11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 26, Water Code, is amended |
---|
13 | 13 | | by adding Section 26.054 to read as follows: |
---|
14 | 14 | | Sec. 26.054. URINARY METABOLITE TESTING FOR CERTAIN |
---|
15 | 15 | | WASTEWATER TREATMENT FACILITIES. (a) The commission shall conduct |
---|
16 | 16 | | quarterly testing for the urinary metabolites listed in Subsection |
---|
17 | 17 | | (b) of all intakes and outflows of the wastewater treatment |
---|
18 | 18 | | facilities described by Subsection (c). Tests conducted under this |
---|
19 | 19 | | section must be performed by an accredited or certified |
---|
20 | 20 | | environmental testing laboratory. |
---|
21 | 21 | | (b) In accordance with Subsection (a), the commission shall |
---|
22 | 22 | | conduct testing for the following urinary metabolites in the form |
---|
23 | 23 | | of gluconates: |
---|
24 | 24 | | (1) benzophenone; |
---|
25 | 25 | | (2) bisphenol A; |
---|
26 | 26 | | (3) estrone; |
---|
27 | 27 | | (4) ethinyl estradiol; |
---|
28 | 28 | | (5) musk ketone; |
---|
29 | 29 | | (6) pregnanediol; |
---|
30 | 30 | | (7) testosterone; |
---|
31 | 31 | | (8) tonalide (AHTN); |
---|
32 | 32 | | (9) mifepristone; and |
---|
33 | 33 | | (10) any other organic substance required to be tested |
---|
34 | 34 | | for by the commission. |
---|
35 | 35 | | (c) The commission shall conduct the testing required by |
---|
36 | 36 | | this section at: |
---|
37 | 37 | | (1) each wastewater treatment facility located within |
---|
38 | 38 | | 10 miles of a municipality with a population of 250,000 or more; and |
---|
39 | 39 | | (2) at least 10 wastewater treatment facilities |
---|
40 | 40 | | located within 10 miles of a municipality: |
---|
41 | 41 | | (A) with a population of 100,000 or more but less |
---|
42 | 42 | | than 250,000; |
---|
43 | 43 | | (B) with a population of 25,000 or more but less |
---|
44 | 44 | | than 100,000; and |
---|
45 | 45 | | (C) with a population of less than 25,000. |
---|
46 | 46 | | (d) In selecting wastewater treatment facilities for |
---|
47 | 47 | | testing under Subsection (c)(2), the commission shall prioritize |
---|
48 | 48 | | facilities that reasonably represent typical wastewater systems of |
---|
49 | 49 | | municipalities of the population categories in that subsection. |
---|
50 | 50 | | (e) The commission shall maintain detailed records of all |
---|
51 | 51 | | testing conducted under this section and publish the records on the |
---|
52 | 52 | | commission's Internet website. The records must include: |
---|
53 | 53 | | (1) the date on which each sample was collected; |
---|
54 | 54 | | (2) the location from which each sample was collected; |
---|
55 | 55 | | (3) the date on which each sample was tested for the |
---|
56 | 56 | | presence of the urinary metabolites listed in Subsection (b); and |
---|
57 | 57 | | (4) the results of the test for each urinary |
---|
58 | 58 | | metabolite listed in Subsection (b) in parts per trillion. |
---|
59 | 59 | | SECTION 2. This Act takes effect immediately if it receives |
---|
60 | 60 | | a vote of two-thirds of all the members elected to each house, as |
---|
61 | 61 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
62 | 62 | | Act does not receive the vote necessary for immediate effect, this |
---|
63 | 63 | | Act takes effect September 1, 2025. |
