| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 11, Article 49.25, Code of Criminal |
|---|
| 12 | 12 | | Procedure, is amended by adding Subsection (d) to read as follows: |
|---|
| 13 | 13 | | (d) The information relating to the next of kin of a |
|---|
| 14 | 14 | | decedent is excepted from required public disclosure in accordance |
|---|
| 15 | 15 | | with Chapter 552, Government Code, but is subject to disclosure |
|---|
| 16 | 16 | | under subpoena or authority of other law. |
|---|
| 17 | 17 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 18 | 18 | | request for information that is received by a governmental body or |
|---|
| 19 | 19 | | an officer of public information on or after the effective date of |
|---|
| 20 | 20 | | this Act. A request for information that was received before the |
|---|
| 21 | 21 | | effective date of this Act is governed by the law in effect on the |
|---|
| 22 | 22 | | date the request was received, and the former law is continued in |
|---|
| 23 | 23 | | effect for that purpose. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2025. |
