77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the compensation and benefits for certain peace
1010 officers commissioned by the state fire marshal.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 417.006, Government Code, is amended to
1313 read as follows:
1414 Sec. 417.006. STATE FIRE MARSHAL PEACE OFFICERS [AND ARSON
1515 INVESTIGATORS]. (a) The state fire marshal may:
1616 (1) commission peace officers to act as fire and arson
1717 investigators under the state fire marshal's [his] supervision and
1818 to perform other law enforcement duties assigned to the
1919 commissioner and the state fire marshal by law; and
2020 (2) [. The state fire marshal may] revoke a peace
2121 officer's commission under this section for just cause.
2222 (b) The commissioner shall ensure that a peace officer
2323 commissioned under Subsection (a) is compensated according to
2424 Schedule C of the position classification salary schedule
2525 prescribed by the General Appropriations Act.
2626 SECTION 2. Section 659.301(5), Government Code, is amended
2727 to read as follows:
2828 (5) "State employee" means an individual who:
2929 (A) is a commissioned law enforcement officer of
3030 the Department of Public Safety, the Texas Facilities Commission,
3131 the Texas Alcoholic Beverage Commission, the Texas Department of
3232 Criminal Justice, the attorney general, [or] the insurance fraud
3333 unit of the Texas Department of Insurance, or the state fire
3434 marshal;
3535 (B) is a commissioned security officer of the
3636 comptroller;
3737 (C) is a law enforcement officer commissioned by
3838 the Parks and Wildlife Commission;
3939 (D) is a commissioned peace officer of an
4040 institution of higher education;
4141 (E) is an employee or official of the Board of
4242 Pardons and Paroles or the parole division of the Texas Department
4343 of Criminal Justice if the employee or official has routine direct
4444 contact with inmates of any penal or correctional institution or
4545 with administratively released prisoners subject to the board's
4646 jurisdiction;
4747 (F) has been certified to the Employees
4848 Retirement System of Texas under Section 815.505 as having begun
4949 employment as a law enforcement officer or custodial officer,
5050 unless the individual has been certified to the system as having
5151 ceased employment as a law enforcement officer or custodial
5252 officer;
5353 (G) before May 29, 1987, received hazardous duty
5454 pay based on the terms of any state law if the individual holds a
5555 position designated under that law as eligible for the pay; or
5656 (H) is a security officer employed by the Texas
5757 Military Department.
5858 SECTION 3. Section 661.918(a), Government Code, is amended
5959 to read as follows:
6060 (a) This section applies to a peace officer under Article
6161 2A.001, Code of Criminal Procedure, who is commissioned as a law
6262 enforcement officer or agent, including a ranger, by:
6363 (1) the Public Safety Commission and the director of
6464 the Department of Public Safety;
6565 (2) the Parks and Wildlife Commission;
6666 (3) the Texas Alcoholic Beverage Commission;
6767 (4) the attorney general;
6868 (5) the insurance fraud unit of the Texas Department
6969 of Insurance; [or]
7070 (6) the comptroller; or
7171 (7) the state fire marshal.
7272 SECTION 4. (a) The classification officer in the office of
7373 the state auditor shall classify the position of commissioned peace
7474 officer employed as an investigator by the Texas Department of
7575 Insurance State Fire Marshal's Office as a Schedule C position
7676 under the position classification plan maintained under Chapter
7777 654, Government Code.
7878 (b) The change made by the classification officer as
7979 required by this section applies beginning with the state fiscal
8080 biennium beginning September 1, 2025.
8181 (c) This section expires September 1, 2027.
8282 SECTION 5. Section 661.918(a), Government Code, as amended
8383 by this Act, applies only to an injury that occurs on or after the
8484 effective date of this Act.
8585 SECTION 6. This Act takes effect September 1, 2025.
