88 AN ACT
99 relating to the criminal and licensing consequences of certain
1010 offenses relating to the possession of marihuana, certain
1111 tetrahydrocannabinols, certain synthetic cannabinoids, and drug
1212 paraphernalia; imposing a fee.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Article 14.06, Code of Criminal Procedure, is
1515 amended by adding Subsections (b-1) and (b-2) and amending
1616 Subsection (d) to read as follows:
1717 (b-1) A peace officer who is charging a person with
1818 committing an offense under Section 481.1161(b)(1), 481.121(b)(1),
1919 or 481.125(a), Health and Safety Code, may not arrest the person and
2020 shall issue the person a citation as provided by Subsection (b).
2121 (b-2) Subsection (b-1) does not apply to an officer making
2222 an arrest for an offense other than an offense under Section
2323 481.1161(b)(1), 481.121(b)(1), or 481.125(a), Health and Safety
2424 Code.
2525 (d) Subsection (c) applies only to a person charged with
2626 committing an offense under:
2727 (1) Section 481.121, Health and Safety Code, if the
2828 offense is punishable under Subsection (b)(1-a) [(b)(1)] or (2) of
2929 that section;
3030 (1-a) Section 481.1161, Health and Safety Code, if the
3131 offense is punishable under Subsection (b)(1-a) [(b)(1)] or (2) of
3232 that section;
3333 (2) Section 28.03, Penal Code, if the offense is
3434 punishable under Subsection (b)(2) of that section;
3535 (3) Section 28.08, Penal Code, if the offense is
3636 punishable under Subsection (b)(2) or (3) of that section;
3737 (4) Section 31.03, Penal Code, if the offense is
3838 punishable under Subsection (e)(2)(A) of that section;
3939 (5) Section 31.04, Penal Code, if the offense is
4040 punishable under Subsection (e)(2) of that section;
4141 (5-a) Section 37.10, Penal Code, if the offense is for
4242 tampering with a temporary tag issued under Chapter 502 or 503,
4343 Transportation Code;
4444 (6) Section 38.114, Penal Code, if the offense is
4545 punishable as a Class B misdemeanor; or
4646 (7) Section 521.457, Transportation Code.
4747 SECTION 2. Article 45A.302, Code of Criminal Procedure, is
4848 amended by adding Subsection (a-1) to read as follows:
4949 (a-1) Unless the defendant has previously received a
5050 deferral of disposition for an offense under Section
5151 481.1161(b)(1), 481.121(b)(1), or 481.125(a), Health and Safety
5252 Code, committed within the 12-month period preceding the date of
5353 the commission of the instant offense, on plea of guilty or nolo
5454 contendere for either offense, the judge shall defer further
5555 proceedings without entering an adjudication of guilt and place the
5656 defendant on deferred disposition under the provisions of this
5757 article.
5858 SECTION 3. Article 45A.305, Code of Criminal Procedure, is
5959 amended by adding Subsection (a-1) to read as follows:
6060 (a-1) A court that dismisses a complaint under Subsection
6161 (a) for a person charged with an offense under Section
6262 481.1161(b)(1), 481.121(b)(1), or 481.125(a), Health and Safety
6363 Code, shall notify the defendant in writing of the person's
6464 expunction rights under Article 45A.501 and provide the person with
6565 a copy of that article.
6666 SECTION 4. Chapter 45A, Code of Criminal Procedure, is
6767 amended by adding Subchapter K to read as follows:
6868 SUBCHAPTER K. EXPUNCTIONS
6969 Art. 45A.501. EXPUNCTION OF CERTAIN RECORDS. (a) This
7070 article applies only to a person charged with an offense under
7171 Section 481.1161(b)(1), 481.121(b)(1), or 481.125(a), Health and
7272 Safety Code.
7373 (b) Records of a person relating to a complaint may be
7474 expunged under this article if:
7575 (1) the complaint was dismissed under Article 45A.305
7676 or 45A.401 or other law and:
7777 (A) at least 180 days have elapsed from the date
7878 of the dismissal; or
7979 (B) at least one year has elapsed from the date of
8080 the citation; or
8181 (2) the person was acquitted of the offense.
8282 (c) The person must make a written request to have the
8383 records expunged. The request must be under oath.
