66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the conduct of the state lottery; creating a criminal
99 offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 466.002, Government Code, is amended by
1212 adding Subdivision (8-a) to read as follows:
1313 (8-a) ""Playslip" means an optically readable paper
1414 card issued by the Texas Lottery used by players of draw games to
1515 select Plays and to elect all features. There shall be five
1616 playboards on each playslip. A playslip has no pecuniary value and
1717 shall not constitute evidence of ticket purchase or of numbers
1818 selected.
1919 SECTION 2. Subchapter F, Chapter 466, Government Code, is
2020 amended by adding Sections 466.257, 466.258, 466.259, 466.260, and
2121 466.261 to read as follows:
2222 Sec. 466.257. LIMITATION ON PROVISION OF CERTAIN LOTTERY
2323 EQUIPMENT. The commission may not provide to a licensed location of
2424 a sales agent more than two of the following:
2525 (1) lottery vending machines;
2626 (2) lottery computer terminals; or
2727 (3) other lottery equipment that prints tickets.
2828 Sec. 466.258. FORMS REQUIRED FOR CERTAIN PURCHASES. (a)
2929 For each purchase by a single purchaser of tickets in an amount of
3030 at least $10,000, the sales agent or an employee of the sales agent
3131 shall complete and file:
3232 (1) with the Internal Revenue Service, IRS Form 8300,
3333 Report of Cash Payments Over $10,000 Received in Trade or Business;
3434 and
3535 (2) with the comptroller, the form prescribed by the
3636 comptroller under Subsection (b).
3737 (b) The comptroller by rule shall prescribe a form that
3838 requires the sales agent or an employee of the sales agent to
3939 provide on the form all of the information required by the Internal
4040 Revenue Service in IRS Form 8300, Report of Cash Payments Over
4141 $10,000 Received in Trade or Business.
4242 Sec. 466.259. PLAY SLIPS. The commission by rule shall:
4343 (1) require a purchaser to provide to the sales agent
4444 or employee of the sales agent a play slip in a printed format at the
4545 time the ticket is purchased; and
4646 (2) prohibit the provision of play slips in an
4747 electronic format.
4848 Sec. 466.260. PROHIBITED SCANNING DEVICES. The commission
4949 by rule shall prohibit a sales agent or an employee of a sales agent
5050 from using a device that scans play slips faster than an individual
5151 is capable of scanning play slips by hand.
5252 Sec. 466.261. PROHIBITED USE OF LOTTERY LOGO. (a) In this
5353 section, "courier" means a person who for compensation arranges
5454 through an Internet application or mobile Internet application the
5555 purchase of a ticket on a player's behalf.
5656 (b) A courier may not use the commission's name or logo on
5757 any Internet application or mobile Internet application operated by
5858 the courier.
5959 (c) The attorney general may bring an action for injunctive
6060 relief to restrain or remedy a violation of this section.
6161 SECTION 3. Subchapter G, Chapter 466, Government Code, is
6262 amended by adding Section 466.3111 to read as follows:
6363 Sec. 466.3111. FORM REQUIRED FOR CERTAIN PURCHASES;
6464 CRIMINAL OFFENSE. (a) A sales agent or an employee of a sales agent
6565 commits an offense if the person intentionally or knowingly fails
6666 to complete and file a form as required by Section 466.258.
6767 (b) An offense under this section is a state jail felony.
6868 SECTION 4. As soon as practicable after the effective date
6969 of this Act, the comptroller of public accounts by rule shall
7070 prescribe the form required by Section 466.258(b), Government Code,
7171 as added by this Act.
7272 SECTION 5. As soon as practicable after the effective date
7373 of this Act, the Texas Lottery Commission shall adopt rules as
7474 necessary to implement Sections 466.259 and 466.260, Government
7575 Code, as added by this Act.
7676 SECTION 6. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2025.
