on |
|---|
| 36 | 32 | | applicable federal and state regulatory requirements; and |
|---|
| 37 | 33 | | (2) collaborate with regional education service |
|---|
| 38 | 34 | | centers to provide resources, information, and other appropriate |
|---|
| 39 | 35 | | assistance to local education agencies participating or seeking to |
|---|
| 40 | 36 | | participate as providers in the school health and related services |
|---|
| 41 | 37 | | program. |
|---|
| 42 | 38 | | (d) The commission and the Texas Education Agency shall |
|---|
| 43 | 39 | | enter into a memorandum of understanding that specifically |
|---|
| 44 | 40 | | identifies the responsibilities of each agency with respect to |
|---|
| 45 | 41 | | operating the school health and related services program. |
|---|
| 46 | 42 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 47 | 43 | | a state agency determines that a waiver or authorization from a |
|---|
| 48 | 44 | | federal agency is necessary for implementation of that provision, |
|---|
| 49 | 45 | | the agency affected by the provision shall request the waiver or |
|---|
| 50 | 46 | | authorization and may delay implementing that provision until the |
|---|
| 51 | 47 | | waiver or authorization is granted. |
|---|
| 52 | 48 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 53 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 54 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 55 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 56 | 52 | | Act takes effect September 1, 2025. |
