77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of a person to serve on a civilian
1010 oversight board.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 143.003, Local Government Code, is
1313 amended by amending Subdivision (1) and adding Subdivision (1-a) to
1414 read as follows:
1515 (1) "Civilian oversight board" means a board or office
1616 established by a municipality to practice oversight, monitoring, or
1717 investigations of fire fighters or police officers, or departments,
1818 by members of the public who are not fire fighters or police
1919 officers.
2020 (1-a) "Commission" means the Fire Fighters' and Police
2121 Officers' Civil Service Commission.
2222 SECTION 2. Subchapter F, Chapter 143, Local Government
2323 Code, is amended by adding Section 143.091 to read as follows:
2424 Sec. 143.091. ELIGIBILITY FOR CIVILIAN OVERSIGHT BOARD. A
2525 person is not eligible to serve on a civilian oversight board if the
2626 person has been:
2727 (1) convicted of or placed on deferred adjudication
2828 community supervision for a felony offense; or
2929 (2) convicted of a crime of moral turpitude.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2025.
