77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to additional requirements for individualized education
1010 programs developed for children with autism or other pervasive
1111 developmental disorders.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 29.005, Education Code, is amended by
1414 adding Subsection (e-2) to read as follows:
1515 (e-2) For a child with autism or another pervasive
1616 developmental disorder, the committee must consider for inclusion
1717 in the child's individualized education program each strategy
1818 identified under commissioner rule as appropriate for autism or
1919 another pervasive developmental disorder and that is based on
2020 peer-reviewed, research-based educational programming practices.
2121 The committee shall determine whether each strategy considered is
2222 appropriate and practicable to include in the child's
2323 individualized education program. If the committee determines that
2424 a strategy is not appropriate or practicable to include in the
2525 child's individualized education program, the committee must
2626 include a written statement to that effect and the basis for that
2727 determination in the documentation for the child's individualized
2828 education program.
2929 SECTION 2. Subchapter A, Chapter 29, Education Code, is
3030 amended by adding Section 29.0052 to read as follows:
3131 Sec. 29.0052. ADDITIONAL PROGRAM REQUIREMENTS FOR STUDENTS
3232 WITH AUTISM OR ANOTHER PERVASIVE DEVELOPMENTAL DISORDER. (a) Not
3333 later than seven days before each meeting of an admission, review,
3434 and dismissal committee for a child with autism or another
3535 pervasive developmental disorder, a school district shall provide
3636 to the parent of the child written information regarding each
3737 strategy identified under commissioner rule as appropriate for
3838 autism or another pervasive developmental disorder and that is
3939 based on peer-reviewed, research-based educational programming
4040 practices.
4141 (b) At each meeting of an admission, review, and dismissal
4242 committee for a child with autism or another pervasive
4343 developmental disorder, the committee must consider each strategy
4444 described by Subsection (a) and determine whether the strategy is
4545 appropriate and practicable to include in the child's
4646 individualized education program. If the committee determines that
4747 a strategy is not appropriate or practicable to include in the
4848 child's program, the committee must include a written statement to
4949 that effect and the basis for that determination in the
5050 documentation for the child's individualized education program.
5151 (c) If the child's parent is unable to speak English, a
5252 school district shall:
5353 (1) provide the parent with a written or audiotaped
5454 copy of the written information required under Subsection (a)
5555 translated into Spanish if Spanish is the parent's native language;
5656 or
5757 (2) if the parent's native language is a language other
5858 than Spanish, make a good faith effort to provide the parent with
5959 the written information required under Subsection (a) translated
6060 into the parent's native language.
6161 SECTION 3. This Act applies beginning with the 2025-2026
6262 school year.
6363 SECTION 4. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2025.