8484 (d) The court shall order all complaints, verdicts,
8585 sentences, and prosecutorial and law enforcement records and any
8686 other documents relating to the offense expunged from the person's
8787 record if the court finds that the person satisfies the
8888 requirements of this article.
8989 (e) The justice or municipal court shall require a person
9090 who requests expungement under this article to pay a fee in the
9191 amount of $30 to defray the cost of notifying state agencies of
9292 orders of expungement under this article.
9393 (f) The procedures for expunction provided under this
9494 article are separate and distinct from the expunction procedures
9595 under Chapter 55A.
9696 SECTION 5. Section 411.0728(a), Government Code, is amended
9797 to read as follows:
9898 (a) This section applies only to a person:
9999 (1) who is convicted of or placed on deferred
100100 adjudication community supervision for an offense under:
101101 (A) Section 481.1161, Health and Safety Code, if
102102 the offense is punishable under Subsection (b)(1-a);
103103 (B) Section 481.120, Health and Safety Code, if
104104 the offense is punishable under Subsection (b)(1);
105105 (C) [(B)] Section 481.121, Health and Safety
106106 Code, if the offense is punishable under Subsection (b)(1-a)
107107 [(b)(1)];
108108 (D) [(C)] Section 31.03, Penal Code, if the
109109 offense is punishable under Subsection (e)(1) or (2); or
110110 (E) [(D)] Section 43.02, Penal Code; and
111111 (2) who, if requested by the applicable law
112112 enforcement agency or prosecuting attorney to provide assistance in
113113 the investigation or prosecution of an offense under Section
114114 20A.02, 20A.03, or 43.05, Penal Code, or a federal offense
115115 containing elements that are substantially similar to the elements
116116 of an offense under any of those sections:
117117 (A) provided assistance in the investigation or
118118 prosecution of the offense; or
119119 (B) did not provide assistance in the
120120 investigation or prosecution of the offense due to the person's age
121121 or a physical or mental disability resulting from being a victim of
122122 an offense described by this subdivision.
123123 SECTION 6. Sections 481.002(5) and (6), Health and Safety
124124 Code, are amended to read as follows:
125125 (5) "Controlled substance" means a substance,
126126 including a drug, an adulterant, and a dilutant, listed in
127127 Schedules I through V or Penalty Group 1, 1-A, 1-B, 2, 2-A, 2-B, 3,
128128 or 4. The term includes the aggregate weight of any mixture,
129129 solution, or other substance containing a controlled substance.
130130 The term does not include hemp, as defined by Section 121.001,
131131 Agriculture Code, or the tetrahydrocannabinols in hemp.
132132 (6) "Controlled substance analogue" means:
133133 (A) a substance with a chemical structure
134134 substantially similar to the chemical structure of a controlled
135135 substance in Schedule I or II or Penalty Group 1, 1-A, 1-B, 2, [or]
136136 2-A, or 2-B; or
137137 (B) a substance specifically designed to produce
138138 an effect substantially similar to, or greater than, the effect of a
139139 controlled substance in Schedule I or II or Penalty Group 1, 1-A,
140140 1-B, 2, [or] 2-A, or 2-B.
141141 SECTION 7. Section 481.103(a), Health and Safety Code, is
142142 amended to read as follows:
143143 (a) Penalty Group 2 consists of:
144144 (1) any quantity of the following hallucinogenic
145145 substances, their salts, isomers, and salts of isomers, unless
146146 specifically excepted, if the existence of these salts, isomers,
147147 and salts of isomers is possible within the specific chemical
148148 designation:
149149 5-(2-aminopropyl)benzofuran (5-APB);
150150 6-(2-aminopropyl)benzofuran (6-APB);
151151 5-(2-aminopropyl)-2,3-dihydrobenzofuran
152152 (5-APDB);

400400 SECTION 8. Subchapter D, Chapter 481, Health and Safety
401401 Code, is amended by adding Section 481.1032 to read as follows:
402402 Sec. 481.1032. PENALTY GROUP 2-B. (a) Penalty Group 2-B
403403 consists of any quantity of the following substances, their salts,
404404 isomers, and salts of isomers, unless specifically excepted, if the
405405 existence of these salts, isomers, and salts of isomers is possible
406406 within the specific chemical designation:
407407 Tetrahydrocannabinols, other than marihuana, and
408408 synthetic equivalents of the substances contained in the plant, or
409409 in the resinous extractives of Cannabis, or synthetic substances,
410410 derivatives, and their isomers with similar chemical structure and
411411 pharmacological activity such as:
412412 delta-1 cis or trans tetrahydrocannabinol, and
413413 their optical isomers;
414414 delta-6 cis or trans tetrahydrocannabinol, and
415415 their optical isomers;
416416 delta-3, 4 cis or trans tetrahydrocannabinol, and
417417 their optical isomers; or
418418 compounds of these structures, regardless of
419419 numerical designation of atomic positions, since nomenclature of
420420 these substances is not internationally standardized.
