88 AN ACT
99 relating to the use of proceeds deposited to the horse industry
1010 account for law enforcement purposes.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2028.202(b), Occupations Code, is
1313 amended to read as follows:
1414 (b) From the total amount deducted under Subsection (a), a
1515 greyhound racetrack association that receives an interstate
1616 cross-species simulcast signal shall distribute the following
1717 amounts from each pari-mutuel pool wagered on the signal at the
1818 racetrack:
1919 (1) a fee of 1.5 percent to be paid to the racetrack in
2020 this state sending the signal;
2121 (2) a purse in the amount of 0.75 percent to be paid to
2222 the official state horse breed registry for Thoroughbred horses for
2323 use as purses at racetracks in this state;
2424 (3) a purse in the amount of 0.75 percent to be paid to
2525 the official state horse breed registry for quarter horses for use
2626 as purses at racetracks in this state; and
2727 (4) an amount equal to [a purse of] 4.5 percent of the
2828 pool to be deposited [escrowed] with the commission in the manner
2929 provided by Section 2028.204.
3030 SECTION 2. Sections 2028.203 and 2028.204, Occupations
3131 Code, are amended to read as follows:
3232 Sec. 2028.203. REIMBURSEMENT FOR SIMULCAST SIGNAL COST. If
3333 a racetrack association purchases an interstate simulcast signal
3434 and the signal cost exceeds five percent of the pari-mutuel pool,
3535 the commission, from the amount set aside [escrowed account] under
3636 Section 2028.202(b)(4), shall reimburse the racetrack association
3737 an amount equal to one-half of the signal cost that exceeds five
3838 percent of the pari-mutuel pool.
3939 Sec. 2028.204. USE [ALLOCATION] OF MONEY IN HORSE INDUSTRY
4040 ACCOUNT [ESCROW ACCOUNTS]. (a) A greyhound racetrack association
4141 shall deposit into an [escrow] account in the commission's registry
4242 the amount [purse] set aside under Section 2028.202(b)(4).
4343 (b) The commission shall use [Any horse racetrack
4444 association in this state may apply to the commission for receipt
4545 of] money in the horse industry [escrow] account only for law
4646 enforcement purposes [use as purses]. [Any state horse breed
4747 registry listed in Section 2030.002(a) may apply for receipt of
4848 money in the account for any event that furthers the horse industry.
4949 The commission:
5050 [(1) shall determine the horse racetrack associations
5151 and state horse breed registries to be allocated money from the
5252 account and the percentages to be allocated, taking into
5353 consideration purse levels, racing opportunities, and the
5454 financial status of the requesting racetrack association or
5555 requesting breed registry; and
5656 [(2) may not annually allocate more than 70 percent of
5757 the amount deposited into the account to horse racetrack
5858 associations for use as purses.]
5959 SECTION 3. Section 2028.2041, Occupations Code, is amended
6060 to read as follows:
6161 Sec. 2028.2041. ALLOCATION OF CERTAIN FUNDS. (a) In each
6262 state fiscal biennium, the comptroller shall deposit the amounts
6363 allocated under Section 151.801(c-3), Tax Code, into the [escrow]
6464 account established under Section 2028.204(b), until the
6565 comptroller determines the amount deposited into the account in
6666 that fiscal biennium equals the greater of:
6767 (1) the amount appropriated to the commission for the
6868 purposes of Section 2028.204 for that fiscal biennium; or
6969 (2) $50 million.
7070 (b) Once the comptroller determines the greater of the
7171 amount described by Subsection (a)(1) or (2) has been deposited
7272 during a state fiscal biennium into the [escrow] account
7373 established under Section 2028.204(b), for the remainder of that
7474 fiscal biennium the comptroller shall deposit the amounts allocated
7575 under Section 151.801(c-3), Tax Code, into the general revenue
7676 fund.
7777 (c) The balance of the [escrow] account established under
7878 Section 2028.204(b) shall not exceed $50 million.
7979 SECTION 4. Section 2031.004(e), Occupations Code, is
8080 amended to read as follows:
8181 (e) The commission may not:
8282 (1) use funds from the accredited Texas-bred program
8383 under Subchapter A, Chapter 2030, or the horse industry [escrowed
8484 purse] account under Section 2028.204 to fund the Texas Derby
8585 escrow purse fund; or
8686 (2) order a state horse breed registry to fund a purse
8787 for a Texas Derby, make contributions to the Texas Derby escrow
8888 purse fund, or pay the expenses of a Texas Derby race.
8989 SECTION 5. Section 151.801(c-3), Tax Code, is amended to
9090 read as follows:
9191 (c-3) Subject to the limitation imposed under Section
9292 2028.2041, Occupations Code, an amount equal to the proceeds from
9393 the collection of the taxes imposed by this chapter on the sale,
9494 storage, or use of horse feed, horse supplements, horse tack, horse
9595 bedding and grooming supplies, and other taxable expenditures
9696 directly related to horse ownership, riding, or boarding shall be
9797 deposited to the credit of the [escrow] account administered by the
9898 Texas Racing Commission and established under Section 2028.204,
9999 Occupations Code.
100100 SECTION 6. Section 2028.205, Occupations Code, is repealed.
101101 SECTION 7. This Act takes effect immediately if it receives
102102 a vote of two-thirds of all the members elected to each house, as
103103 provided by Section 39, Article III, Texas Constitution. If this
104104 Act does not receive the vote necessary for immediate effect, this
105105 Act takes effect September 1, 2025.
