77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the liability of a funeral service provider for mental
1010 anguish damages.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1313 amended by adding Chapter 77A to read as follows:
1414 CHAPTER 77A. FUNERAL SERVICE PROVIDERS
1515 Sec. 77A.001. DEFINITIONS. In this chapter:
1616 (1) "Body or remains" means a human corpse or the body
1717 parts of a human corpse.
1818 (2) "Claimant" means a person described by Section
1919 77A.002(a) who brings an action described by that section.
2020 (3) "Funeral service" means a service performed by a
2121 funeral service provider related to the care, preparation, and
2222 disposition of a body or remains, including:
2323 (A) retrieving, loading, and transporting the
2424 body or remains;
2525 (B) storing, embalming, dressing, casketing,
2626 interring, or cremating the body or remains;
2727 (C) arranging, supervising, and conducting a
2828 funeral ceremony; and
2929 (D) arranging, supervising, and implementing the
3030 final disposition of the body or remains.
3131 (4) "Funeral service provider" means a person engaged
3232 in the business of providing funeral services. The term includes an
3333 employee or contractor of the person engaged in the business of
3434 providing funeral services, including an employee or contractor
3535 used in the provision of a funeral service and who is:
3636 (A) an embalmer;
3737 (B) a crematory operator;
3838 (C) a funeral director;
3939 (D) a provisional license holder; or
4040 (E) a transporter.
4141 Sec. 77A.002. APPLICABILITY; EXCLUSIVE REMEDY. (a) This
4242 chapter applies only to an action:
4343 (1) brought by a person who has a special relationship
4444 with a funeral service provider due to a claimant's right of
4545 sepulcher, a right to possess a body or remains, a right to control
4646 the disposition of a body or remains under Section 711.002(a),
4747 Health and Safety Code, or another related right; and
4848 (2) in which the person seeks to recover mental
4949 anguish damages from a funeral service provider based on that
5050 special relationship.
5151 (b) A claimant may not pursue an action governed by this
5252 chapter under any other law to obtain mental anguish damages from a
5353 funeral service provider.
5454 Sec. 77A.003. LIMITED LIABILITY FOR MENTAL ANGUISH DAMAGES.
5555 (a) Except as provided by Subsection (b), a funeral service
5656 provider is not liable to a claimant for mental anguish damages
5757 unless the claimant proves:
5858 (1) the funeral service provider mishandled a body or
5959 remains;
6060 (2) if the funeral service provider had acted in a
6161 manner consistent with the common practice of reasonably prudent
6262 funeral service providers, the mishandling of the body or remains
6363 would not have occurred;
6464 (3) as a result of the mishandling of the body or
6565 remains and the close personal relationship between the claimant
6666 and the decedent, the claimant experienced grievous or debilitating
6767 angst, distress, torment, emotional suffering, or turmoil that
6868 caused a substantial disruption in the claimant's daily routine;
6969 and
7070 (4) a reasonable person in the position of the funeral
7171 service provider would have foreseen that the mishandling of the
7272 body or remains would cause significant emotional harm to the
7373 claimant.
7474 (b) Except as provided by Subsection (c), mental anguish
7575 damages that may be recovered from a funeral service provider by a
7676 claimant in an action governed by this chapter are limited to the
7777 lesser of:
7878 (1) three times the amount paid to the funeral service
7979 provider for funeral services for the decedent; or
8080 (2) $50,000.
8181 (c) A claimant may not recover mental anguish damages from a
8282 funeral service provider in an action governed by this chapter if
8383 the claimant seeks relief from the funeral service provider under
8484 Subchapter E, Chapter 17, Business & Commerce Code.
8585 Sec. 77A.004. JURY INSTRUCTIONS. In a trial to a jury for
8686 an action governed by this chapter, the court shall provide the jury
8787 a definition for mental anguish that conforms to Section
8888 77A.003(a)(3) and instruct the jury regarding the requirements of
8989 this chapter.
9090 Sec. 77A.005. CONSTRUCTION OF CHAPTER. This chapter does
9191 not:
9292 (1) create a cause of action in favor of, or confer
9393 standing to bring an action against a funeral service provider on,
9494 any person; or
9595 (2) limit a claimant's recovery of other forms of
9696 economic or exemplary damages or apply to other actions, including
9797 actions to recover damages for death or physical injury caused to
9898 the claimant by negligence of a funeral service provider.
9999 SECTION 2. Chapter 77A, Civil Practice and Remedies Code,
100100 as added by this Act, is an exercise of authority under Section
101101 66(c), Article III, Texas Constitution, and takes effect only if
102102 this Act receives a vote of three-fifths of all the members elected
103103 to each house, as provided by Subsection (e) of that section.
104104 SECTION 3. Chapter 77A, Civil Practice and Remedies Code,
105105 as added by this Act, applies only to an action commenced on or
106106 after the effective date of this Act. An action commenced before
107107 the effective date of this Act is governed by the law applicable to
108108 the action immediately before the effective date of this Act, and
109109 that law is continued in effect for that purpose.
110110 SECTION 4. This Act takes effect immediately if it receives
111111 a vote of two-thirds of all the members elected to each house, as
112112 provided by Section 39, Article III, Texas Constitution. If this
113113 Act does not receive the vote necessary for immediate effect, this
114114 Act takes effect September 1, 2025.