421421 (b) For the purposes of this section, the term "isomer"
422422 includes an optical, position, or geometric isomer.
423423 SECTION 9. Section 481.106, Health and Safety Code, is
424424 amended to read as follows:
425425 Sec. 481.106. CLASSIFICATION OF CONTROLLED SUBSTANCE
426426 ANALOGUE. For the purposes of the prosecution of an offense under
427427 this subchapter involving the manufacture, delivery, or possession
428428 of a controlled substance, Penalty Groups 1, 1-A, 1-B, 2, [and] 2-A,
429429 and 2-B include a controlled substance analogue that:
430430 (1) has a chemical structure substantially similar to
431431 the chemical structure of a controlled substance listed in the
432432 applicable penalty group; or
433433 (2) is specifically designed to produce an effect
434434 substantially similar to, or greater than, a controlled substance
435435 listed in the applicable penalty group.
436436 SECTION 10. The heading to Section 481.113, Health and
437437 Safety Code, is amended to read as follows:
438438 Sec. 481.113. OFFENSE: MANUFACTURE OR DELIVERY OF SUBSTANCE
439439 IN PENALTY GROUP 2, [OR] 2-A, OR 2-B.
440440 SECTION 11. Section 481.113(a), Health and Safety Code, is
441441 amended to read as follows:
442442 (a) Except as authorized by this chapter, a person commits
443443 an offense if the person knowingly manufactures, delivers, or
444444 possesses with intent to deliver a controlled substance listed in
445445 Penalty Group 2, [or] 2-A, or 2-B.

471471 requested emergency medical assistance in response to the possible
472472 overdose of the actor or another person.
473473 SECTION 13. Section 481.1151(d), Health and Safety Code, is
474474 amended to read as follows:
475475 (d) The defense to prosecution provided by Subsection (c) is
476476 not available if:
477477 (1) at the time the request for emergency medical

531531 SECTION 16. Sections 481.1161(a), (b), (c), and (d), Health
532532 and Safety Code, are amended to read as follows:
533533 (a) Except as authorized by this chapter, a person commits
534534 an offense if the person knowingly possesses a controlled substance
535535 listed in Penalty Group 2-A or 2-B, unless the person obtained the
536536 substance directly from or under a valid prescription or order of a
537537 practitioner acting in the course of professional practice.
538538 (b) An offense under this section is:
539539 (1) a Class C misdemeanor if the amount of the
540540 controlled substance possessed is, by aggregate weight, including
541541 adulterants or dilutants, one ounce or less;
542542 (1-a) a Class B misdemeanor if the amount of the
543543 controlled substance possessed is, by aggregate weight, including
544544 adulterants or dilutants, two ounces or less but more than one
545545 ounce;
546546 (2) a Class A misdemeanor if the amount of the
547547 controlled substance possessed is, by aggregate weight, including
548548 adulterants or dilutants, four ounces or less but more than two
549549 ounces;
550550 (3) a state jail felony if the amount of the controlled
551551 substance possessed is, by aggregate weight, including adulterants
552552 or dilutants, five pounds or less but more than four ounces;
553553 (4) a felony of the third degree if the amount of the
554554 controlled substance possessed is, by aggregate weight, including
555555 adulterants or dilutants, 50 pounds or less but more than 5 pounds;
556556 (5) a felony of the second degree if the amount of the
557557 controlled substance possessed is, by aggregate weight, including
558558 adulterants or dilutants, 2,000 pounds or less but more than 50
559559 pounds; and
560560 (6) a felony of the first degree punishable by
561561 imprisonment in the Texas Department of Criminal Justice for life
562562 or for a term of not more than 99 years or less than 5 years, and a
563563 fine not to exceed $50,000, if the amount of the controlled
564564 substance possessed is, by aggregate weight, including adulterants
565565 or dilutants, more than 2,000 pounds.
