| 8 | 8 | | relating to the conduct of the state lottery; creating a criminal |
|---|
| 9 | 9 | | offense. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 466.002, Government Code, is amended by |
|---|
| 12 | 12 | | adding Subdivision (8-a) to read as follows: |
|---|
| 13 | 13 | | (8-a) ""Playslip" means an optically readable paper |
|---|
| 14 | 14 | | card issued by the Texas Lottery used by players of draw games to |
|---|
| 15 | 15 | | select Plays and to elect all features. There shall be five |
|---|
| 16 | 16 | | playboards on each playslip. A playslip has no pecuniary value and |
|---|
| 17 | 17 | | shall not constitute evidence of ticket purchase or of numbers |
|---|
| 18 | 18 | | selected. |
|---|
| 19 | 19 | | SECTION 2. Subchapter F, Chapter 466, Government Code, is |
|---|
| 20 | 20 | | amended by adding Sections 466.257, 466.258, 466.259, 466.260, and |
|---|
| 21 | 21 | | 466.261 to read as follows: |
|---|
| 22 | 22 | | Sec. 466.257. LIMITATION ON PROVISION OF CERTAIN LOTTERY |
|---|
| 23 | 23 | | EQUIPMENT. The commission may not provide to a licensed location of |
|---|
| 24 | 24 | | a sales agent more than two of the following: |
|---|
| 25 | 25 | | (1) lottery vending machines; |
|---|
| 26 | 26 | | (2) lottery computer terminals; or |
|---|
| 27 | 27 | | (3) other lottery equipment that prints tickets. |
|---|
| 28 | 28 | | Sec. 466.258. FORMS REQUIRED FOR CERTAIN PURCHASES. (a) |
|---|
| 29 | 29 | | For each purchase by a single purchaser of tickets in an amount of |
|---|
| 30 | 30 | | at least $10,000, the sales agent or an employee of the sales agent |
|---|
| 31 | 31 | | shall complete and file: |
|---|
| 32 | 32 | | (1) with the Internal Revenue Service, IRS Form 8300, |
|---|
| 33 | 33 | | Report of Cash Payments Over $10,000 Received in Trade or Business; |
|---|
| 34 | 34 | | and |
|---|
| 35 | 35 | | (2) with the comptroller, the form prescribed by the |
|---|
| 36 | 36 | | comptroller under Subsection (b). |
|---|
| 37 | 37 | | (b) The comptroller by rule shall prescribe a form that |
|---|
| 38 | 38 | | requires the sales agent or an employee of the sales agent to |
|---|
| 39 | 39 | | provide on the form all of the information required by the Internal |
|---|
| 40 | 40 | | Revenue Service in IRS Form 8300, Report of Cash Payments Over |
|---|
| 41 | 41 | | $10,000 Received in Trade or Business. |
|---|
| 42 | 42 | | Sec. 466.259. PLAY SLIPS. The commission by rule shall: |
|---|
| 43 | 43 | | (1) require a purchaser to provide to the sales agent |
|---|
| 44 | 44 | | or employee of the sales agent a play slip in a printed format at the |
|---|
| 45 | 45 | | time the ticket is purchased; and |
|---|
| 46 | 46 | | (2) prohibit the provision of play slips in an |
|---|
| 47 | 47 | | electronic format. |
|---|
| 48 | 48 | | Sec. 466.260. PROHIBITED SCANNING DEVICES. The commission |
|---|
| 49 | 49 | | by rule shall prohibit a sales agent or an employee of a sales agent |
|---|
| 50 | 50 | | from using a device that scans play slips faster than an individual |
|---|
| 51 | 51 | | is capable of scanning play slips by hand. |
|---|
| 52 | 52 | | Sec. 466.261. PROHIBITED USE OF LOTTERY LOGO. (a) In this |
|---|
| 53 | 53 | | section, "courier" means a person who for compensation arranges |
|---|
| 54 | 54 | | through an Internet application or mobile Internet application the |
|---|
| 55 | 55 | | purchase of a ticket on a player's behalf. |
|---|
| 56 | 56 | | (b) A courier may not use the commission's name or logo on |
|---|
| 57 | 57 | | any Internet application or mobile Internet application operated by |
|---|
| 58 | 58 | | the courier. |
|---|
| 59 | 59 | | (c) The attorney general may bring an action for injunctive |
|---|
| 60 | 60 | | relief to restrain or remedy a violation of this section. |
|---|
| 61 | 61 | | SECTION 3. Subchapter G, Chapter 466, Government Code, is |
|---|
| 62 | 62 | | amended by adding Section 466.3111 to read as follows: |
|---|
| 63 | 63 | | Sec. 466.3111. FORM REQUIRED FOR CERTAIN PURCHASES; |
|---|
| 64 | 64 | | CRIMINAL OFFENSE. (a) A sales agent or an employee of a sales agent |
|---|
| 65 | 65 | | commits an offense if the person intentionally or knowingly fails |
|---|
| 66 | 66 | | to complete and file a form as required by Section 466.258. |
|---|
| 67 | 67 | | (b) An offense under this section is a state jail felony. |
|---|
| 68 | 68 | | SECTION 4. As soon as practicable after the effective date |
|---|
| 69 | 69 | | of this Act, the comptroller of public accounts by rule shall |
|---|
| 70 | 70 | | prescribe the form required by Section 466.258(b), Government Code, |
|---|
| 71 | 71 | | as added by this Act. |
|---|
| 72 | 72 | | SECTION 5. As soon as practicable after the effective date |
|---|
| 73 | 73 | | of this Act, the Texas Lottery Commission shall adopt rules as |
|---|
| 74 | 74 | | necessary to implement Sections 466.259 and 466.260, Government |
|---|
| 75 | 75 | | Code, as added by this Act. |
|---|
| 76 | 76 | | SECTION 6. This Act takes effect immediately if it receives |
|---|
| 77 | 77 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 78 | 78 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 79 | 79 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 80 | 80 | | Act takes effect September 1, 2025. |
