66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to an exemption from required disclosure of information
99 related to the next of kin of deceased persons.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 11, Article 49.25, Code of Criminal
1212 Procedure, is amended by adding Subsection (d) to read as follows:
1313 (d) The information relating to the next of kin of a
1414 decedent is excepted from required public disclosure in accordance
1515 with Chapter 552, Government Code, but is subject to disclosure
1616 under subpoena or authority of other law.
1717 SECTION 2. The change in law made by this Act applies to a
1818 request for information that is received by a governmental body or
1919 an officer of public information on or after the effective date of
2020 this Act. A request for information that was received before the
2121 effective date of this Act is governed by the law in effect on the
2222 date the request was received, and the former law is continued in
2323 effect for that purpose.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2025.