566566 (c) It is a defense to prosecution for an offense punishable
567567 under Subsection (b)(1), (1-a), or (2) that the actor:
568568 (1) was the first person to request emergency medical
569569 assistance in response to the possible overdose of another person
570570 and:
571571 (A) made the request for medical assistance
572572 during an ongoing medical emergency;
573573 (B) remained on the scene until the medical
574574 assistance arrived; and
575575 (C) cooperated with medical assistance and law
576576 enforcement personnel; or
577577 (2) was the victim of a possible overdose for which
578578 emergency medical assistance was requested, by the actor or by
579579 another person, during an ongoing medical emergency.
580580 (d) The defense to prosecution provided by Subsection (c) is
581581 not available if:
582582 (1) at the time the request for emergency medical
583583 assistance was made:
584584 (A) a peace officer was in the process of
585585 arresting the actor or executing a search warrant describing the
586586 actor or the place from which the request for medical assistance was
587587 made; or
588588 (B) the actor is committing another offense,
589589 other than an offense punishable under Section 481.115(b),
590590 481.1151(b)(1), 481.116(b), 481.117(b), 481.118(b), or
591591 481.121(b)(1), (1-a), or (2), or an offense under Section
592592 481.119(b), 481.125(a), 483.041(a), or 485.031(a);
593593 (2) the actor has been previously convicted of or
594594 placed on deferred adjudication community supervision for an
595595 offense under this chapter or Chapter 483 or 485;
596596 (3) the actor was acquitted in a previous proceeding
597597 in which the actor successfully established the defense under that
598598 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
599599 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
600600 483.041(e), or 485.031(c); or
601601 (4) at any time during the 18-month period preceding
602602 the date of the commission of the instant offense, the actor
603603 requested emergency medical assistance in response to
604604 the possible overdose of the actor or another person.
605605 SECTION 17. Section 481.117(g), Health and Safety Code, is
606606 amended to read as follows:
607607 (g) The defense to prosecution provided by Subsection (f) is
608608 not available if:
609609 (1) at the time the request for emergency medical
610610 assistance was made:
611611 (A) a peace officer was in the process of
612612 arresting the actor or executing a search warrant describing the
613613 actor or the place from which the request for medical assistance was
614614 made; or
615615 (B) the actor is committing another offense,

632632 SECTION 18. Section 481.118(g), Health and Safety Code, is
633633 amended to read as follows:

659659 SECTION 19. Section 481.119(d), Health and Safety Code, is
660660 amended to read as follows:
661661 (d) The defense to prosecution provided by Subsection (c) is
662662 not available if:
663663 (1) at the time the request for emergency medical
664664 assistance was made:
665665 (A) a peace officer was in the process of
666666 arresting the actor or executing a search warrant describing the
667667 actor or the place from which the request for medical assistance was
668668 made; or
669669 (B) the actor is committing another offense,
670670 other than an offense punishable under Section 481.115(b),

686686 SECTION 20. Sections 481.121(b), (c), and (d), Health and
687687 Safety Code, are amended to read as follows:
688688 (b) An offense under Subsection (a) is:
689689 (1) a Class C misdemeanor if the amount of marihuana
690690 possessed is one ounce or less;
691691 (1-a) a Class B misdemeanor if the amount of marihuana
692692 possessed is two ounces or less but more than one ounce;
693693 (2) a Class A misdemeanor if the amount of marihuana
694694 possessed is four ounces or less but more than two ounces;
695695 (3) a state jail felony if the amount of marihuana
696696 possessed is five pounds or less but more than four ounces;
697697 (4) a felony of the third degree if the amount of
698698 marihuana possessed is 50 pounds or less but more than 5 pounds;
699699 (5) a felony of the second degree if the amount of
700700 marihuana possessed is 2,000 pounds or less but more than 50 pounds;
701701 and
702702 (6) a felony of the first degree punishable by
703703 imprisonment in the Texas Department of Criminal Justice for life
704704 or for a term of not more than 99 years or less than 5 years, and a
705705 fine not to exceed $50,000, if the amount of marihuana possessed is
706706 more than 2,000 pounds.
