77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to certain testing requirements at certain wastewater
1010 treatment facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
1313 by adding Section 26.054 to read as follows:
1414 Sec. 26.054. URINARY METABOLITE TESTING FOR CERTAIN
1515 WASTEWATER TREATMENT FACILITIES. (a) The commission shall conduct
1616 quarterly testing for the urinary metabolites listed in Subsection
1717 (b) of all intakes and outflows of the wastewater treatment
1818 facilities described by Subsection (c). Tests conducted under this
1919 section must be performed by an accredited or certified
2020 environmental testing laboratory.
2121 (b) In accordance with Subsection (a), the commission shall
2222 conduct testing for the following urinary metabolites in the form
2323 of gluconates:
2424 (1) benzophenone;
2525 (2) bisphenol A;
2626 (3) estrone;
2727 (4) ethinyl estradiol;
2828 (5) musk ketone;
2929 (6) pregnanediol;
3030 (7) testosterone;
3131 (8) tonalide (AHTN);
3232 (9) mifepristone; and
3333 (10) any other organic substance required to be tested
3434 for by the commission.
3535 (c) The commission shall conduct the testing required by
3636 this section at:
3737 (1) each wastewater treatment facility located within
3838 10 miles of a municipality with a population of 250,000 or more; and
3939 (2) at least 10 wastewater treatment facilities
4040 located within 10 miles of a municipality:
4141 (A) with a population of 100,000 or more but less
4242 than 250,000;
4343 (B) with a population of 25,000 or more but less
4444 than 100,000; and
4545 (C) with a population of less than 25,000.
4646 (d) In selecting wastewater treatment facilities for
4747 testing under Subsection (c)(2), the commission shall prioritize
4848 facilities that reasonably represent typical wastewater systems of
4949 municipalities of the population categories in that subsection.
5050 (e) The commission shall maintain detailed records of all
5151 testing conducted under this section and publish the records on the
5252 commission's Internet website. The records must include:
5353 (1) the date on which each sample was collected;
5454 (2) the location from which each sample was collected;
5555 (3) the date on which each sample was tested for the
5656 presence of the urinary metabolites listed in Subsection (b); and
5757 (4) the results of the test for each urinary
5858 metabolite listed in Subsection (b) in parts per trillion.
5959 SECTION 2. This Act takes effect immediately if it receives
6060 a vote of two-thirds of all the members elected to each house, as
6161 provided by Section 39, Article III, Texas Constitution. If this
6262 Act does not receive the vote necessary for immediate effect, this
6363 Act takes effect September 1, 2025.
