69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to excused absences from public school for certain
912 students to attend mental health care appointments.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 25.087(b), Education Code, is amended to
1215 read as follows:
1316 (b) A school district shall excuse a student from attending
1417 school for:
1518 (1) the following purposes, including travel for those
1619 purposes:
1720 (A) observing religious holy days;
1821 (B) attending a required court appearance;
1922 (C) appearing at a governmental office to
2023 complete paperwork required in connection with the student's
2124 application for United States citizenship;
2225 (D) taking part in a United States naturalization
2326 oath ceremony;
2427 (E) serving as an election clerk; or
2528 (F) if the student is in the conservatorship of
2629 the Department of Family and Protective Services, participating, as
2730 determined and documented by the department, in an activity:
2831 (i) ordered by a court under Chapter 262 or
2932 263, Family Code, provided that it is not practicable to schedule
3033 the participation outside of school hours; or
3134 (ii) required under a service plan under
3235 Subchapter B, Chapter 263, Family Code;
3336 (2) a temporary absence resulting from an appointment
3437 with health care professionals, including mental health
3538 professionals, for the student or the student's child if the
3639 student commences classes or returns to school on the same day of
3740 the appointment; or
3841 (3) an absence resulting from a serious or
3942 life-threatening illness or related treatment that makes the
4043 student's attendance infeasible, if the student or the student's
4144 parent or guardian provides a certification from a physician
4245 licensed to practice medicine in this state specifying the
4346 student's illness and the anticipated period of the student's
4447 absence relating to the illness or related treatment.
4548 SECTION 2. This Act applies beginning with the 2025-2026
4649 school year.
4750 SECTION 3. This Act takes effect immediately if it receives
4851 a vote of two-thirds of all the members elected to each house, as
4952 provided by Section 39, Article III, Texas Constitution. If this
5053 Act does not receive the vote necessary for immediate effect, this
5154 Act takes effect September 1, 2025.