707707 (c) It is a defense to prosecution for an offense punishable
708708 under Subsection (b)(1), (1-a), or (2) that the actor:
709709 (1) was the first person to request emergency medical
710710 assistance in response to the possible overdose of another person
711711 and:
712712 (A) made the request for medical assistance
713713 during an ongoing medical emergency;
714714 (B) remained on the scene until the medical
715715 assistance arrived; and
716716 (C) cooperated with medical assistance and law
717717 enforcement personnel; or
718718 (2) was the victim of a possible overdose for which
719719 emergency medical assistance was requested, by the actor or by
720720 another person, during an ongoing medical emergency.
721721 (d) The defense to prosecution provided by Subsection (c) is
722722 not available if:
723723 (1) at the time the request for emergency medical
724724 assistance was made:
725725 (A) a peace officer was in the process of
726726 arresting the actor or executing a search warrant describing the
727727 actor or the place from which the request for medical assistance was
728728 made; or
729729 (B) the actor is committing another offense,
730730 other than an offense punishable under Section 481.115(b),
731731 481.1151(b)(1), 481.116(b), 481.1161(b)(1), (1-a), or (2),
732732 481.117(b), or 481.118(b), or an offense under Section 481.119(b),
733733 481.125(a), 483.041(a), or 485.031(a);
734734 (2) the actor has been previously convicted of or
735735 placed on deferred adjudication community supervision for an
736736 offense under this chapter or Chapter 483 or 485;
737737 (3) the actor was acquitted in a previous proceeding
738738 in which the actor successfully established the defense under that
739739 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
740740 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.125(g),
741741 483.041(e), or 485.031(c); or
742742 (4) at any time during the 18-month period preceding
743743 the date of the commission of the instant offense, the actor
744744 requested emergency medical assistance in response to the possible
745745 overdose of the actor or another person.
746746 SECTION 21. Section 481.122(a), Health and Safety Code, is
747747 amended to read as follows:
748748 (a) A person commits an offense if the person knowingly
749749 delivers a controlled substance listed in Penalty Group 1, 1-A,
750750 1-B, 2, 2-A, 2-B, or 3 or knowingly delivers marihuana and the
751751 person delivers the controlled substance or marihuana to a person:
752752 (1) who is a child;
753753 (2) who is enrolled in a public or private primary or
754754 secondary school; or
755755 (3) who the actor knows or believes intends to deliver
756756 the controlled substance or marihuana to a person described by
757757 Subdivision (1) or (2).
758758 SECTION 22. Section 481.124(d), Health and Safety Code, is
759759 amended to read as follows:
760760 (d) An offense under this section is:
761761 (1) a felony of the second degree if the controlled
762762 substance is listed in Penalty Group 1, 1-A, or 1-B;
763763 (2) a felony of the third degree if the controlled
764764 substance is listed in Penalty Group 2, 2-A, or 2-B;
765765 (3) a state jail felony if the controlled substance is
766766 listed in Penalty Group 3 or 4; or
767767 (4) a Class A misdemeanor if the controlled substance
768768 is listed in a schedule by an action of the commissioner under this
769769 chapter but not listed in a penalty group.
770770 SECTION 23. Section 481.125(h), Health and Safety Code, is
771771 amended to read as follows:
772772 (h) The defense to prosecution provided by Subsection (g) is
773773 not available if:
774774 (1) at the time the request for emergency medical
775775 assistance was made:
776776 (A) a peace officer was in the process of
777777 arresting the actor or executing a search warrant describing the
778778 actor or the place from which the request for medical assistance was

780780 (B) the actor is committing another offense,
781781 other than an offense punishable under Section 481.115(b),

789789 in which the actor successfully established the defense under that
790790 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
791791 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.121(c),
792792 483.041(e), or 485.031(c); or
793793 (4) at any time during the 18-month period preceding
794794 the date of the commission of the instant offense, the actor
795795 requested emergency medical assistance in response to the possible
796796 overdose of the actor or another person.
797797 SECTION 24. Section 481.134(f), Health and Safety Code, is
798798 amended to read as follows:
799799 (f) An offense otherwise punishable under Section
800800 481.1161(b)(1-a), 481.118(b), 481.119(b), 481.120(b)(1), or
801801 481.121(b)(1-a) [481.121(b)(1)] is a Class A misdemeanor if it is
802802 shown on the trial of the offense that the offense was committed:
803803 (1) in, on, or within 1,000 feet of any real property
804804 that is owned, rented, or leased to a school or school board, the
805805 premises of a public or private youth center, or a playground;
806806 (2) on a school bus; or
807807 (3) by any unauthorized person 18 years of age or
808808 older, in, on, or within 1,000 feet of premises owned, rented, or
809809 leased by a general residential operation operating as a
810810 residential treatment center.
