| 9 | 9 | | relating to the relocation or adjustment of certain facilities for |

| 10 | 10 | | certain municipal projects. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 54.203(c), Utilities Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (c) The governing body of a municipality may require a |
|---|
| 15 | 15 | | certificated telecommunications utility to relocate the utility's |
|---|
| 16 | 16 | | facility in a municipal public right-of-way at the municipality's |
|---|
| 17 | 17 | | [utility's] expense from their collected right-of-way fees as |
|---|
| 18 | 18 | | described by Section 283.051, Local Government Code, to permit the |
|---|
| 19 | 19 | | widening or straightening of a street by: |
|---|
| 20 | 20 | | (1) giving the utility notice at least 30 days before |
|---|
| 21 | 21 | | the date relocation is required [30 days' notice]; and |
|---|
| 22 | 22 | | (2) specifying the new location for the facility along |
|---|
| 23 | 23 | | the right-of-way of the street. |

| 24 | 24 | | SECTION 2. Section 66.011, Utilities Code, is amended by |
|---|
| 25 | 25 | | adding Subsection (d-1) to read as follows: |
|---|
| 26 | 26 | | (d-1) A municipality may require a holder of a state-issued |
|---|
| 27 | 27 | | certificate of franchise authority to relocate the holder's |
|---|
| 28 | 28 | | facility in a municipal public right-of-way at the municipality's |
|---|
| 29 | 29 | | expense to permit the widening or straightening of a street or to |
|---|
| 30 | 30 | | accommodate another municipal project by: |
|---|
| 31 | 31 | | (1) giving the holder notice at least 30 days before |
|---|
| 32 | 32 | | the date relocation is required; and |
|---|
| 33 | 33 | | (2) specifying the new location for the facility along |
|---|
| 34 | 34 | | the right-of-way. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2025. |
