15- relating to the authority of the North Texas Groundwater
16- Conservation District to consider certain factors before granting
17- or denying a permit.

1811 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1912 SECTION 1. Subchapter C, Chapter 8856, Special District
20- Local Laws Code, is amended by adding Section 8856.1055 to read as
13+ Local Laws Code, is amended by adding Section 8856.108 to read as

22- Sec. 8856.1055. PERMIT CONSIDERATIONS; PONDS AND LAKES.
23- Before granting or denying a permit or a permit amendment issued in
24- accordance with Section 36.1146, Water Code, the district shall
25- consider whether the proposed use of water from the well is wholly
26- or partly to provide water to a pond or lake to enhance the
27- appearance of the landscape.
28- SECTION 2. Section 8856.1055, Special District Local Laws
29- Code, as added by this Act, applies only to an application for a
30- permit or permit amendment submitted on or after the effective date
31- of this Act.
32- SECTION 3. This Act takes effect immediately if it receives
33- a vote of two-thirds of all the members elected to each house, as
34- provided by Section 39, Article III, Texas Constitution. If this
35- Act does not receive the vote necessary for immediate effect, this
36- Act takes effect September 1, 2025.