811811 SECTION 25. Section 483.041(f), Health and Safety Code, is
812812 amended to read as follows:
813813 (f) The defense to prosecution provided by Subsection (e) is
814814 not available if:
815815 (1) at the time the request for emergency medical
816816 assistance was made:
817817 (A) a peace officer was in the process of
818818 arresting the actor or executing a search warrant describing the
819819 actor or the place from which the request for medical assistance was
820820 made; or
821821 (B) the actor is committing another offense,
822822 other than an offense punishable under Section 481.115(b),
823823 481.1151(b)(1), 481.116(b), 481.1161(b)(1), (1-a), or (2),
824824 481.117(b), 481.118(b), or 481.121(b)(1), (1-a), or (2), or an
825825 offense under Section 481.119(b), 481.125(a), or 485.031(a);
826826 (2) the actor has been previously convicted of or
827827 placed on deferred adjudication community supervision for an
828828 offense under this chapter or Chapter 481 or 485;

838838 SECTION 26. Section 485.031(d), Health and Safety Code, is
839839 amended to read as follows:
840840 (d) The defense to prosecution provided by Subsection (c) is
841841 not available if:
842842 (1) at the time the request for emergency medical
843843 assistance was made:
844844 (A) a peace officer was in the process of
845845 arresting the actor or executing a search warrant describing the
846846 actor or the place from which the request for medical assistance was
847847 made; or
848848 (B) the actor is committing another offense,
849849 other than an offense punishable under Section 481.115(b),
850850 481.1151(b)(1), 481.116(b), 481.1161(b)(1), (1-a), or (2),
851851 481.117(b), 481.118(b), or 481.121(b)(1), (1-a), or (2), or an
852852 offense under Section 481.119(b), 481.125(a), or 483.041(a);
853853 (2) the actor has been previously convicted of or
854854 placed on deferred adjudication community supervision for an

864864 overdose of the actor or another person.
865865 SECTION 27. Sections 551.003(11) and (12), Occupations
866866 Code, are amended to read as follows:
867867 (11) "Controlled substance" means a substance,
868868 including a drug:
869869 (A) listed in Schedule I, II, III, IV, or V, as
870870 established by the commissioner of public health under Chapter 481,
871871 Health and Safety Code, or in Penalty Group 1, 1-A, 1-B, 2, 2-A,
872872 2-B, 3, or 4, Chapter 481; or
873873 (B) included in Schedule I, II, III, IV, or V of
874874 the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21
875875 U.S.C. Section 801 et seq.).
876876 (12) "Dangerous drug" means a drug or device that:
877877 (A) is not included in Penalty Group 1, 1-B, 2,
878878 2-A, 2-B, 3, or 4, Chapter 481, Health and Safety Code, and is
879879 unsafe for self-medication; or
880880 (B) bears or is required to bear the legend:
881881 (i) "Caution: federal law prohibits
882882 dispensing without prescription" or "Rx only" or another legend
883883 that complies with federal law; or
884884 (ii) "Caution: federal law restricts this
885885 drug to use by or on the order of a licensed veterinarian."
886886 SECTION 28. Section 521.371(3), Transportation Code, is
887887 amended to read as follows:
888888 (3) "Drug offense" has the meaning assigned under 23
889889 U.S.C. Section 159(c) and includes an offense under Section 49.04,
890890 49.07, or 49.08, Penal Code, that is committed as a result of the
891891 introduction into the body of any substance the possession of which
892892 is prohibited under the Controlled Substances Act. The term does
893893 not include an offense punishable by fine only under the laws of
894894 this state.
895895 SECTION 29. The changes in law made by this Act apply only
896896 to an offense committed on or after the effective date of this Act.
897897 An offense committed before the effective date of this Act is
898898 governed by the law in effect on the date the offense was committed,
899899 and the former law is continued in effect for that purpose. For
900900 purposes of this section, an offense was committed before the
901901 effective date of this Act if any element of the offense was
902902 committed before that date.
903903 SECTION 30. This Act takes effect September 1, 2025.
